Kindly peruse the note of EE, ZO. On examination of the same, it is submitted that the unit is a small-scale, Orange Category industry.
Earlier, directions under Section 33-A of the Water Act, 1974 and Section 31-A of the Air Act, 1981 were issued vide order dated 09.09.2022 for disconnection of electricity. On compliance of the earlier violations, the electricity connection was temporarily restored on 22.05.2023 for six months (up to 21.11.2023) and Consent to Operate was granted up to 21.11.2023. Thereafter, the unit obtained CTO under auto-renewal mode up to 31.03.2025; however, the same was revoked as action under Section 33-A/31-A was pending. Accordingly, the unit was directed to apply afresh vide letters No. 2022 dated 23.08.2024 and No. 2250 dated 19.09.2024. PSPCL was also requested vide letter No. 2560-64 dated 16.10.2024 to disconnect the electricity connection and provide TDCO. Subsequently, CTO under both Acts was granted up to 19.09.2025. Now, the unit has applied again for grant of fresh CTO under the Water Act, 1974 and the Air Act, 1981.
The unit was inspected by the Regional Office on 05.12.2025 and was found complying with the provisions of the Water Act, 1974 and the Air Act, 1981. The unit has submitted letter of DTP, Ludhiana vide No. 443 dated 20.02.2023, wherein it is clarified that the site falls in Agricultural Zone as per the approved Master Plan Samrala (2012–31), and industrial units are permissible as per Department of Housing and Urban Development notification No. PS/PSHUD/206 dated 12.11.2021, subject to regularization/CLU and approval of building plan as per applicable policy and notifications. The unit has also submitted the building plan approved through the Architect of the Director of Factories, Punjab. Further, as per the inspection/report, the unit meets the prescribed siting criteria, including the required distances from abadi.
In view of the above, if approved:
1. Consent to Operate under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 may be granted up to 30.09.2028, subject to conditions as per policy of the Board. (Competency: SEE)
2. Permanent restoration of the electricity connection may be granted-in light of Office Memo No. 428 dated 23.09.2025. (Competency: CEE) |
