It is intimated that the BKO was earlier granted consent to operate under Air (Prevention & Control of Pollution) Act, 1981 vide application no. 2277068, valid up to 30.06.2019. Now, the unit has applied for CTO under the Air (Prevention & Control of Pollution) Act, 1981 vide application no. 30461643 for its brick kiln.
The unit has deposited consent fees amounting to Rs. 32400/- vide Rt. No. 282575702 dated 01.12.2025 and Rs. 23200/- vide Rt. No. 969474470 dated 05.01.2026, which is adequate up to 31.03.2031 under Air (Prevention & Control of Pollution) Act, 1981.
The unit has submitted Completion Certificate regarding Zig-Zag Technology issued by CSIR dated 09.12.2019. CA Certificate against fixed assets amounting to ₹48.64 lakh (with UDIN mentioned). The unit has attached CA certified and self-attested coal register vide which it is clear that the brick kiln has not consumed/utilised coal in the months of 01.01.2019 to 19.04.2019 and 01.06.2019 to 10.12.2019. As such, no penalty is required to be imposed on the brick kiln.
The brick kiln was visited by Er. Arshpreet Kaur, AEE of this office on 14.01.2026 and it was observed as under:
1. The industry was in operation during visit.
2. A 25 kVA DG set has been installed without an acoustic enclosure (canopy) and with inadequate stack height.
3. Crushed coal was observed to be stored in the open, without any proper covering.
4. Porthole, platform, and ladder were found to be provided.
5. Plantation along the periphery of the unit has not been adequately developed; only a few trees were observed on two sides.
6. The approach road to the unit is not paved; only a kuccha road is available.
7. The unit has not installed a display board as required under the directions of the Hon’ble NGT.
In view of the above, it is recommended that a Show Cause Notice before refusal of Consent to Operate under the Air (Prevention & Control of Pollution) Act, 1981 may be issued to the unit, with an opportunity to submit a reply within 15 days.
