File Note: It is submitted that last directions were issued to the project proponent due to main following reasons as per the last visited dated 19.03.2025: - 1. The effluent samples collected from the outlet of STP were found beyond the limit. 2. The residential colony had applied CTO for generation of domestic effluent @ 429 KLD for partial reuse into flushing system (168 KLD) and for partial discharge into plantation area (140) and horticulture (121 KLD). The residential colony had sufficient land for discharge of 140 + 121 = 261 KLD. However, estimated discharge of colony at that time was found 620 KLD. Maximum 33% of treated effluent (i.e. 204.6 KLD) will be reused for flushing through dual plumbing system. Thus, remaining discharge will be 620-204.6 = 415.6 KLD. The residential colony has 04 acres 06 kanals land as per Karnal technology and this land can handle 4.75 acre x 60 KLD/acre = 285 KLD discharge. The residential colony has 7.01 acres park and green area and this can handle 0.5 litre/m2 of treated trade effluent i.e. 02 KL/Acre x 7.01 acre = 14.02 KLD discharge. Thus, residential colony have land to handle discharge @ 299.02 KLD only. 3. The residential colony had not developed 04 acres land reserved for plantation. This land is located at a distance of about 10 acres from the colony. As per Environmental Clearance, the Project proponent had proposed this land for discharge of treated trade effluent. 4. Further, the Environmental Clearance was granted for an expected discharge of 1223 KLD with provisions for reuse in flushing, HVAC, horticulture, and irrigation, the reuse of treated effluent for flushing and HVAC was not being implemented in practice. 5. The project proponent had failed to arrange 20 acres of additional land for plantation as committed during the environmental impact assessment while obtaining environmental clearance. 6. The proposed disposal of treated effluent into the sewage network leading to the Bhattian STPs is not in line with the environmental clearance conditions, as the necessary permissions and amended clearance have not been obtained. The reply of the above said observations as per latest visit on 20.11.2025 is as under: 1. The residential colony has installed 2 modules of STP @ 610 KLD each. Both modules were found in operation. The effluent samples were collected during visit and as per the analysis report, concentration of the effluent samples collected during visit are found within the prescribed limits of the Board. 2. The present application has been applied for the generation of domestic effluent @ 429 KLD, out of this 160 KLD to be recycled with or without treatment and remaining 269 KLD to be discharged onto green area of 7.01 acres within premises & excess onto 04 acre area developed under Karnal Technology. The project proponent has submitted that the generation of 620 KLD earlier estimated by the Board is not correct and it was on just estimation. To check the statement of the project proponent the record of the STPs of last 03 months were checked and found that the average waste water generation of the project is presently below 285 KLD as out of total 743 units only 505 have been occupied by the residents. The residential colony has newly provided sapling of elcryptous in 04 acres 06 kanals land as per Karnal technology and provided green area and park in 07 acre land inside the project. Which is adequate to handle the present waste water generation. However, with the further occupancy and change in season from winter to summer or rainy season it can increase. 3. The residential colony and partially into 04 acres 06 kanals land taken by it on lease from Sh. Amandeep Singh Malhi S/o Sh. Sukhjinder Singh Malhi. The residential colony had done registered land lease agreement with Sh. Amandeep Singh Malhi for 04 acres 06 kanals land from khasra no: 5//13,14,15/1,2,11,9,20/1, 21/12, 22,23, 24/1 and 11//4/1, 2/2, 2/3/2,3/1. The land taken on lease was located near the STP and project proponent had laid underground PVC pipeline system for discharge of treated water into 04 acres 06 kanals land. New sapling of eucalyptus tree has been provided in this area. Further, residential colony has provided the 7.01 park / green area inside its project for the disposal of treated effluent. 4. Presently as per the Environmental clearance conditions the treated effluent reuse in flushing, HVAC, horticulture, and irrigation, the reuse of treated effluent for flushing and HVAC is not being implemented in practice. 5. The project proponent has failed to arrange and develop 20 acres of additional land for plantation as committed during the environmental impact assessment while obtaining environmental clearance. 6. Presently, treated effluent is being discharged onto land for plantation/ green area and no connection has been made with the sewage network leading to the Bhattian STPs. Further, the case was lastly heard by the Hon'ble NGT on 19.01.2026 and further extended the stay granted to the project proponent vide the last order dated 15.10.2025 till the next date of hearing i.e. 21.04.2026. A copy of the order is also enclosed herewith for kind perusal. In view of above, it is recommended that show cause notice for refusal of Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 be issued to the project proponent with an opportunity of personal hearing before the Competent Authority, please.
