Background
It is submitted that the project proponent has earlier obtained renewal of consent to operate vide no. CTOW/Renewal/SAS/2025/28396158 dated25.04.2025 under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and vide no. CTOA/Renewal/SAS/2025/28396094 dated 25.04.2025 Air (Prevention & Control of Pollution) Act, 1981, both having validity upto 31/12/2025 for development of Group Housing (475 Nos.), Commercial (71 Nos.), Plots (2071 Nos.), Villas (62 Nos.), Bungalows (63 Nos.), Floors (36 Nos.), along with certain suitable conditions mentioned therein.
Environment Clearance
The project proponent had obtained environmental clearance vide no. DECC/SEIAA/2020/1512 dated 19.03.2020 for the development of Integrated Township namely “Mohali Hills” at Sector- 98, 99, 104, 105, 106, 108, 109 and 110, SAS Nagar, Mohali, Punjab, which was earlier granted Environmental Clearance by MoEF, Government of India vide letter no. 21-171/2007- IA.III dated 18.06.2008 in an area of 888.50 acres of Sector 98, 105 108 & 109, SAS Nagar, Mohali, for total plot area of 625.35 acres (or 253.07 hectares) and Builtup area 8,61,844.852 sq.m. and Green area 1,73,326.86 sqm. (42.83 acres).
Present status
Now, the project proponent has applied for obtaining renewal of consent to operate under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for development of Group Housing (475 Nos.), Commercial (71 Nos.), Plots (2071 Nos.), Villas (62 Nos.), Bungalows (63 Nos.) and Floors (36 Nos.), along with requisite documents.
Fee details
The project proponent has deposited Rs. 1128000 vide Ref. no. HSBCR22025112833523237 dated 28.11.2025 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 1128000 vide Ref. no. HSBCR22025112833523238 dated 28.11.2025 under the Air (Prevention & Control of Pollution) Act, 1981. After deducting the NOC regularization fee, the fee deposited by the project proponent is adequate for 1.5 years under the Water (Prevention & Control of Pollution) Act, 1974 and 02 years under the Air (Prevention & Control of Pollution) Act, 1981 against the total project cost of Rs. 793.654 crores. The project proponent has submitted a CA certificate of total fixed assets of Rs. 793.654 crores dated 14.11.2025.
Project Overview
The project proponent has submitted the compliance report of previous obtained consent to operate from the Board.
Visit Report
The site was visited by the undersigned on 09.01.2026. During the visit, it was observed as under:
1. The promoter company has installed 2 no. STP of capacity 2.5 MLD (for sectors 99,104,105 & 106) and 1 no. STP of capacity 5 MLD (for sectors 108 & 109) based on SBR technology. STP of capacity 2.5 MLD is installed in sector- 105 and STP of 5 MLD is installed in sector-108.
2. During the visit, STP of capacity 2.5 MLD installed by the project proponent was in operation.
• However, the screens were not operational at the time of visit. The site representative informed that the same have been non-functional for the past few weeks due to a technical fault.
• An unused tank filled with untreated water was there adjoining to the STP but the representative failed to explain regarding purpose of the said tank.
• During the visit, stagnation/wild growth was observed in the STP area leading to poor housekeeping. Further, from the condition of the STP, it reflects that the components are not being cleaned/maintained regularly.
• During the visit, samples from the outlet of STP were collected and sent to HO Lab, Patiala for further analysis. The results of the same are awaited.
• The project proponent has shown the record of the STP w.e.f. 01.01.2026 but could not show the record of previous months during the visit.
3. STP of capacity 5 MLD
• STP was in operation at the time of visit.
• Screens of the STP were completely dry which seems that the same has been not operated since long and the conveyer belt for carrying the trash of screens was not in proper working condition.
• STP sludge was littered on the ground near STP indicates poor handling of the same.
• One DG set was installed at the STP site, having capacity 100 kVA equipped with canopy and stack of adequate height.
• Poor housekeeping was observed at the site. Wild vegetation along with stagnant water was found within the premises.
• Significant quantity of stagnant water was found around this STP on the vacant land which belongs to the project proponent for EWS and the representative informed that this land is handover to GMADA. However, the villagers nearby informed that STP water was being disposed by the project proponent onto this land.
• The project proponent has not developed any Karnal Technology for disposal of wastewater. However, the intention of the project proponent is that entire treated water is being utilised in the lawn area which does not seems feasible.
4. Three (03) DG sets were installed at the STP site of capacity 2.5 MLD, having capacities of 250 kVA, 100 kVA, and 50 kVA. The DG sets of 100 kVA and 50 kVA capacities were provided with stacks of inadequate height.
5. Samples were collected from both of the STPs during the visit and the same were sent to HO Lab, Patiala for the analysis. Results of the same have been awaited.
6. The promoter company has provided 2 no. organic composter of capacity 500 kg/day. The record of the same was not being maintained.
7. The project proponent has not provided any designated hazardous room for storage of Hazardous waste generated from the DG sets.
8. The project proponent has not yet installed SCADA system as per the special condition no. 01 of the last obtained consent to operate from the Board.
Recommendations
From above, the project proponent is found non-complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 as well as conditions of EC granted to it.
In view of above, may if approve, it is recommended that renewal of Consent to Operate under the provisions of Water (Prevention & control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 may be refused, please and the project proponent be issued show cause notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981.
