• It is submitted that the institute was show cause notice before refusal of 'consents to operate' under the provisions of the Water Act, 1974 and Air Act, 1981 alongwith an opportunity of personal hearing before the Member Secretary of the Board on 21.11.2025, postponed to 24.11.2025. After hearing the representative of institute and officer of the Board, the Member Secretary of the Board decided that:-
1. The institute shall install and commission the Sewerage Treatment Plant (STP), within 02 months…………
2. The institute shall submit bank guarantee of Rs 5.00 Lakh to the Environmental Engineer, Regional Office, Sri Muktsar Sahib, within 15 days as an assurance to install & commission the STP within stipulated time period……………
3. The institute shall ensure scientific disposal (segregation & treatment) of solid waste in compliance to the Solid Waste Management Rules, 2016. The institute shall operate the compost pits efficiently……………..
4. Consents to operate under Water Act, 1974 & Air Act, 1981 be granted to the institute for six months………………..
5. During hearing, it has been made clear to the representative of the institute that in case of non-compliance of decisions of the hearing within stipulated period or if any violation(s) observed under the provisions of the Water Act, 1974 & Air Act, 1981, in future, further action as deemed fit shall be initiated by the Board under the said Acts without any further notice/opportunity………………..
6. The Environmental Engineer, Regional Office, Sri Muktsar Sahib shall visit the institute, verify the contents and submit report with conclusive recommendations after stipulated time period………….
• The proceedings of hearing were conveyed to the institute vide letter no. 3658 dated 05.12.2025. But the institute has not deposited bank guarantee of amounting to Rs. 5.0 Lacs………..
• Regional Office, Sri Muktsar Sahib vide letter no. 2523 dated 18.12.2025 has also requested to the institute to deposit the bank guarantee as imposed during personal hearing dated 24.11.2025……………
• The institute has not yet deposited the bank guarantee. However, the institute vide letter no. MIMIT/Estate/26/25 dated 06.01.2026 has submitted request for extension of time for installation of the Sewage Treatment Plant (STP) and exemption from submission of Bank Guarantee……..
• The institute was visited by Er. Prabhjot Kaur, AEE of RO, Sri Muktsar Sahib on 09.01.2026 and it was observed that the institute has not made any arrangement for proper storage / handling of solid waste and same was found dumped in an open area adjacent to the hostel building. Further, the institute has not yet started any activity regarding installation of STP………..
• RO has reported that the institute is not complying with the decisions of personal hearing held before the worthy Member Secretary of the Board on 24.11.2025 and recommended for refusal of CTOs under the Water Act, 1974 & Air Act, 1981……………..
Keeping in view of above and recommendations of RO, if approved, consents to operate under Water Act, 1974 & Air Act, 1981 applied by the institute may be refused, please.
