Subject: Application for obtaining NOC for retail outlet petrol pump - M/s Wayside Amenities (WSA)-Nawanshahr Site (G25NSW1596335).
It is submitted that the unit has applied for obtaining NOC for retail outlet petrol pump at Village Mehatpur, Tehsil Balachaur District SBS Nagar. The unit has submitted the documents such as layout plan, authority letter, proprietorship certificate, Jamabandi, Detailed project report, Distance letter. The unit has deposited Rs. 8900/- vide R. No. 279083185 dated 27.11.2025.
It is submitted that the proposed site for setting up of Petrol Pump at Khasra no. 7//4/2/2/1(0-6), 7//5/2/1(0-14), 7//5/2/2/1(2-12), 8//2/2/1(1-0), 8//2/2/2/1(6-2), 8//8/1/2/1(0-17), 8//8/1/2/2(2-13), 8//10/2/1/1(2-19), 8//10/2/2/1(1-15), 8//12/1/1 (0-1), Village Mehatpur, Tehsil Balachaur, District SBS Nagar was visited by the Aditya Sharma, AEE (OS) on 10.12.2025, and it was observed that the demarcation of the site has done by the applicant.
Further, the industry has submitted the distance report certified by Tehsildar, Balachaur, which is mentioned as below: -
“There is no school/hospital/the retail outlet site/any water body (lake, pond, stream, rivers, wetland, canal, creee/choe) etc. within 50 m of the proposed site. Hence, the site is suitable. However, there is no case of the distance between new retail outlet from residential area of less than 30 m and no high-tension line is passing over the retail outlet.”
Furthermore, it is submitted that in this regard, Additional Supervising Engineer, PSPCL vide its letter no. 6289 dated 17.07.2025 has submitted its report which is reproduced as under:
“ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਦੇ ਸਬੰਧ ਵਿੱਚ ਆਪ ਜੀ ਨੂੰ ਲਿਖਿਆ ਜਾਂਦਾ ਹੈ ਕਿ ਵਿਸ਼ਾ ਅਤੇ ਹਵਾਲੇ ਅਧੀਨ ਦਰਜ ਪੱਤਰ ਨੰ. ਦੀ ਪਾਲਣਾ ਕਰਦੇ ਹੋਏ ਸਬੰਧਤ ਏਰੀਆ ਇੰਚਾਰਜ ਜੇ.ਈ.ਅਤੇ ਉਪ ਮੰਡਲ ਅਫਸਰ ਬਲਾਚੌਰ ਨੰ. 1 ਵੱਲੋਂ ਸਾਇਟ ਚੈਕ ਕੀਤੀ ਗਈ । ਇਸ ਸਬੰਧੀ ਫਾਇਲ ਉਪਰ ਦਰਸਾਏ ਗਏ ਬਿਨੈਕਾਰ ਰਮਨ ਸਿੰਘ ਨਾਲ ਸੰਪਰਕ ਕੀਤਾ ਗਿਆ ਅਤੇ ਉਸ ਨਾਲ ਦਰਸਾਇਆ ਗਿਆ ਖਸਰਾ ਨੰ. 8//10/2/1/1 ਪਿੰਡ ਮਹਿਤਪੁਰ ਵਿਖੇ ਵੇਖਿਆ ਗਿਆ । ਸਾਇਟ ਉਤੇ ਦਰਸਾਏ ਗਏ ਖਸਰਾ ਨੰ. ਤੇ ਉਪਰੋ ਕੋਈ ਵੀ 11 ਕੇ.ਵੀ ਜਾਂ ਐਲ.ਟੀ ਲਾਇਨ ਦੀ ਕ੍ਰਾਸਿੰਗ ਨਹੀਂ ਹੈ। ਬਿਨੈਕਾਰ ਵੱਲੋਂ ਅਪਲਾਈ ਕਰਨ ਉਪਰੰਤ ਇਥੇ ਬਿਜਲੀ ਕੂਨੈਕਸ਼ਨ ਦੇਣ ਯੋਗ ਹੋਵੇਗਾਂ, ਜਿਸ ਦੀ ਦਰਸਾਈ ਗਈ ਸ਼ਰਤ ਹੇਠ ਲਿਖੇ ਅਨੁਸਾਰ ਹੈ ਜੀ।
As per ESIM 2018, instruction 3.3.4” The applicants intending to establish/operate industries falling under “Red/Orange” Categories shall obtain NOC/clearance at their own level from PPCB as may be applicable.
The list of Red, Orange and Green/exempted categories of industries is given in Annexure-35, 36 and 37 of the Appendix-I.
Annexure-35 ਦੇ ਪੁਆਇੰਟ ਨੰ. 45 ਦੇ ਵਿੱਚ ਲਿਖਿਆ ਗਿਆ ਹੈ Manufacturing of Lubricating oils , greasers or petroleum based products, ਜਿਸ ਵਿੱਚ ਬਿਨੈਕਾਰ ਵੱਲੋਂ ਅਪਲਾਈ ਕੀਤੀ ਗਈ Commercial Activity ਆਉਂਦੀ ਹੈ। ਇਸ ਲਈ ਉਪਰੋਕਤ ਦਰਸਾਈ ਗਈ ਸ਼ਰਤ ਪੂਰੀ ਹੋਣ ਉਪਰੰਤ, ਇਸ ਜਗ੍ਹਾ ਉਪਰ, ਪੈਟਰੋਲ/ਡੀਜ਼ਲ ਪੰਪ ਲਈ ਕੁਨੈਕਸ਼ਨ ਦੇਣ ਯੋਗ ਹੋਵੇਗਾਂ ਜੀ। ਇਹ ਆਪ ਜੀ ਦੀ ਜਾਣਕਾਰੀ ਅਤੇ ਅਗਲੇਰੀ ਕਾਰਵਾਈ ਹਿੱਤ ਹੈ ਜੀ।”
In view of above, may if approved, it is recommended that the Board has no objection for issuance of permission for setting up of retail outlet of subject cited company at proposed location, subject to the following conditions:
1. The Project Proponent will comply with guidelines issued by CPCB vide office order no. B-13011/1/2019-20/AQM-10809 dated 07.01.2020 as amended from time to time for setting up new petrol pumps in compliance of the Hon'ble NGT order dated 18.01.2019 in OA no. 86/2019 Gyanprakash @ Pappu Singh Vs GOI & Ors-regarding.
2. The Project Proponent shall obtain license from the Department of Explosives & submit the same to the Board.
3. The Project Proponent shall prepare on-site and offsite emergency plans and get it approved from Competent Authority and thereafter submit the same to the Board.
4. The Project Proponent shall comply with the provisions of the Manufacture, Storage & Import of Hazardous Chemical Rules, 1989 as amended from time to time.
5. The Project Proponent shall get insurance cover under the Public Liability Insurance Act, 1991.
6. The Project Proponent shall store quantity not more than the threshold quantity mentioned in columns 3 of schedule 2 & 3 of Manufacture, Storage & Import of Hazardous Chemical Rules, 1989 as amended from time to time.
7. The company shall comply with the provisions of MoEF notification no. GSR 371(E) dated 17.05.2002 regarding noise pollution for DG sets.
8. In case the Project Proponent installs DG set, it will install silent DG set in compliance of the provisions of the Noise Pollution (Regulation and Control) Rules, 2000. In case the capacity DG set is more than 10 KVA, it will obtain consent to operate under the Air Act, 1981 from the Board.
9. The Project Proponent will not violate the provisions of Punjab Regional Town Planning & Development Act, 1995.
10. The Project Proponent will not carry out any activity that will result in water and air pollution such as vehicle service centre etc, without prior permission/ NOC of the Board.
11. The Project Proponent shall obtain requisite permission from other departments also.
