File Note: The industry has applied for fresh ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Plastic Granule @2000 Kgs/day and Master Batch @50 Kgs/day as raw material and Plastic Drums @ 1500 Numbers/Day as products from scrap plastic, along with requisite documents and fees. The industry had not obtained ‘consent to establish’ before setting up of the unit and has directly applied for obtaining ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The industry has deposited Rs. 170400/- vide UTR. no. INDBN2903293405 dated 29.03.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 116400/- vide UTR. no. INDBN2903293439 dated 29.03.2024. The fee deposited by the industry is adequate upto 30.06.2028, under both the Acts against the fixed assets of Rs. 301.3 lakhs as on 10.12.2025 (Considering of NOC regularization fee of Rs. 8400/-, penalty of Rs. 2,35,200/- under the both acts). It is submitted that the industry has uploaded a copy of electricity bill issued by PSPCL, wherein, it has been mentioned that the electric connection was released to the industry on 04.01.2019. Manufacturing Process: Suitability of Site: The industry has uploaded a copy of land use classification letter issued by DTP SAS Nagar vide letters no. 452 dated 22.03.2023, wherein it has reproduced as under: The industry has submitted a copy of building plan signed by Er. Rajesh Kumar Singla, Competent Person of Director of Factories of Punjab. The industry has also submitted a copy of registry18.06.2019 executed between Smt. Jag Jyoti and M/s Omtek Containers for bearing khasra nos. 47//9/2/1, 2 bigha, 0 biswa, situated at village Saidpura, Tehsil Derabassi, Distt. SAS Nagar. Water Pollution: As per the brief project report, the domestic effluent @ 0.5 KLD shall be generated from the unit and the industry has proposed to use the same for onto land for plantation within premises after passing through septic tank. No trade effluent generated from the industry. Air Pollution: The industry has not installed any DG set. Further, the machinery installed by the industry is non polluting in nature. Applicability of EIA notification dated 14.09.2006: The process of the industry is not covered under the ambit of EIA notification dated 14.09.2006. Visit: Accordingly, the industry was visited by undersigned of this office on 15.01.2026 and it was observed as under: 1. The industry is using plastic dana (granules) as raw material for production of Plastic Drums. 2. The industry has installed 01 no. injection molding and 02 no. of blow molding machine for manufacturing of plastic drums. 3. The industry has installed one no. cooling plant for water used in cooling of molding/extruding machines. 4. The industry is not reusing the waste plastic produced from process and is disposing the same to the recyclers. 5. The industry has not installed any DG sets in its premises. 6. The industry has constructed septic tank for domestic sewage, which is disposed onto land for plantation within the premises at front boundary. From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Recommendations: In view of above, if may approved, the ‘consent to operate’ may be granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 upto 30.06.2028, subject to suitable conditions and following additional conditions: 1. The industry shall not carry out any activity in its premises, which can change the category of unit from Green to Orange/Red, under any circumstances. 2. The industry shall register itself onto plastic waste EPR Portal, within 15 days as producer. 3. The industry shall discharge only domestic effluent onto land for plantation within premises, after passing through septic tank. 4. The industry shall not exceed the production beyond the capacity mentioned in this consent letter, without prior permission of the Board. 5. The industry shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 and shall dispose the hazardous waste generated as per rules, within 30 days. 6. The industry shall not add any new land area in its premises, without obtaining prior permission from the Board. 7. The industry shall immediately start maintaining record of water consumption, ETP and APCD operation. 8. The project proponent shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 9. The industry shall ensure that the activities of unit does not create any nuisance in the surrounding areas and no public complaints are received. 10. The adequacy/ efficacy of the pollution control arrangements& disposal scheme shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 11. The unit shall ensure that no nuisance is created in the vicinity of its premises from the operations. In case, any complaint is received against the project, the Board shall be at liberty to revoke/ cancel this consent without giving any opportunity of hearing to the industry. 12. The ‘consent to operate’ is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 13. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
