File Note: It is submitted that the subject cited industry is a small scale Red category unit and was granted 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH2/2018/8551177 dated 18/10/2018 valid upto 30/06/2023 for Electroplating of raw material on job basis @ 1.0 TPD. Earlier history Earlier, it has obtained auto renewed 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTO/Renewal/LDH2/2023/24125085 dated 07.11.2023 valid upto 07.11.2028. A complaint regarding illegal discharging of industrial effluent by the industries located at St. No. 17-B, Kot Mangal Singh, Ludhiana is being received in this office through whatsapp. To verify the complaint, subject cited industry was also visited by officers of the Board on 22.8.2024 and observed as under: 1. The industry was in operation and is a small scale red category electroplating unit. 2. The industry has made an agreement with M/s JBR Technology Pvt Ltd, Phase-VIII, Ludhiana @ 3500 Ltr/M for disposal of trade effluent generated from electroplating process. 3. The industry has installed water meter in process area and reading was not readable. The industry was found taking fresh water from unmetered supply in the process area. 4. The industry could not produce record of water consumption viz-a-viz effluent lifted to CETP operator. 5. The industry is disposing its untreated effluent into sewer through toilet seat found near wet process area. 6. During the visit, the housekeeping of the industry was very poor. 7. The industry has obtained consent to operate under Water Act, 1974, which is valid upto 07.11.2028. Accordingly, consent to operate granted under the Water Act, 1974 has been revoked vide no. 4003-04 dated 05.09.2024 and the industry was issued directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 vide no. 5539-40 dated 24.09.2024 for disconnection of electric connection available to the industry. In compliance, PSPCL authorities has disconnected the electric supply of the unit vide TDCO no. 24/81597 dated 28/10/2024. Further, the industry had applied for obtaining fresh 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974, which was refused by the Board vide certificate CTOW/Fresh/LDH2/2025/27342298 dated 21/02/2025. Furthermore, the industry was enlisted for the month of January, February, March, April, May, June and July, 2025 against non-lifting of trade effluent to M/s JBR technologies, Pvt, Ltd, Focal Point, Phase-8, Ludhiana. The industry was visited by officer of the Board on 03.09.2025 and it was observed as under: 1. The industry was operational at the time of the visit, despite not having received any electricity restoration orders from the Board. 2. It was engaged in zinc plating of nut bolts and has installed 06 no. barrels and 02 no. dhols. 3. The has installed a tubewell for consumption of fresh water however the same was not metered. 4. The industry has not installed water meter on pipeline for consuming fresh water in the process. 5. During visit, the industry was utilizing fresh water for unmetered tap supply installed in its toilet. 6. The industry couldn't produce record register for water consumption and trade effluent lifting to CETP operator. 8. The industry has provided waste water storage tank of capacity 1500 ltr which was full upto it's brim. The industry was not complying with directions issued u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 for closure of the unit and violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974. Accordingly, the industry was again issued directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 for sealing of wet processes of the industry vide no. 4618-19 dated 24.09.2025 and the PSPCL authority was directed to disconnect the connection of electricity available to the industry vide no. 4615-17 dated 24.09.2025. Now, the industry has applied for obtaining fresh consent to operate under the Water Act, 1974 with requisite documents. The industry has deposited consent fee against the un-depreciated fixed assets of Rs. 4.0 Lacs as on 03/10/2024 as per CA certificate dated 03/10/2024, which is adequate upto 07/11/2026 under Water Act, 1974, as per Board's Office Order dated 29/10/2018 after deducting penalty charges. Accordingly, the industry was already visited by the JEE of the Board on 12/11/2025. During the visit, it was observed as under: 1. The industry was not in operation during visit as electric connection of the industry was found disconnected. 2. It is engaged in manufacturing of Electroplating of mixed material on job basis @ 1.0 TPD by using raw material as Zinc metal @ 0.06 T/day. 3. The industry has made agreement with M/s JBR Technology Pvt. Ltd., Ludhiana (CETP) for disposal of its trade effluent @ 3000 ltr/month. 4. The sealing of wet process has been done during visit. 5. The industry has installed water meter on pipeline leading to process area. 6. No byepass was observed during the visit. 7. Domestic effluent generated by the industry is discharged into sewer. 8. The industry was guided to increase its storage capacity for trade effluent and install CCTV cameras in the industry on wet process area, water meter and effluent storage tank. 9. The industry has submitted building plan prepared by Sh. Rajnish Kumar Singla approved Architect from Director of Factories, Punjab. Site Suitability As per letter no. 695/ATP-D dated 27.9.2023 issued by MC, Ludhiana, the site of the subject cited industry falls under industrial mix zone, which has been notified as conformity zone by the Board and it has been decided that consent to operate to the unit located in conformity zone can be granted as per the policy of the Board. The industry has deposited consent fees for five years. In the subject cited case, the industry has mentioned ground water extraction @ 1.0 KLD. Considering 25 working days per month, ground water extraction will be 25 KL/month, which is less than 300 KL/month. It is pertinent to mention here that in case of M/s Kalsi Sons Fabricators, #13581, Street No. 7, Parbhat Nagar, Dholewal, Ludhiana, Competent Authority of the Board has decided not to restore electric connection in such cases till such small scale illegal industry deposit Rs 1.0 lac as environment compensation. Now, the industry has deposited EC of Rs. 1 lac vide R no. 43/5612 dated 15.01.2025 in this office. It is therefore recommended that: 1. Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 may be granted upto 10.09.2026 (as the industry falls in mixed land use area and it is permitted by Deptt. of Housing & Urban Development vide letter no. 08/05/2023-4HI/2208 dated 06.10.2023 to run the existing industries till 10.09.2026) with suitable conditions as per policy of the Board. (Competency – Senior Environmental Engineer) 2. PSPCL authorities may be directed to restore the electric connection available with the industry, permanently.
