It is intimated that earlier the brick kiln was granted consent to operate under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/ASR/2017/5260654 dated 22/03/2017, which was valid up to 30/09/2026 for Bricks and Tiles @ 30000 Numbers/Day using mud, soil & clay
Now, the subject cited brick kiln has applied for obtaining varied consent under Air (Prevention & Control of Pollution) Act, 1981 and fresh consent under Water (Prevention & Control of Pollution) Act, 1974 for manufacturing of Brick & Tiles @ 45,000 Nos/day.
Detail of the case are as under: -
1. The brick kiln has submitted CA certificate dated 30/09/2025, which it is gross value of fixed assets of Rs. 29,67,935/-. Accordingly, it has deposited Rs. 49,800/- vide UTR No. 50723771 dated 29/12/2025 as consent fee under Water (Prevention & Control of Pollution) Act, 1974, (including Rs. 500/- as application form fee), Rs. 66,700/- vide UTR No. 10972041 dated 29/12/2025 as consent fee Air (Prevention & Control of Pollution) Act, 1981, (including Rs. 17,400 as penalty under Air Act, 1981, Rs 2900 as NOC regularization fee) to make consent fee adequate up to 30/09/2035 under both Acts against the fixed assets of the industry below 50 Lakhs.
2. The Brick Kiln has submitted the copy of Design adequacy cum Completion certificate issued by Punjab State Council for Science & Technology, Chandigarh vide no. 1304 dated 14/07/2020, mentioning that the subject cited brick kiln has constructed hi-draft brick kiln with zig-zag technology, rectangular in design as per prescribed guidelines. The Brick Kiln has also submitted the copy of dimensional drawing/plan & section of Kiln showing the length of Central Island of brick kiln less than 245 ft.
3. The brick kiln has submitted Land Documents, drawing of brick kiln issued by Punjab State Council for Science & Technology, Chandigarh etc and other requisite documents.
4. The brick kiln has also submitted coal register which is duly verified by M/s Ritesh Chhabra & Co., Chartered Accountants, which shows that the Brick Kiln was non-operational till July, 2020.
The subject cited brick kiln was visited by officer of this office on 07/01/2026 and observed as under: -
1) The brick kiln was not in operation at the time of visit.
2) The brick kiln has been converted into Induced draft technology with zig-zag settings.
3) The passage around the vessel was stabilized with Brick Bats & Keri etc.
4) The approach road to the Brick Kiln is pre-mix carpeted.
5) The brick kiln has provided adequate stack fitted with induced draft fan.
6) No un-authorized fuel found stored in the premises of the brick kiln at the time of visit.
7) The BKO has planted trees along the boundary of the kiln. However, it was guided to plant more saplings in coming season.
Keeping in view of the above, it was recommended that consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 may be granted to the brick kiln for a period up to 30/09/2035 with the special conditions as under: -
a. The brick kiln shall obtain Environmental Clearance for the mining of brick earth in the light of office memorandum no. F-No. IA3-3/45/2021-IA.III [E]-165219] dated 09/08/2024 issued by MOEF&CC, Govt. of India.
b. The brick kiln shall use 20% paddy straw pallet by replacing coal as per order issued by the Board vide letter no. 39914-33 dated 04/12/2025.
c. The consent is subject to the performance evaluation of new technology adopted by the brick kiln.
d. The brick kiln will plant adequate trees around the boundary of the Brick Kiln.
