It is submitted that the project proponent has applied for obtaining Consent to Establish (NOC) under Water Act, 1974 and Air Act, 1981 for development of a Residential Colony with total no. of residential plots @280, EWS Plots @5157.3 Sq. meter and Shops @25 on 25.53 Acres ( 204 kanal 11.75 Marla) of Land in revenue estate of Talwandi Sabo, under Orange category for which the Project Proponent submit the following documents:
• The Project Proponent has submitted copy of project report, showing total project cost will be Rs. 903/- Lakhs. Accordingly, the project proponent has deposited NOC fee of Rs. 43200/- (including application fees Rs. 500/-) vide Receipt No. 376674342 dated 01.11.2025, (i.e. total Rs. 18000/- as NOC fee and Rs. 500/- as application fees) which is adequate for one year. It is pertinent to mentioned here that after adjusting one year NOC fees, the balance fees remained with the Board will be Rs 24,700/-
• The Project Proponent has submitted copy of approved site plan signed by Senior Town Planner, Bathinda Region, Department of Local Government, Punjab and by Competent Authority, ADC (Urban Development) Bathinda.
• The Project Proponent has submitted copies of land registries and letter of consents duly attested by Executive Magistrate of total 25.5 acre as proof of ownership. The PP has also submitted copy of Aks Sajra, attested by Tehsildar, Talwandi Sabo.
• The PP has submitted license for setting of Residential Colony having license no ADC-UD/CA-BTI-2025/267 dated 30.06.2025 on the name of M/s Damdama Sahib Builders valid upto 24.06.2029 for net area @ 123533.43 Sq yard.
The PP has submitted Authority Letter as per which the authorized person is Sh. Harpal Singh (Partner) to sign and execute the documents.
The PP has submitted the Partnership deed as which there are total 5 partners of the firm namely 1. Sh. Harpal Singh, 2. Sh. Sehajvir Singh, 3. Sh. Balwinder Singh, 4. Sh. Gurpreet Singh, 5. Sh. Davinder Pal Sharma (copy attached).
• The project proponent has submitted copy feasibility report of STP to be installed for the treatment of domestic effluent generated from the colony. As per feasibility report, (Considering 15 persons in residential Plots and 400 persons per acre for ESW area and @1 person per 3 sq. meter) fixed population of ~100 persons and floating population of about 830 (during day time). For commercial area; the total effluent will be generated @525 KLD and considering 20% overloading factor, PP Purposed to install STP of 630 KLD for the treatment of domestic effluent generated. The PP has proposed to utilized @ 220 KLD Reused in dual plumbing, and remaining treated effluent @ 305 KLD will dispose into MC sewer.
• The Project Proponent has submitted copy of permission letter issued by Executive Officer, Municipal Council, Talwandi Sabo vide letter no. 805 dated 03.09.2025 for disposal of treated effluent in MC Sewerage.
• The Total Saleable area is 59050.4 Sq. meter, by Considering FAR value at maximum @2.1 as per bye-laws, the maximum builtup area will be 1,24,005 sq. meter, which is less than 1,50,000 Sq Meter, hence doesn’t Comes under the purview of EIA notification, 2006
• The Project Proponent has proposed in feasibility report that organic waste @ 1 tonnes, will be disposed of in compost pits, whereas recyclable waste@ 1 tonnes, will be lifted recycler. The PP has also submitted permission letter vide no. 806 dated 03.09.2025 issued by MC Talwandi Sabo for lifting of solid waste from the residential colony.
•The site of the project proponent was VISITED by the officer of this office on 14.01.2026 and it was observed that:-
1. The site is located within Municipal limits of Municipal council, Talwandi Sabo.
2. The PP has completed construction of Boundary wall and construction work of roads and leveling of ground was in process during visit.
3. There is no MAH unit within the 250 mtrs from the boundary of the project. There is no brick kiln and cement plant within 300 m and no rice sheller, stone crusher, grinding unit or hot mix plant within 500 mtrs and no air polluting industry within 100 m from the proposed site.
4. The MC Talwandi, has STP of Capacity @3MLD and presently appox. treated 2.5 MLD of waste water. Hence MC- STP has adequate capacity of handling treated waste water of the residential colony.
5. The Total Saleable area is 59050.4 Sq. meter, by Considering FAR value at maximum @2.1 as per bye-laws, the maximum builtup area will be 1,24,005 sq. meter, which is less than 1,50,000 Sq Meter, hence doesn’t Comes under the purview of EIA notification, 2006
As such, the site is suitable for the establishment of project. From the above, it is clear that the site is meeting with the guidelines prescribed by the Board for the establishment of a Residential Colony as per the policy of the Board.
Keeping in view of above, it is recommended that Consent to Establish (NOC) may be granted for the period upto one year to the Project Proponent for development of a Residential Colony with total no. of residential plots @280, EWS Plots @5157.3 Sq. meter and Shops @25 on 25.53 Acres with suitable conditions along with specific conditions as under.
1. The project proponent shall be bound to obtain environmental clearance under EIA notification dated 14.09.2006 in case the built-up area of the project increases above 1,50,000 sq. meters.
2. The project proponent shall utilize maximum effluent inside its premises after treatment in STP, only surplus treated effluent will be discharged into MC sewer leading to terminal STP after getting assessed spare capacity of STP from MC Talwandi Sabo/ PWSSB and after obtaining permission from the concerned authorities.
3. It is made clear to the project proponent that in case the STP provided by Municipal Council Talwandi Sabo do not have adequate treatment capacity, then the project proponent will make its own arrangement to utilize entire treated wastewater.
4. The project proponent shall look for the possibility of utilization of treated effluent of STP for double plumbing, construction work, roadside sprinkling etc.
5. The project proponent shall install STP for treatment of its domestic effluent before its commissioning.
6. The project proponent will handle its solid waste as per the provisions of the Solid Waste Management Rules, 2016 and make adequate arrangements for treatment of wet waste and source of generation……………….
