File Note: A. It is submitted that the industry is large scale red category unit. B. Earlier, the industry had not submitted action plan along with PERT chart for the installation and commissioning of ZLD plant as already decided during hearing given on 16.06.2023 till date. No physical progress has been made by industry to achieve zero liquid discharge. The industry was given deadline to upgrade its ETP to ZLD upto 31.03.2024, but no progress was given by the industry till date. The industry had not submitted the Bank guarantee amounting to Rs. 50 Lacs as an assurance to provide ZLD as per decision of the personal hearing dated 16.06.2023. The industry was found violating of provisions of the said Act, due to above said reasons. And whereas, the Government of Punjab issued directions vide orders no. 10/228/2019/STE5/1594066/1 dated 10.10.2019 u/s 5 of the Environment (Protection) Act 1986 to the effect that "industrial effluents and dairy waste whether treated / partially treated or untreated shall not be discharged into Municipal sewer."The Competent Authority of the Punjab Pollution Control Board had decided that directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 be confirmed for the closure of the industry and disconnection of electric supply available to it by the PSPCL Authorities and sealing of wet process and DG set as the industrial activity is endangering the environment and ecosystem and in light of decisions of Hon'ble Supreme Court of India in writ petition no. 375 of 2012 titled as Paryavaran Suraksha Samiti and another v/s Union of India and others. The industry had been issued directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 and the following directions as under:- a. That the industry shall close down its operations and production activities and shall dismantle and remove all outlets and stop forthwith discharging its waste water onto land for plantation/sewer or through any other mode. b. That the machinery and wet processes related to the generation of trade effluent and the DG sets installed by the industry be sealed, immediately. c. That the Punjab State Power Corporation Limited will disconnect the supply of electricity available to industry. C. Accordingly, the directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 was issued to PSPCL authorities vide letter no. 759-62 dated 07.02.2025: - “That authorities concerned shall disconnect the supply of electricity available to the premises of subject cited industry with immediate effect”. D. In compliance of above the PSPCL has disconnected the electric supply of the industry vide TDCO no. 274/112 dated 20.02.2025. The wet machinery of the industry and DG set has also now been sealed. E. Thereafter the industry has applied for consent to operate under the Water Act, 1974, which was granted to the industry vide no. CTOW/Fresh/LDH4/2025/28115786 dated 10.03.2025, which is valid upto 09.09.2025 and electric connection of the industry was temporary restored upto 09.09.2025 with special conditions that:- 1. The industry shall submit a PERT chart with clear timelines of each & every activity to ensure that ZLD upgradation and commissioning shall be completed by 31.12.2025, positively, within 07 days. 2. The industry will submit the progress with respect to the upgradation of ETP to ZLD technology well before the 5th of every month alongwith the photographs and expenditure details vis-à-vis the timelines given in the PERT chart. 3. The industry shall deposit environmental compensation to be calculated for the recent violations reported on 17.01.2025 by the Board. 4. The project proponent may also develop the vermicomposting/composting to manage the biodegradable solid waste. The project proponent shall not throw, burn or bury any solid wastes in open, outside premises or in drain / water bodies. 5. The project proponent shall perform / promote its Corporate Environment Responsibility (CER) activities as well as use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic (See attached banner/circular). 6. The project proponent shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises. 7. The project proponent shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner. F. Now, the industry has applied for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974. G. The industry has already deposited consent fee Rs. 2,18,900/- (Rs. 2,04,000/- under Water Act, 1974, Rs. 14,400/- as NOC regularization, Rs. 500/- form fee) vide R.No. 430297660 dated 25.02.2022against the gross value of fixed assets Rs. 2495.88 Lacs and plant & machinery Rs. 1838.56 Lacs as on 31.03.2025. The consent fee is adequate upto 31.03.2026. H. The industry has now submitted a PERT chart for Zero Liquid Discharge (ZLD) implementation. The gist of chart indicates that it will complete its ZLD process within 16 months’ time. I. Now, the industry was visited by the officer of this office on 12.01.2026 and it was observed as under:- 1. The industry was in operation during the visit. The construction work of the ZLD system was ongoing. 2. The industry has completed the scheme finalization and vendor selection, site preparation, civil construction (phase-1), RCC tank, Screw Press, Thermic Fluid Boiler for the MEE system, 200 KL tank constructed and heat recovery system has been installed. The construction of the MBBR tank was ongoing and the construction of Main tank of 1500KL also in process. 3. The industry has installed the online continuous effluent quality monitoring system (OCEMS) and the same is working. 4. The industry has made arrangement for recovery & reuse of cooling water and steam condensate. The cooling water is reused in the process and steam condensate is being reused as boiler feed water. 5. The industry has installed physico-chemical followed by biological treatment plant for treatment of trade effluent generated from dyeing section and having components i.e. collection tank, mixer, primary tuber settler, biological tank, secondary tube settler, sand & carbon filter and sludge drying bed. The industry has made up-gradation in its ETP and its working by adding new dosing pumps, additional holding tank, new sludge press and 02 additional multi media filters, refurbished its Multi-Grade Filter (MGF) and Activated Carbon Filter (ACF). The industry has installed automated of backwash process. 6. The effluent sample was collected on 23.07.2025 and as per the analysis report received from the Zonal Lab, Ludhiana, the results are pH=7.3, TSS=15 mg/l, TDS=2085 mg/l, BOD=10 mg/l, COD=56 mg/l, O&G= BDL, Sulphides = 2.0 mg/l, Phenolic Compounds=BDL, Ammonical Nitrogen=BDL, Total Chromium=<0.1 mg/l and SAR=8.2, which are within permissible limit prescribed by the Board. 7. The industry had submitted a B.G. of Rs. 10.0 Lakhs, which is valid upto 16.10.2026 in this office. 8. The industry has submitted a request letter for Extension of its period of installation of ZLD due to Heavy Rains in the monsoon season. Earlier as per the PERT chart submitted by the industry Date of Commissioning of the ZLD was proposed as 31.12.2025. Recommendations: - Keeping in view of above, it is recommended that Show Cause notice may be issued to the industry to decide the period of validity of Consent to be granted to the industry.
