It is intimated that the HCF is a 10 bedded hospital. The HCF was granted authorization under the Bio-Medical Waste (Management & Handling) Rules, 2016 vide authorization no. BMW/Fresh/LDH3/2024/26626890 dated 30.08.2024, which is valid upto 31.03.2028.
Thereafter, the HCF was visited by Er. Gaurav, AEE (OS) of RO-3 on 13.11.2025 and observed that:
1. The HCF was in operation during visit.
2. The HCF has 10 beds located within MC limits of Jagraon.
3. The HCF has made an agreement with Medicare environment management valid upto 15-12-2028.
4. The HCF is discharging its liquid waste directly into MC sewer without any treatment with sodium hypochlorite solution.
5. The HCF is not properly collecting its bio-medical waste such as cotton swabs and cotton fiber. It has not made adequate arrangement for collection of the bio-medical waste and hospital has not provided any records regarding lifting of Bio-medical waste to the CBWTF.
6. The hospital has not provided needle shredder.
7. The hospital is not maintaining the record of bio-medical waste, generation and disposal. The HCF has authorization under bio-medical waste till 31-03-2028.
8. The hospital has not provided final storage room for the storage of bio-medical waste generated from the hospital.
9. The HCF is operating without obtaining consent to operate under Air (Prevention & Control of Pollution) Act, 1981 under Water (Prevention & Control of Pollution) Act, 1974 of the board.
Accordingly, the HCF was issued show cause notice for violating the provisions of Bio-Medical Waste Management Rules, 2016 vide letter no 3599 dated on 18.11.2025. However, the HCF has not submitted any reply of the show cause notice. Thereafter, the HCF was given an opportunity of personal hearing before the Environmental Engineer, Regional Office-3 on 09-12-2025, wherein it was decided as under:
1. The HCF shall comply with the provisions of Bio- Medical Waste Management Rules, 2016 & consent Water (Prevention & Control of Pollution) Act 1974 on regular basis.
2. The HCF shall treat its liquid waste with sodium hypochlorite solution before discharging into MC sewer.
3. The HCF shall apply for consent Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act 1981 from the board within 7 days, positively.
4. The concerned AEE shall visit the HCF after 10 days to check submission & compliance made by the HCF.
Now, the HCF has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for domestic effluent @ 4 KLD into MC sewer. The HCF has submitted rent deed, agreement made with BMW facility, Annual Report, Declaration, electricity bill etc.
The HCF has submitted rent deed as proof of commissioning. As per commissioning proof, the HCF commissioned in 23 December, 2023. The HCF has deposited Rs. 7,000/- vide R no. 66661886 dated 13.01.2026 under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 7,000/- vide R no. 859076771 dated 13.01.2026 under Air (Prevention & Control of Pollution) Act, 1981, which are adequate upto 30.11.2030 under both acts.
The hospital has submitted copy of an agreement made with common facility of M/s Medicare Environmental Management Pvt. Ltd., Ludhiana, authorized for capacity of 10 beds, wherein MEM has undertaken the liability of collection, transportation and treatment/disposal of Bio-Medical Waste generating from the hospital. The agreement is valid upto 15.12.2028.
Accordingly, the HCF was visited by Er. Gaurav AEE (OS) on 16.01.2026 and it was observed that:-
1. The HCF has installed 10 beds and occupancy is 05 beds during visit.
2. The HCF has provided sodium hypo-chloride pre-treatment system for treatment of its liquid waste generated and the treated effluent is discharged into Municipal Council Jagraon sewer which is connected with terminal STP 16 MLD Jagraon.
3. The hospital has provided color coded bins as well as bags for the segregation of the Bio medical waste generated from the premises.
4. The HCF is properly segregating its Bio-Medical Waste and lifting the same to CBWTF also HCF provided the storage room for the Bio-Medical Waste.
5. The hospital has installed 01 no. DG sets of capacities 40 KVA with canopy and adequate stack height.
The HCF is complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 and also complying with the conditions of authorization granted to it.
Keeping in view of the above, it is recommended that the fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the HCF upto 30.09.2030 with suitable conditions along with special conditions that:
i. The HCF shall ensure to comply with the effluent standards as notified and Bio-medical Waste Management Rules, 2016, amended upto date and subsequent amendments if any.
ii. The HCF shall renew its agreement time to time before its expiry.
iii. The HCF shall maintain proper record of generation and lifting of bio-medical waste.
iv. The HCF shall got lifted/handed over its Bio-Medical Waste generated to the Common Bio-Medical Waste Treatment Facility on daily basis.
v. There is no claim of continuation of HCF in present premises on the basis of this authorization. The HCF has to comply with the zoning regulation of master plan & to be shifted from the site as and when asked by the Govt./PPCB/ or any concerned Govt. agency.
vi. The HCF shall obtain other statutory approvals required from other departments, if any.
