The industry is small scale red category unit and earlier the industry was visited by the officer of this office and it was observed that the industry could not produce any MOU made with CETP Operator and operate its unit without consents of the Board. Thereafter the industry was issued directions u/s 33-A of the Water Act, 1974 for disconnection of the electric supply vide letter no. 6184 dated 22.10.2024 alongwith sealing of polluting machinery/D.G. set. Further, the electric connection of the industry was disconnected by the PSPCL authorities vide TDCO no. 83/271 dated 13.11.2024 and polluting machinery of the industry has been sealed by the officer of this office on 13.11.2024. Thereafter the industry has applied for fresh consent to operate under the Water Act, 1974, which was granted to the industry upto 09.06.2025 alongwith temporarily restoration of electric connection for six months………………..
Thereafter the industry again applied for fresh consent to operate under the Water Act, 1974, which was granted to the industry upto 12.12.2025 alongwith temporarily restoration of electric connection for six months……………….

The industry was issued SCN for refusal of CTO under the Water Act, 1974, to reply the following observations within 07 days:…
The industry was visited by the officer of the Board on 12.12.2025 and it was observed as under: - 1. The industry was in operation during the visit and was engaged in electroplating and pickling process using HCL. 2. The industry has provided 9-barrel machines (out of which 1 standby) and 1 drum for washing. 3. The industry has provided 1 PVC storage tank capacity of 2000 ltr and approx. 1500 Itr. was lying stored. 4. The industry has made an agreement with M/s JBR Technologies Pvt. Ltd CETP, Focal Point, Ludhiana @ 4000 Itr/month for lifting of trade effluent. 5. The industry has provided 1 no. water meter and the reading of the water meter was observed as 83.95 KL during the visit. 6. The washroom facility has been provided by the industry near the work area, however, the same was found temporarily closed during visit. During checking of the domestic sewer at the rear side of the premises revealed strong pH, which indicates the possibility of discharge of trade effluent into the sewer through the washroom outlet. 7. The industry is required to increase the capacity of effluent collection tank, atleast equivalent to the CETP agreement, by providing additional storage tank. 8.The industry is required to prepare a revised lifting schedule with the CETP operator and to 9. ensure that the lifting shall be made atleast 3-4 times in a month and take a written assurance from the operator. The industry is required to install CCTV cameras with 30 days backup, facing towards a) entry gate of processing shed b) flow meter provided on freshwater supply provided for processing activities c) effluent storage tanks d) any other suitable point deemed fit to ensure that whole of the water consumed metered and whole of the trade effluent is lifted to CETP operator is The industry is required to maintain in-house monitoring mechanism through mobile phone/ office screen for visualizing the above CCTV cameras so as to ensure that no intentional or unintentional lapse happens and no untreated effluent is bye-passed. 10. The industry is required to ensure that there is no unauthorized mode of wastewater disposal. The industry is required to ensure that there is only a single fresh water supply for the industry and meters shall be provided for the water being used for process. 11. The industry'is required to maintain proper record of fresh water consumption and trade effluent generated & effluent got lifted by the CETP operator on daily basis. 12. The record is required to be available in the industry at all times, kept in a designated box in the process area to ensure easy and ready accessibility to record keeper as well as regulatory authority. In case, the record is not maintained by the industry, it will be presumed that the industry is disposing of its wastewater illegally……………………
Now, the industry has submitted reply to the SCN, wherein it has been mentioned that The industry has permanently closed the washroom in the work area and the compliance has been physically verified by the officer of the board on 12.01.2026. The industry has installed CCTV cameras at the required points. Further, as reported by RO, The industry has provided 02 no. effluent collection tank of capacity 2000 Ltr. each, which is not equivalent to the agreement quantity, The industry has revised its effluent lifting frequency from twice in a month to once a week (2-4 times per month), There is no unmetered supply or unauthorized mode of disposal found during visit, The industry is maintaining the record of fresh water consumption viz-a-viz effluent lifted and The industry has ensured that the records are available at all times and are kept in a designated box in the process area for ready inspection by regulatory authorities………………..
In view of the above, the industry is complying with the provisions of the Water Act, 1974 during the last 03 visits……
In view of above, it is recommended that:- 1. The electricity connection of the industry be permanently restored and de-sealing of the machinery of the industry be carried out permanently . 2. The consent to operate under the Water Act, 1974 may be granted to the industry for regular period upto 30.06.2030 with suitable conditions as per policy of the Board and with special conditions that:- 1. The industry shall ensure that there is no unauthorized mode of wastewater disposal. The industry shall ensure that there is only a single fresh water supply for the industry and meters shall be provided for the water being used for process. ………….
2. The industry shall maintain proper record of fresh water consumption and trade effluent generated & effluent got lifted by the CETP operator on daily basis. ……………
3. The record shall be available in the industry at all times, kept in a designated box in the process area to ensure easy and ready accessibility to record keeper as well as regulatory authority. In case, the record is not maintained by the industry, it will be presumed that the industry is disposing of its wastewater illegally and action as deemed fit shall be taken in accordance with law…………………….
