File Note: The industry has applied for obtaining ‘consent to establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Zinc Oxide @2200 MT/Year as products, along with requisite document. The industry has deposited Rs. 5600/- vide R. no. 763624757 dated 12.11.2025 including application form fee, against the cost of the project of Rs. 95.00 lakhs. (As per application form). The NOC fees deposited by the industry is adequate for one year. Suitability of site: The industry has uploaded a copy of land use classification letter issued by DTP SAS Nagar vide letters no. 946 dated 18.06.2025, wherein it has reproduced as under: As such, as per the above-mentioned land use classification letter, the site falls in existing industry zone. Further, the site falls within the limits of MC Derabassi. As the site is in existing industry zone within MC limit, thus, is suitable for the establishment of the Orange Category of the industry. Manufacturing process: Water Pollution: As per the brief project report, the domestic effluent @ 0.4 KLD shall be generated from the unit and the industry has proposed to use the same for onto land for plantation within premises after passing through septic tank. As per the proposal, no trade effluent shall be generated from the proposed unit. Air Pollution: The industry shall install 01 no. of Furnace based on Low Sulphur Fuel Oil of capacity 2200 MT/Year, which will be equipped with bag filter house. The industry has proposed to install one no. DG set of capacity 58.5 KVA, which is provided with canopy and adequate stack height. Applicability of EIA notification dated 14.09.2006: The process of the industry is not covered under the ambit of EIA notification dated 14.09.2006. Visit: Accordingly, the proposed site of the industry was visited by the undersigned of this office on 15.01.2026. During visit, it was observed as under: 1. The proposed site of the unit is located near PSPCL Sub-Division, Derabassi at coordinates 30.585157, 76.872901. 2. The industry is going to be installed in existing industrial building. As per the representative, the site was being used earlier by some defense ordinance manufacturing industry. 3. The site falls in existing industry zone within the limits of MC Derabassi. 4. There is one residential colony at around 75 m from the site of the industry. 5. One natural drain also lies at around 40 m from the site of the industry. Recommendations: In view of above, if may approved, ‘consent to establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, may be granted to the industry for one year with usual conditions & with following special conditions: 1. The industry shall not carry out any activity in its premises, which can change the category of unit from Orange to Red, under any circumstances. 2. The industry shall provide the 15 m green buffer towards the existing residential habitation and shall get the certificate regarding the same from MC Derabassi. 3. The industry shall get the site plans approved from the MC Derabassi by incorporating the 15 m green buffer belt towards the existing residential habitation. 4. The industry shall provide the adequate arrangement with the STP for reuse of the treated wastewater into the cooling purpose and shall only dispose the excess treated wastewater onto plantation. 5. The industry shall provide the completion certificate for the APCD from Punjab State Council for Science & Technology before obtaining ‘Consent to Operate’. 6. The industry shall not carry out any activity which is covered under the ambit of EIA notification dated 2006. 7. The industry shall comply with the provisions of Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 and shall obtain authorization for spray paint sludge and other hazardous wastes generated from the industry. 8. The industry shall install flow meter with the tubewell to be installed in its premises and shall maintain daily record of the readings of the same, if applicable. 9. The industry shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water, if applicable. 10. This ‘consent to establish’ is being granted to the industry on the basis of land use classification letter uploaded by the industry alongwith the online application. The industry shall establish its unit only in the said Khasra nos. mentioned in rent deed and shall comply with the guidelines/bylaws/stipulations of the Department of Town and Country Planning, at all times. 11. The industry shall ensure that no problem related to pollution is being caused by the unit due to its operation and no public complaints are received by the Board in this regard. 12. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 13. The adequacy/efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 14. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time. 15. The ‘consent to establish’ is being issued to the project proponent based upon the documents/ information/undertaking submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document/undertaking is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 16. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
