File Note: It is submitted that show cause notice before refusal of 'consents to operate' under the Water Act, 1974 & Air Act, 1981 has been issued to the hospital alongwith an opportunity of personal hearing before the Senior Environmental Engineer (B) of the Board on 15.01.2026. Dr. Abhishek & Sh. Ravi Kant attended the hearing on behalf of the hospital and submitted written reply of show cause notice, which has been taken on record. They submitted that:- 1. ETP plant installed in this institute is under the AMC till 29.03.2026 with Hi-Tech Sweet Water Tech. Pvt. Ltd, WZ-249A, Ground Floor, Inderpuri, New Delhi 110012 and all Maintenances and operations are made by such company. After receiving your office show cause notice this office has issued letter no. 30 Dated 12/1/2026 the company to strictly maintain all the standard as specified under Water act 1974 and also explain your failure to comply with provision of water act 1974. 2. A sample was collected by the firm who is running ETP Plant and report was submitted to this office. This report is issued by Centre for Environment and Food Technology Pvt. Ltd office at DLF Industrial Area, Moti Nagar, New Delhi, this report shows Bioassay 90% Survival of fish after 96 hours in 100% effluent. 3. Maintenance and reinstallation of new sewer pipeline was under process by Municipality Committee Sri Muktsar Sahib and now work is completed and ETP Treated water disposal process is smoothly functioning on daily basis. 4. The HCF has two DG sets of capacity 82 KVA & 15 KVA. They further stated that the data regarding sources of water supply, water consumption details, waste water generation, waste water treatment and treated waste water disposal has been mentioned wrong in the application form inadvertently. They requested to return the applications so that they can fill the correct data in the application form. After hearing the representative of the hospital and officer of the Board and the materials facts on record, the Senior Environmental Engineer (B) decided as under: - 1. The hospital shall submit bank guarantee of Rs. 1.0 lac (one lac), within one week in the Regional Office, Sri Muktsar Sahib as an assurance to comply with the provisions of Water Act, 1974 & Air Act, 1981 and Bio-Medical Waste Management Rules, 2016. 2. The incomplete / improper applications submitted by the hospital under the Water Act, 1974 & Air Act, 1981 be returned with request to resubmit the proper / complete applications with requisite documents, within 07 days. 3. The occupier of hospital shall discharge his / her duties in true letter & spirit as mentioned in section 4 of the Bio Medical Waste Management Rules, 2016. 4. The hospital shall operate the ETP-cum-STP regularly & scientifically so as to achieve the prescribed standards. 5. The hospital shall provide separate water meter and energy meter for STP within 10 days and shall maintain its record on daily basis. 6. During hearing, it has been made clear to the representatives of the hospital that in case of non-compliance of decisions of the hearing within stipulated period or if any violation(s) observed under the provisions of Water Act, 1974 & Air Act, 1981 and Bio-Medical Waste Management Rules, 2016 in future, further action as deemed fit shall be initiated by the Board under the said Acts / Rules without any further notice/opportunity. 7. The Environmental Engineer, Regional Office, Sri Muktsar Sahib shall visit the hospital immediate after stipulated time period to check the compliance at site including re-collection of effluent samples from ETP-cum-STP and shall submit the report with conclusive recommendations in the matter.
