It is submitted that earlier the brick kiln was granted consent to operate under Air (Prevention & Control of Pollution) Act, 1981 vide no. R14ASRCTOA1882947 dated 04/10/2014, which was valid upto 30/09/2019 for manufacturing of Brick & Tiles @ 30,00,000 Number/Year.
The brick kiln was visited by officer of this office on 08/02/2020 and observed that the brick kiln was not converted into Zig-zag technology. Accordingly, directions u/s 31- A of Air (Prevention & Control of Pollution) Act, 1981 were issued the by the Board vide letter no. 1791-93 dated 06/07/2020 to the District Food & Supply Controller, Amritsar to suspend the license of the brick kiln with immediate effect. Thereafter, District Food & Supply Controller, Amritsar vide letter no. 6902 dated 29/12/2020 intimated this office that license of the subject cited brick kiln has been suspended.
Now, the subject cited brick kiln has applied for varied consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and fresh consent under Water (Prevention & Control of Pollution) Act, 1974 for manufacturing of Brick & Tiles @ 30,00,000 nos/year, as the brick kiln has converted into hi-draft brick kiln with zig-zag technology.
Detail of the case are as under: -
1. The brick kiln has submitted CA certificate dated 12/11/2025, as per which gross value of fixed assets is Rs. 20,83,457/-. Accordingly, it has deposited Rs. 46,800/- vide UTR No. 545067623 dated 05/01/2026 as consent fee under Water Act, 1974 (including Rs. 14,400/- as penalty under Water Act, 1974), Rs. 49,100/- vide UTR No. 542234819 dated 05/01/2026 as consent fee Air Act, 1981, (including Rs. 14,400/- as penalty under Air Act, 1981, Rs. 1800/- as NOC regularization fee & Rs. 500/- as application form fee) to make consent fee adequate up to 30/09/2035 under both Acts.
2. The brick kiln has also submitted coal register which is duly verified by M/s KAN & Associates, Chartered Accountants, which shows that the Brick Kiln was operated only for one month in April, 2019 till July, 2022. Accordingly, the Brick Kiln has deposited EC of Rs. 25,000/- vide this office R. No. 25/5556 dated 07/01/2026 for operation of its kiln for one month period in April, 2019.
3. The Brick Kiln has submitted the copy of Design adequacy cum Completion certificate issued by Punjab State Council for Science & Technology, Chandigarh vide no. 372 dated 15/07/2022, mentioning that the subject cited brick kiln has constructed hi-draft brick kiln with zig-zag technology, rectangular in design as per prescribed guidelines. The Brick Kiln has also submitted the copy of dimensional drawing/plan & section of Kiln showing the length of Central Island of brick kiln less than 245 ft.
4. The brick kiln has submitted Land Documents, drawing of brick kiln issued by Punjab State Council for Science & Technology, Chandigarh etc. and other requisite documents.
The subject cited brick kiln was visited by undersigned on 14/01/2026 and observed as under: -
1) The brick kiln was not in operation at the time of visit.
2) The brick kiln has been converted into Induced draft technology with zig-zag settings.
3) The passage around the vessel was stabilized with Brick Bats & Keri etc.
4) The approach road to the Brick Kiln is pre-mix carpeted.
5) The brick kiln has provided adequate stack fitted with induced draft fan.
6) No un-authorized fuel found stored in the premises of the brick kiln at the time of visit.
7) The BKO has planted trees along the boundary of the kiln. However, it was guided to plant more saplings in coming season.
It is further intimated that the Brick Kiln is complying with the conditions of consents granted earlier under Air (Prevention & Control of Pollution) Act, 1981. The unit falls in orange category in small-scale sector and competency to decide the case lies with Environmental Engineer.
Keeping in view of the above, it is recommended that:
1. Consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 may be granted to the brick kiln for a period up to 30/09/2035 with special conditions as under:
a. The brick kiln shall obtain Environmental Clearance for the mining of brick earth in the light of office memorandum no. F-No. IA3-3/45/2021-IA.III [E]-165219] dated 09/08/2024 issued by MOEF&CC, Govt. of India.
b. The brick kiln shall use 20% paddy straw pallet by replacing coal as per order issued by the Board vide letter no. 39914-33 dated 04/12/2025.
c. The consent is subject to the performance evaluation of new technology adopted by the brick kiln.
d. The brick kiln will plant adequate trees around the boundary of the Brick Kiln. (Competency EE, RO, Amritsar).
2. Directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 may be issued to District Food & Supply Controller, Amritsar for permanent restoration of license (Competency: CEE, Jalandhar after concurrence of Hon'ble Chairperson).
