The report/ recommendations of RO in the matter has been perused and it was noted as under:
• The project proponent was earlier granted fresh consent to establish (NOC) from PBIP dated 17.07.2023 having validity till 09.06.2024 under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for Group Housing project in total land area of 24050.76 sqm and having max. built up area of 102981 sqm consisting of components as 272 flats & 18 shops, subject to some of the following special conditions as under:
4. The project proponent shall obtain revised Environment Clearance from the competent authority for the increase in built-up area from 95394 Sqm to 102981 sqm, on the basis of revised conceptual layout plan submitted alongwith this application.
5. The project proponent shall not carry out any construction in aberration to the conceptual plan submitted at the time of grant of Environment Clearance to it (having total built-up area of 95394 Sqm), to refrain from committing violation & action thereof under the Environment (Protection) Act, 1986.
6. The project proponent shall get its revised conceptual layout plan approved from the competent authority (having total built-up area of 102981 Sqm).
7. After obtaining revised Environment Clearance as mentioned at above point; the promoter shall develop its Group Housing project strictly in accordance with the layout plan to be approved to be approved by the Competent Authority.
8. The promoter company shall install STP of capacity 225 KLD based on SBR technology for the treatment of domestic effluent generated by the project proponent, as proposed by it.
9. The project proponent shall provide necessary arrangements for usage of the treated effluent after STP for flushing purpose @ 61 KLD and shall develop adequate green/ plantation area in 6423 sqm area for discharge of the treated effluent after STP @ 35.32 KLD-11.56 KLD-3.21 KLD during Summer-Winter-Monsoon Season respectively. Only, the remaining treated effluent shall be allowed for discharge into Sewer during Summer-Winter-Monsoon Season respectively after obtaining NOC from the competent authority regarding sewerage connection for the same, in accordance with the Environment Clearance granted to it by SEIAA, Punjab.
• Earlier, the project proponent had obtained Environmental Clearance vide no. EC22B038PB140579 dated 02.03.2022 for the project in total land area of 24050.76 sqm and having maximum built up area of 95,394 sqm and green area of 6423 sqm consisting of components as 366 Flats and 28 shops. Later, the project proponent had obtained amended Environmental Clearance dated 16.04.2024 for increase in built-up area from 95,394 sqm to 129171 sqm, , decrease in no. of flats from 366 to 348 and decrease in population from 1886 to 1796, increase in project cost from Rs. 261.49 Crore to Rs. 306.49 Crore and decrease in Green Area from 6423 sqm to 6279 sqm w.r.t to same terms and conditions as imposed in the original Environmental Clearance granted vide SEIAA letter No. EC22B038PB140579 dated 02.03.2022. The EC has been granted with water consumption as 238 KLD, Flushing as 78 KLD and total wastewater generation as 190 KLD.
• Thereafter, the project proponent has obtained extension in the validity of the said consent to establish (NOC) from PBIP dated 06.08.2024 having validity till 09.06.2025 subject to some of the following special conditions as under:
1. The project proponent shall not carry out any construction in aberration to the conceptual plan submitted at the time of grant of amendment in Environment Clearance by the SEIAA, Punjab vide no. 2024/EC/A/59 dated 16.04.2024, to refrain from committing violation & action thereof under the Environment (Protection) Act, 1986.
2. The project proponent shall get its revised layout plan approved from the competent authority in congruence to the revision in total built-up area as 129171 Sqm, for which amendment in Environment Clearance has been granted by the SEIAA, Punjab vide no. 2024/EC/A/59 dated 16.04.2024.
3. The project proponent shall immediately provide anti-smog gun as per CPCB guidelines at site and submit compliance to the Regional Office of the Board.
• Now, the project proponent has applied for obtaining expansion of consent to establish/NOC under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for Group Housing project in total land area of 24050.76 sqm and having max. built up area of 129171 sqm (as per application form but layout plan approved for 127511.006 sqm) consisting of components as 348 flats & 27 shops with green area as 6160.79 sqm, along with requisite documents. The project proponent has proposed its project cost as Rs. 568.54 Crore.
• The project proponent has submitted a copy of latest building/ layout plan of the project according to which the built-up area of the project is given as 127511.006 sqm and green area is given as 6160.79 sqm, with the same no. of flats as 348 for which amended EC accorded to it.
• The project proponent has proposed in its feasibility report that the total water requirement shall be 238 KLD, wastewater generation shall be 190 KLD to be treated through STP of capacity 275 KLD based on SBR technology, out of treated wastewater 78 KLD shall be reused for flushing, 34.5 KLD – 11 KLD – 3 KLD shall be utilized in green area measuring 6279 sqm during summer – winter – monsoon seasons respectively and excess max. 105 KLD shall be discharged into MC Sewer.
• The site of the project was visited by the undersigned on 31.12.2025 and contacted Mr. Pritpal Singh. During the visit, it was observed as under:
1. The site is a residential project comprising 07 no. of towers having construction as - (S + 23) 2x (S + 24) 2x (S + 26) 2x (S + 27) . The project has 348 no. of total flats & 27 no. of shops located at sector 88, Mohali.
2. The site was under construction and the present status of construction is mentioned below:
Tower T1A → 4 BHK → 42 no. of flats structure has been completed.
Tower T2A → 3 BHK → 44 no. of flats structure has been completed.
Tower T3A → 3 BHK → 20 no. of flats structure has been completed.
Tower T2C → 3 BHK → 40 no. of flats structure has been completed.
Tower T1C 3 BHK → construction of the basement has been started
Tower T1B → 4 BHK → Basement completed.
Tower T2B4 BHK under construction.
3. No occupancy has been provided on the site.
4. No labour hutments provided on site. Hence, no labour is residing at site.
5. The project proponent is using water through tankers for construction. Approximately 05-06 no. of tankers of capacity 4000 liters is used each day.
6. 02 no. of borewells provided with water meter was observed at site.
7. Domestic wastewater generated within the premises is being lifted by tanker.
8. The project proponent has installed one no. anti-smog gun for suppression of dust emissions.
9. The unit has provided 03 no. DG set of capacity 250 KVAX01 and 125KVAX02 equipped with canopy and stack of adequate height.
10. The unit has provided 01 no. RMC plant namely M/s Yash construction company in its premises for construction purpose.
• The RO has concluded in its report that the project proponent is found complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981; and recommended that the expansion in consent to establish (NOC) be granted for 02 years under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
From the above facts; it is brought out as under:
1. As per the amended layout plan of the project attached by RO, the total covered area/ built-up area is given as 127511.006 sqm & green area as 6160.79 sqm and the project cost proposed by the project promoter after expansion is Rs. 568.84 Crore, which is in aberration to the terms for which EC has been accorded to the project i.e. total built up area as 129171 sqm with 6279 sqm area earmarked for green area development at site and total project cost as Rs. 306.49 Crore; though the no. of proposed dwelling units remained the same as 348 nos. It is brought out that, as per Office Memorandum issued by MoEF&CC, New Delhi dated 10.09.2025, wherein it has been given as under:
“5. Accordingly, matter has been examined and it has been decided that any change in configuration/planning/design of the appraised building Project for which EC was granted shall not require amendment in EC, provided there is no increase in:
(v) Built Up Area as defined in the EIA Notification
(vi) Total excavation of earth
(vii) Height of the building, and
(viii) Water consumption/ Sewage generation/ Waste generation; so as not to require any changes in the already approved Environmental Impact Assessment (EIA) and Environmental Management Plan (EMP).
Further there shall be no reduction in the exterior open spaces/green belts and no change in the designated use of the building.”
In the present case, since there is reduction in proposed green area from 6279 sqm to 6160.79 sqm; though reduction in proposed built-up area from 129171 sqm to 127511.006 sqm; the project proponent may be required to obtain amendment in EC from the competent authority for the said changes.
2. Also, there is considerable increase in project cost from Rs. 306.49 Crore to Rs. 568.84 Crore, for which the project proponent may get its AEA activity targets revised from the competent authority.
In view of the above facts and the report/ recommendations of RO; if approved, the Consent to Establish (Expansion) under the Water (Prevention & control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for establishment of Group Housing project in total land area of 24050.76 sqm and having max. built up area of 127511.006 sqm (as per the layout plan) consisting of components as 348 flats & 27 shops with green area as 6160.79 sqm, be granted to the project proponent for period of two year from date of expiry of last CTE Extension obtained by it i.e. upto 09.06.2027, subject to suitable general conditions and the following additional conditions that:
1) This CTE is valid for establishment of the Group Housing project namely Joy Grand at Sector 88, SAS Nagar in total land area of 24050.76 sqm and having max. built up area of 127511.006 sqm (as per the layout plan) consisting of components as 348 flats & 27 shops with green area as 6160.79 sqm, only.
2) The project proponent shall get its Environment Clearance amended from the competent authority for the reduction in proposed green area from 6279 sqm to 6160.79 sqm; though reduction in proposed built-up area from 129171 sqm to 127511.006 sqm, increase in project cost from Rs. 306.49 Crore to Rs. 568.84 Crore (for which the project proponent may get its AEA activity targets revised from the competent authority) and submit to the Board.
3) The promoter company shall comply with conditions mentioned in the Environmental Clearance granted to it by the SEIAA vide no. SEIAA/PB/MIS/2022/EC/04 dated 02.03.2022 and amendments issued thereto vide no. EC24C3801PB5277447A dated 16.04.2024.
4) The project proponent shall comply with the terms & conditions of the allotment letter of the site issued by GMADA vide no. EO/2021/88013 dated 08.11.2021.
5) The project proponent shall not carry out any construction in aberration to the layout plan submitted at the time of grant of amended Environment Clearance to it, to refrain from committing violation & action thereof under the Environment (Protection) Act, 1986.
6) The promoter company shall install STP of capacity 275 KLD based on SBR technology for the treatment of domestic effluent generated by the project proponent, as proposed by it.
7) The project proponent shall provide necessary arrangements for usage of the treated effluent after STP for flushing purpose @ 78 KLD and shall develop adequate green/ plantation area in 6160.79 sqm area for discharge of the treated effluent after STP @ @ 33.8 KLD – 11.08 KLD – 3.08 KLD during Summer-Winter-Monsoon Season respectively. Only, the remaining treated effluent (max. 105 KLD during Monsoon Season) shall be allowed for discharge into Sewer respectively after obtaining NOC from the competent authority regarding sewerage connection for the same.
8) In case, there is any change in components of the project such as total area, built-up area, water consumption, wastewater generation, solid waste generation etc. if at any stage, then the project proponent shall obtain revised ‘Consent to Establish’ from the Board as well as Environment Clearance from the competent authority, for the said change.
9) The project proponent shall not allow occupancy in the project till Sewer Connection and Occupancy Certificate have been issued by competent authority.
10) The promoter shall also not allow any occupancy in the project till the time adequate arrangements for solid waste disposal are made as well as 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 are obtained.
11) The promoter company shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate.
12) The project proponent shall obtain permission from the PWRDA for the abstraction of ground water.
13) The project proponent shall utilize treated wastewater from nearby STPs for the construction purpose and shall submit an agreement in this regard within one month.
14) The project proponent shall provide separate water meter and energy meter for the STP and maintain record of the same on daily basis.
15) The promoter shall provide a buffer zone of green belt (dense populated trees with pleasant fragrance) around the sewage treatment plant, so as to reduce the effect of odour problem in its vicinity.
16) The promoter company shall explore the possibility of using treated domestic effluent for useful purpose such as construction work, sprinkling on dusty patches/roads, use in nearby construction activities etc.
17) The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted.
18) The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter of adequate capacity to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.
19) The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.
20) The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016.
21) The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disperse in the air in any form.
22) The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form.
23) The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project.
24) The project proponent shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material.
25) The project proponent shall provide mask to every worker working on the construction site and involved in loading/ unloading and carrying of construction material and construction debris.
26) The project proponent shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions.
27) The project proponent shall install mechanical composter for the treatment of solid waste being a bulk waste generator.
28) The project proponent shall make use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021.
29) The Punjab Pollution Control Board shall have the liberty to revoke this consent & take penal action against the industry/project proponent and its responsible/ concerned person(s), in case any information/document provided by the industry/ project proponent is found to be incorrect/false/misleading at any point of time.
30) The Punjab Pollution Control Board shall not be responsible for any financial liability and/ or any other liability of the project proponent, due to grant of this Consent to Establish.
