File Note: It is intimated that the industry is a small scale red category unit and was granted Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH4/2023/20814497 dated 18.07.2023 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH4/2023/20814537 dated 18.07.2023, which were valid up to 30.06.2028. Earlier, the industry was visited by officer of the Board on 07.11.2025 and it was observed as under: - 1. The industry was in operation during visit. 2. The industry was engaged in process of Powder Coating, Nickle Plating along with Pickling. 3. The industry has installed water meter for fresh water consumption, the reading during visit was 0433.36 KL. 4. The industry is maintaining the record of fresh water consumption & trade effluent generated, the industry consumed 28.63KL of fresh water from the month of May to Nov and lifted 25.5KL of trade effluent during this period. 5. The industry also engaged in manufacturing of Plastic Hangers using fresh granules on its first floor (Operating without Consent to Operate of the Board). 6. The industry has installed 03 no. of electric ejection moulding machines. Accordingly, Show cause notice for violations of provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry with an opportunity of personal hearing before Senior Environmental Engineer, Ludhiana on 22.12.2025. Sh. Manoj Aggarwal, Proprietor of the industry attended the hearing and submitted a written reply which was taken on record. He stated that the industry is engaged in the process of powder coating, nickle plating along with pickling process and complying with the provisions of the Water act, 1974 and Air Act, 1981. Requested for time to apply for varied consents under the Water Act, 1974 and Air Act, 1981 for expansion of the existing unit for manufacturing of plastic hangers. Further, he mentioned that the industry had lifted waste water in October, 2025. The industry has a storage tank of capacity over 10 KLD and have booked the lifting of waste water to J.B.R Technologies, but the same was not lifted. After hearing, the Proprietor of the industry and officer of the Board, the Senior Environmental Engineer of the Board decided as under: 1. The industry shall reassess the effluent quantities and make revised agreement with CETP operator, if required, as per the actual generation of effluent and submit the same to the Board, within 15 days. 2. The industry shall increase the capacity of effluent collection tank, at least equivalent to the CETP agreement, by providing additional storage tank, within 15 days. 3. The industry shall prepare a revised lifting schedule with the CETP operator and to ensure that the lifting shall be made atleast once a week, take a written assurance from the operator. 4. The industry shall install CCTV cameras with 30 days backup within 15 days, facing towards a) entry gate of processing shed b) flow meter provided on freshwater supply provided for processing activities c) effluent storage tanks d) any other suitable point deemed fit to ensure that whole of the water consumed is metered and whole of the trade effluent is lifted to CETP operator 5. The industry shall maintain in-house monitoring mechanism through mobile phone/ office screen for visualizing the above CCTV cameras so as to ensure that no intentional or unintentional lapse happens and no untreated effluent is bye-passed. 6. The industry shall ensure that there is no unauthorized mode of wastewater disposal. 6. The industry shall ensure that there is only a single fresh water supply for the industry and meters shall be provided for the water being used for process. 7. The industry shall maintain proper record of fresh water consumption and trade effluent generated & effluent got lifted by the CETP operator on daily basis. 8. The record shall be available in the industry at all times, kept in a designated box in the process area to ensure easy and ready accessibility to record keeper as well as regulatory authority. In case, the record is not maintained by the industry, it will be presumed that the industry is disposing of its wastewater illegally and action as deemed fit shall be taken in accordance with law. 9. The industry shall apply for varied consent to operate under the Water Act, 1974 and the Air Act, 1981, within 07 days. 10. The Environmental Engineer, Regional Office-4, Ludhiana shall visit the industry, within 15 days, to verify contentions of the industry, carry out audit of the waste water generation, process consent applications on merit, submit compliances with respect to the decisions alongwith fresh recommendations. Now, the industry has applied for varied Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention & Control of Pollution) Act, 1981 through OCMMS. The industry has deposited fee amounting to Rs. 8800/-vide R. No. 979010619 dated 10.01.2026 under Water (Prevention & Control of Pollution) Act, 1974 and vide R. No. 251734627 dated 10.01.2026 and Rs. 7200/- under Air (Prevention & Control of Pollution) Act, 1981, which is adequate up to 03.07.2032 against gross value of fixed assets Rs. 41.03 Lacs and plant & machinery Rs. 6.95 Lacs as on 24.12.2025 To verify the content of the application the industry was visited by Er. Ridham, AEE on 19.01.2026 and it was observed as under:- 1. The industry was in operation during visit and is engaged in the process nickel chrome electroplating and phosphating process. 2. The industry has installed 01 nickel plant, 02 powder coating (electric) with individual cyclone as APCD and 01 electric oven. The industry has also installed 15 power presses machines. 3. The industry has installed electrically operated 01 no. Hardening furnace and 03 nos. injection moulding machines. 4. The industry has made agreement with M/s JBR Technologies Pvt. Ltd., D-260-261, Phase-8, Focal point, Ludhiana for lifting of its trade effluent @ 6000 ltr/month and domestic effluent is discharged into sewer. 5. The industry has provided storage tank for storage of effluent of capacity 6000 ltr. and approx. 2000 ltr. trade effluent stored during the visit. 6. No boiler/furnace/D.G. set has been installed by the industry. 7. The industry has also installed water meter showing reading as 442.07 KLD and has maintained the record of water consumption and lifting of trade effluent. The water audit of last six months (i.e. Dec, 2022 to May, 2023) was carried out and the industry has consumed fresh water @ 30,970 ltr. And lifted 28500 ltr to CETP operator. As per the record the water consumption is almost in proportionate to the trade effluent lifted after assuming evaporation losses. 8. The industry has installed CCTV cameras with 30 days backup, facing towards a) entry gate of processing shed b) flow meter provided on freshwater supply provided for processing activities c) effluent storage tanks and whole process area. 9. The industry has no by-pass arrangement/unauthorized mode of disposal. 10. The site is located in the designated area i.e. Phase-7, Focal Point, Ludhiana. The site is suitable for such type of the industry. 11. The GEO tagging of the industry has been done by the CETP operator in the GPS system. The GPS location of the industry has been checked and random trade effluent lifting by the CETP has been checked and it shows that CETP has actually lifted the trade effluent of the industry from said location. The industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 of the Board and achieved compliance of most of the personal hearing decisions. In view of the above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry up to 30.06.2030 with suitable and special condition:- 1. The industry will be only disposing its trade effluent to CETP operator. 2. The industry will maintain the record of total water consumption viz-a-viz effluent lifted. 3. The industry will submit the record on monthly basis to Board. Competency: SEE
