File Note: It is submitted that the subject cited industry is a small scale red category unit and was granted 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH2/2018/7898695 dated 20/07/2018 valid upto 30/06/2023 for manufacturing of MS Bar @ 600 Kgs/day. Earlier history Earlier, it has obtained auto renewed 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTO/Renewal/LDH2/2024/25427520dated 16.04.2024 valid upto 16.04.2029. The industry was visited by Er. Gurmehar Singh, AEE(OS) & Er. Ashwinder Singh, AEE(OS) on 29.08.2024. During visit it was observed that storage tank provided by the industry for storage of untreated effluent was full upto brim and the industry was in operation, which clearly indicates that the industry is discharging untreated effluent into sewer. Accordingly, consent to operate granted under the Water Act, 1974 has been revoked vide no. 5280-81 dated 17.09.2024 and the industry was issued directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 vide no. 5721-22 dated 01.10.2024 for disconnection of electric connection available to the industry. In compliance, PSPCL authorities has disconnected the electric supply of the unit vide TDCO no. 18/81597 dated 25/10/2024. After making compliance, the industry had applied for consent to operate under Water Act, 1974 and accordingly, the industry was visited by the officer of this office on 21.11.2024 and industry was found complying and consent to operate had granted to the industry vide no. CTOW/Fresh/LDH2/2025/27239251 dated 08/01/2025 valid upto 07/07/2025 and electric connection of the industry was also restored upto 07.07.2025. Further, the industry was again applied for fresh 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 and granted vide no. CTOW/Fresh/LDH2/2025/29098456 dated 11/08/2025 valid upto 10/02/2026 and the electric connection of the industry temporary restored upto 10.02.2026. Now, the industry has applied for obtaining fresh consent to operate under the Water Act, 1974 with requisite documents. The industry has deposited consent fee against the un-depreciated fixed assets of Rs. 1.82 Lacs as on 31/12/2025 as per CA certificate dated 05/01/2025, which is already adequate upto 16/04/2029 under Water Act, 1974, as per Board's Office Order dated 29/10/2018. Accordingly, the industry was visited by the officer of the Board on 13/01/2026. During the visit, it was observed as under: 1. The industry was in operation during visit. 2. It is engaged in manufacturing of MS Bar @ 600 Kgs/day by using raw material as MS Round @ 600 Kgs/day, Acid @ 01 Liter/day. 3. The industry has made agreement with M/s JBR Technology Pvt. Ltd., Ludhiana (CETP) for disposal of its trade effluent @ 1000 ltr/month. 4. The industry has installed water meter on pipeline leading to process area whose reading during visit was 42.85 KL. 5. Lastly, the industry has lifted its trade effluent @ 1000 Ltr to CETP on dated 17.12.2025. 6. The industry is maintaining record w.r.t. fresh water consumption for the wet process & effluent lifted to M/s JBR Technology Ltd. The audit report is enclosed herewith. As per the record the quantity of water consumed for wet process is in consonance with the quantity of effluent lifted to JBR Tech. Pvt. Ltd. 7. Domestic effluent generated by the industry is discharged into sewer. 8. The industry has provided 01 no. storage tank of capacities 2000 Ltr, which was found 50 % full during visit. 9. The industry has installed 02 no. CCTV cameras, 01 no. covering effluent storage tank and 01 no. facing towards the entry gate of the processing shed and fresh water meter installed in processing area. 10. The industry has submitted building plan prepared by Sh. Sukhjinder Singh approved Architect from Director of Factories, Punjab. Site Suitability The industry is situated in Partap Nagar which is industrial mix zone as per Master Plan, Ludhiana. Now, the Board has issued order vide no. 21 dated 08.06.2018 regarding continuation of operation of Industrial establishments in mixed Land use/non-designated area of Ludhiana upto 15 years from date of notification of the master plan which were established before the notification of the Master Plan, Ludhiana. In the subject cited case, the industry has mentioned ground water extraction @ 0.45 KLD. Considering 25 working days per month, ground water extraction will be 11.25 KL/month, which is less than 300 KL/month. The industry has already deposited Rs. 1.0/- Lacs vide Cheque no. 277819 dated 04.01.2025 as environmental compensation fee. In view of above, it is recommended that: 1. Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 may be granted upto 10.09.2026 (as the industry falls in mixed land use area and it is permitted by Deptt. of Housing & Urban Development vide letter no. 08/05/2023-4HI/2208 dated 06.10.2023 to run the existing industries till 10.09.2026) with suitable conditions as per policy of the Board. (Competency – Senior Environmental Engineer) 2. PSPCL authorities may be directed to restore the electric connection available with the industry, permanently.
