It is submitted that earlier, the industry was issued notice to issue directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 alongwith an opportunity of personal hearing before the then Worthy Chairman of the Board on 11.02.2025, wherein, it was decided as under: 1. The consents to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry upto 30.06.2025 with suitable condition and following special conditions: a) The industry shall be bound to comply with the directions of Hon'ble NGT in the matter of OA no. 1358 of 2024 titled as Archit Arora Vs State of Punjab & Ors. as well as directions issued by the Board from time to time in the stipulated time period. b) The industry shall modify its re-heating furnace to use PNG as fuel within 2 months and shall submit the compliance to the Board, thereafter. 2. Environmental Engineer, Regional Office, Fatehgarh Sahib shall get the compliance of above said decisions in the time bound manner and shall submit the report with recommendations. 3. lt was made clear to the industry that if the industry fails to shift to PNG as fuel in its furnace, action as deemed fit under the provisions of the Air (Prevention & Control of Pollution) Act, 1981 and as per the directions of Hon'ble NGT in the matter of OA no. 1358 of 2024 titled as Archit Arora Vs State of Punjab & Ors shall be taken without affording any further notice/ opportunity.
Now, the industry has applied for renewal of consents to operate under the Air (Prevention & Control of Pollution) Act, 1981 and Air (Prevention & Control of Pollution) Act, 1981. As reported by Regional Office, M/s Think Gas Ludhiana Ltd. has already laid down the pipeline in the area. The PNG pipeline is passing in front of the industry; however, the gang box/stone marker is still about 10 meters from the industry. Therefore, the pipeline is yet to be laid down fully to the industry. The industry is using wood pallets as fuel and as reported by Regional Office, Fatehgarh Sahib. The industry has submitted the stack emission analysis report of sampling carried out by M/s Sima Labs on 09.12.2025 and as per the analysis results, the concentration of SPM was analyzed as 67 mg/Nm3, which is well within the permissible limit as prescribed by the Board. The Hon'ble NGT in the matter of OA no. 1358 of 2024 titled as Archit Arora Vs State of Punjab & Ors has heard the parties on 16.09.2025 and the next date of hearing is 17.02.2026. In view of above, as the industry is achieving prescribed standards and SPM level is well within prescribed limits of 150 mg/Nm3. May if approved, the consent to operate applied by the industry under the Water (Prevention & Control of Pollution) Act, 1974 may be renewed to the industry upto 31.03.2026 with suitable conditions and special conditions that : 1. Environmental Engineer, Regional Office, Fatehgarh Sahib shall carryout the monitoring of stack emissions as per protocol prescribed by the Board. 2. The industry shall make credible efforts to shift its unit to PNG as fuel before 31.03.2026. 3. The industry shall be bound to comply with orders of Hon’ble NGT in the matter of OA no. 1358 of 2024 titled as Archit Arora Vs State of Punjab & Ors, please.
