File Note: It is submitted that the proceedings of the personal hearing held before the Chairperson of the Board on 15/01/2026 for violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 as well as for violations of the provisions of the Hazardous & Other Wastes (Management & Transboundary Movement) Rules, 2016 includes the table of SOPs which can't be reflected in the noting. Thus, copy of the draft proceedings have been enclosed herewith for kind perusal & approval, please.... Also the submissions made by the industry during the hearing and the decision taken are placed below for ready reference:..... The representatives of the industry attended the hearing and submitted a written reply, which was taken on record. They informed that industry has tried to comply with the SOPs laid down by CPCB in July 2017 for utilization of flue gas cleaning residue generated from steel scrap melting induction furnace for zinc extraction, but there are some conditions which cannot be complied with due to operational constraint. The loading of flue gas cleaning residue using mechanized conveyor system is not feasible as the raw material is highly corrosive and having high temperature which can melt the belt of the conveyor. They further informed that the gas burner for igniting flue gas cleaning residue as well as addition of chemicals, additive, leachate and filtrate is not feasible. They also stated that leaching tank and neutralization tank are closed tanks, hence there are no chances of any emission, due to which there is no need of APCD.... It emerged during the hearing that the representatives of the industry have neither explained the technical reasons for not complying with the aforesaid conditions of SOPs laid down by CPCB for such type of units nor have taken any substantial measures to control the fugitive/ dust emissions being generated from the slag crushing unit..... After hearing, the representatives of the industry, officers of the Board, and material facts on the record, the Chairperson of the Board decided that:- 1. The industry shall make the compliance of the SOPs issued by CPCB for such type of units including the observations made by EPS team as conveyed in the notice, to provide OCEMS with all the stacks appended to APCDs and shall connect it with the server of the Board, within three months. 2. The industry shall make the compliances of the observations observed by the EPS team in slag crushing unit, within three months. 3. The industry shall furnish a comprehensive bank guarantee amounting to Rs. 50 lakh as an assurance to comply with the SOPs issued by CPCB for such type of units, compliance of decision at Sr. no.1 & 2 as well as environmental laws, within 7 days. 4. The industry shall be re-visited by the same EPS which earlier visited the unit to check the compliance made by the unit, after three months and submit the report to Member Secretary of the Board within 15 days, thereafter. 5. Upon receipt of Bank guarantee as per above decision, the consents to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 as well as authorization under Hazardous & Other Wastes (Management & Transboundary Movement) Rules, 2016 filed by the industry be granted for three months. 6. Further action in the matter shall be taken after the receipt of the compliance verification report from the EPS.... (Competency : Chairperson Ma’am)
