It is submitted that the industry is a small-scale orange category unit and uses low diesel furnace oil which is permitted under the fuel policy of the board.
Earlier, the industry was visited by officer of the Board on 25.04.2025 and it was observed that the industry is a small-scale unit and is engaged in forging of auto parts. The industry has installed 01 hammer machine, 02 press machines, 01 sherring machine, 01 Kharad Machine, 01 oil-based heating furnace and 01 shot blast machine. No trade effluent was generated by the industry and only domestic effluent is discharged into sewer. The industry failed to produce the any documentary proof regarding production bills and date of the commissioning of unit. The industry is operating its unit without valid NOC/Consents of the Board. As per the latest CPCB classification, the industry falls under the Orange Category and the industry is using low diesel furnace oil which is permitted under the fuel policy of the board.
Accordingly, show cause notice for violations the provisions of the Water Act, 1974 and Air Act, 1981 vide Regional Office letter no. 1429 dated 01.07.2025 was issued to the industry. The industry has neither submitted the reply of show cause notice issued nor apply for consent to operate under the Water Act, 1974 and Air Act, 1981. The industry is violating the provisions of Water Act, 1974 and Air Act, 1981, intentionally and deliberately. The industry is running without obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 of the Board. The industry is violating of provisions of the said Acts, due to above said reasons.
The matter was considered by Competent Authority of the Board and it was decided to issue show cause notice for violation of provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of personal hearing.
Accordingly, show cause notice for violation of provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry with an opportunity of personal hearing before Senior Environmental Engineer, Ludhiana on 04.12.2025, wherein it was decided as under:-
1. The industry shall use only authorized fuel in its furnace as per fuel policy of the Board.
2. Environmental Engineer, Regional Office-4, Ludhiana shall visit the industry to verify its contentions and process consent applications on merit.
Now the industry has applied for fresh consent to operate under the Water Act, 1974 and Air Act, 1981 through OCMMS for Manufacturing of Auto/Tractor & Agriculture parts @ 3.2 MTD and for discharge of domestic effluent @ 0.4 into sewer by installing 01 heating furnace, 01 shot blast machine, 01 hammer, 01 threading and 01 shredding machine.
The industry has deposited CTO fee of amounting to Rs. 5400/- vide R.no. 601619842 dated 01.12.2025 under the Water Act, 1974 and Rs. 7200/- vide R.no. 156960533 dated 01.12.2025 under the Air Act, 1981, which is adequate upto 01.04.2027 (after deducting of NOC and late penalty fee) against the gross fixed assets of Rs. 19.10 Lacs and plant & machinery of Rs. 18.38 Lacs as per CA certificate dated 26.09.2025.
Now the industry was visited by the officer of this office on 12.01.2026 and it was observed as under:-
1. The industry was in operation during visit and is engaged in forging of auto parts.
2. The industry has installed 01 hammer machine, 02 press machines, 01 sherring machine, 01 Kharad Machine, 01 oil-based heating furnace.
3. The industry is using furnace oil (S. max 1.8%) in heating furnace, which is allowed as per fuel policy of the Board.
4. The industry has also installed 01 no. shot blast machine with inbuilt bag house filter.
5. No trade effluent was generated by the industry and only domestic effluent is discharged into sewer.
6. The industry has submitted approved site plan approved by the Competent Person.
7. The industry has submitted rent deed as a proof of date of commissioning i.e. 01.04.2025.
8. The industry is located in designated industrial zone as per Master Plan, Ludhiana i.e. Phase-6, Focal Point, Ludhiana.
9. The industry is complying with the provisions of the Water Act, 1974 and Air Act, 1981.
In view of above it is recommended that the fresh consent to operate under the Water Act, 1974 and Air Act, 1981 may be granted to the industry upto 30.09.2026 with suitable conditions as per policy of the Board.
