Land Documents:
The unit has submitted the sale deed dated 12.07.2024 executed between M/s Unicraft Panels and M/s Starhead Enterprises of total land area 22 Kanal 18 Marle (2.86 acres) vide H.B. No. 197 falls in the revenue estate of Village Majri, Tehsil Khamano, District Fatehgarh Sahib.
Site Suitability:
The unit has submitted a copy of letter vide no. 75 dated 20.01.2025 issued by DTP, Fatehgarh Sahib (attached herewith), vide which, the site of the industry is a part of notified Local Planning Area of Khamanon for which the Master Plan is yet to be prepared. As such, the approval for operation of the unit has been considered according to Right to Business Act subject to the condition that "The applicant shall be liable to abide by the provisions of the Master Plan and shall also be bound to follow the provisions of the section 79 along with other provisions of the PRTPD Act, 1995. In case, the site falls in non-conforming land zone after the notification of Master Plan and no claim shall be demanded by the applicant from the Department."
Further, the unit has submitted the Certificate of In Principal Approval issued by DC Fatehgarh Sahib vide application id 2501782993 dated 10.03.2025 under Punjab Right to Business Act, 2020 for sorting, segregation, grading and sizing of metal scrap. Additionally, the unit has submitted the report dated 14.01.2025 issued by Tehsildar, Khamanon, vide which, there is no Village Lal Lakir, Phirni, Cluster of 15 pucca houses and MC limit within 100-meter radius of the site. As such, the site is suitable for operation of the godown.
Building Plan:
The unit has submitted the building plan approved by Er. Gurmeet Singh, Competent Person, recognized by Director of Factories, PB.
Visit:
To verify the contents of the application, the godown was visited by the undersigned on 02.01.2026 and Sh. Kanav Goyal, Manager was contacted. During visit, it was observed as under:
1. The godown was in operation and engaged in sorting/segregation of scrap.
2. The industry is situated opposite to M/s A.K. Concast Pvt. Ltd., which is an Induction Furnace unit.
3. The industry is surrounded by agricultural lands. There is no Village Lal Lakir, Phirni, Cluster of 15 pucca houses and MC limit within 100-meter radius of the industry as observed during visit.
4. The godown has installed magnetic separator using conveyor belt for segregation of iron and scrap.
5. The godown is also involved in manual segregation/sorting of scrap using gas cutting/torching and with hand tools.
6. The godown has not installed any boiler/furnace in its premises.
7. The godown has installed a DG set of capacity 12 KVA, which is equipped with canopy and stack of adequate height.
8. The godown has provided septic tank for treatment of its domestic effluent generated from toilet/bathrooms and the same is being discharged onto land for plantation.
9. The godown has removed all the plant & machinery from the old site. The photographs of old site are in the note attached herewith.
From above, it is clear that the godown is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.
Recommendations:
In view of the facts mentioned above, if approved, the fresh consent to operate under the provisions of the Air (Prevention & Control of Pollution) Act, 1981 for Graded size segregated ready to feed furnace material suitable for secondary metal production of iron and steel, Aluminum, Copper and zinc @ 53 MTD may be granted upto 30.06.2026 with suitable conditions and following special conditions:
1. This consent is granted in the supersession of earlier granted consent to operate under the Water Act, 1974 vide no. CTOW/Varied/FGS/2022/18430080 dated 22.04.2022 and under the Air Act, 1981 vide no. CTOA/Varied/FGS/2022/18429899 dated 22.04.2022, both were valid upto 31.12.2030 under Green category.
2. The applicant shall be liable to abide by the provisions of the Master Plan and shall also be bound to follow the provisions of the section 79 along with other provisions of the PRTPD Act, 1995. In case, the site falls in non-conforming land zone after the notification of Master Plan and no claim shall be demanded by the applicant from the Department.
3. The godown shall not engage in sorting/segregation of scrap contaminated with used oil/spent oil or any other secondary waste in its activity.
4. The godown shall not engage in any kind of burning activities of metal scrap.
5. The godown shall obtain one time authorization for import of scrap under HWM Rules, 2016 within 15 days.
6. The godown shall engage in pre-processing of metal scrap mentioned under Part-D of Schedule-III for import or export and includes all such waste generated indigenously within the country i.e. B1010 and B1050 only.
7. The godown shall not generate and discharge any kind of trade effluent.
8. The project proponent shall not throw, burn or burry any solid wastes in open, outside premises or in drain/water bodies.
9. The project proponent shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic, through their Corporate Environment Responsibility (CER) activities.
10. The project proponent shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner.
11. The godown shall provide thick plantation of spreading crown varieties of evergreen trees all along the boundary wall.
12. The godown shall inform the Board in writing as and when any change is occurred in the Partnership Deed / Proprietorship / Memorandum of Article of Association, especially with regard to the name and address of the Partner / Proprietor / Director / Subscriber etc. and in any case the industry fails to do so and later on it comes to the notice of the Board that there is any change in Partnership Deed / Proprietorship / Memorandum of Article of Association, action as deem fit under the provision of said Act shall be taken.
13. This consent is being issued as per the documents and submissions made by the applicant. However, if at any point of time in future, any document or submission is found wrong or in-correct, this consent shall stand deemed cancelled.
