The report/ recommendations of RO in the matter has been examined and it was noted as under:
# The project proponent has applied for obtaining ‘Consent to Establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, for establishment of a group housing project in total land area of 18,797 sqm i.e. (4.64 acres) comprising of new Residential Flats 3BHK having 450 no., EWS Flats @45 nos and Shops @ 6 nos..
# The project proponent has submitted a copy of approved layout plan from MC authority and copy of License to develop a project/colony issued by the Competent Authority-cum-Additional Deputy Commissioner (Urban Development), SAS Nagar vide letter no. LDC/CA-ADC(UD)/2025/46 dated 11.07.2025 for developing land into Residential Ground Housing Project and style of project name "Aeroland Heights" on an area of 23 Bigha 01 Biswa 15 Biswasi or (23087.5 sq yds or 4.77025 Acres) at Village Dyalpura, Zirakpur, Distt. SAS Nagar, having validity upto 10.07.2030, which confirms the compliance of project site to zoning regulation as per Master Plan.
# The industry was granted Environmental Clearance vide no. EC24C3801PB5601048N dated 31.10.2025 for Group Housing Project namely "Aeroland Heights" in the total land area of 18,797 sqm and having built-up area of 68,788 sqm located at Village Dyalpura, Zirakpur, Distt. SAS Nagar, Punjab by M/s KS Developers.
# As per the EC proposal, the total wastewater generation shall be 353 KLD which shall be treated through STP of capacity 450 KLD based on SBR technology followed by UF; out of the treated wastewater 155 KLD shall be reused in Flushing; 26 KLD - 8 KLD - 2 KLD shall be utilized for Horticulture demand in an
area of 4,721 sqm during Summer-Winter-Monsoon seasons respectively; and 172 KLD - 190 KLD - 196 KLD shall be discharged into MC sewer during Summer-Winter-Monsoon seasons respectively.
# The project proponent has revised this proposal for grant of Consent to Establish and submitted that the remaining treated effluent 172 KLD - 190 KLD - 196 KLD during Summer-Winter-Monsoon seasons respectively, shall be utilized in plantation area to be developed in an area of 2 Acres, as per Karnal Technology with the water loading of 97.5 KLD/acre.
# The project proponent has also submitted an affidavit from the promoters of the company wherein it has mentioned as under:
"(i) That we have applied for Environmental Clearance for our upcol project namely "Aeroland Heights" located at Village Dyalpura, Zirakpur, Punjab vide proposal No.SIA/PB/INFRA2/497106/2024.
(ii) That we have proposed to utilize excess treated wastewater (195 KLD) for Karnal Technology to be developed in the adjoining land area of 2 acres (Khasra No.404/1 (2-17), 405 (4-0), 406 (4-0), 407 (4-0), 409/3 (1-2-16), Pieces 5, Land Measuring 15Bighe-19Biswe-16Biswas being 3596/6396 share Measuring 8Bighe-19Biswe-16Biswasi).
(iii) That the land proposed for Karnal Technology is on the name of the promoter/partner of the company.
(iv) That the land proposed for Karnal Technology shall not be used for any other purpose until the project sewer is connected with the MC Zirakpur sewer."
# The site of the project was visited by officer of RO on 07.01.2026 and observed that:
1. No building construction has yet been started at the site is empty plot.
2. The site falls in the residential zone and during visit, there is no air polluting industry within a radius of 100 mtr. from the proposed site of the project and there is no MAH industry within a radius of 250 mtr. from the proposed site of the project.
3. Thus, the site is suitable as per notification dated 25.07.2008 as amended on 30.10.2009.
Recommendations:
# The RO has recommended that the 'consent to establish' (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the project proponent for one year.
In consideration of the report/ recommendations of RO; if approved, the Consent to Establish (NOC) from pollution angle under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the project proponent for one year subject to suitable general and additional conditions as proposed by RO:
1. This CTE is valid for establishment of Group housing project in an are of 8,797 sqm and total built-up area of 68788 sqm comprising of new Residential Flats 3BHK having 450 no., EWS Flats @45 nos and Shops @ 6 nos., only.
2. The project proponent shall develop and construct the project strictly in accordance with the layout/building/site plan approved by the Competent Authority. In the event of any variation, modification, or deviation in the approved parameters including but not limited to built-up area, green area, layout configuration, or any other project component, the project proponent shall be required to obtain prior approval of the revised layout plan from the Competent Authority and thereafter apply afresh for a revised Consent to Establish (CTE) from the Board reflecting such changes.
3. The project proponent shall comply with conditions mentioned in the Environmental Clearance granted to it by the SEIAA vide EC Identification vide no. EC24C3801PB5601048N dated 31.10.2025 , in true letter & spirit.
4. The project proponent shall not carry out any construction in aberration to the conceptual/ approved plan submitted at the time of grant of Environment Clearance to it, to refrain from committing violation & action thereof under the Environment (Protection) Act, 1986.
5. In case, there is any change in components of the project such as total area, built-up area, water consumption, wastewater generation, solid waste generation etc. if at any stage, then the project proponent shall obtain revised revised/ amendment in Environment Clearance from the SEIAA, Punjab as well as fresh Consent to Establish/ Operate from the Board, for the said change.
6. The project proponent shall install STP of capacity 450 KLD based on SBR technology to treat the wastewater generated from the project and shall provide UF module to enhance the quality of the treated effluent to be reused for flushing purposed in the project.
7. The project proponent shall provide necessary arrangements for usage of the treated effluent after STP for flushing purpose @ 155 KLD during all seasons; 26 KLD- 8 KLD- 2 KLD for horticulture demand in area of 4,721 sqm during the Summer-Winter-Monsoon seasons respectively; and 172 KLD - 190 KLD - 196 KLD of excess treated wastewater onto land under Karnal Technology in an area of acres (Khasra No.404/1 (2-17), 405 (4-0), 406 (4-0), 407 (4-0), 409/3 (1-2-16), Pieces 5, Land Measuring 15Bighe-19Biswe-16Biswas being 3596/6396 share Measuring 8Bighe-19Biswe-16Biswasi) during the Summer-Winter-Monsoon seasons.
8. The land proposed for development of plantation area as per Karnal Technology for utilization of its treated effluent after STP, shall not be used for any other purpose till the time sewer connection is available to the project. The project proponent shall be entirely responsible for the arrangement of additional land required for the disposal of treated domestic effluent, if any. The project proponent shall be bound to lay pipeline for conveyance of treated
wastewater to the site earmarked for Karnal Technology plantation.
9. The project proponent will develop the project on its own risk & cost in regard to disposal arrangement. The project proponent shall be entirely responsible for the arrangement of additional land required for the disposal of treated domestic effluent, if any.
10. The promoter shall also not allow any occupancy in the project till the time adequate arrangements for effluent treatment & disposal, solid waste handling & disposal are made as well as 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 are obtained.
11. The project proponent shall be granted ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974, only after accessing the arrangements for disposal of treated effluent at that point of time. PPCB shall not be responsible for any loss (including financial) to the project proponent in this regard, howsoever.
12. The project proponent shall not carry out any activity/ construction at site which obstructs the natural drainage through the site, in wetland and water bodies and the natural drainage system should be maintained for ensuring unrestricted flow of water.
13. The project proponent shall restrict its water consumption, waste water generation and abide by the treatment proposal for wastewater and solid waste, as per the proposal given by it.
14. During construction phase, it shall ensure that the waste water being generated from the labour quarters/ toilets shall be treated and disposed in environment friendly manner. In this regard, the project proponent shall provide septic tanks for the treatment of wastewater generated from the labour hutments and the treated effluent/ supernatant from the septic tanks shall be utilized in green area/ plantation only.
15. The promoter company shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate.
16. The project proponent shall obtain permission from the PWRDA for the abstraction of ground water.
17. The project proponent shall utilize treated wastewater from nearby STPs for the construction purpose and shall submit an agreement in this regard within one month.
18. The project proponent shall provide separate water meter and energy meter for the STP and maintain record of the same on daily basis.
19. The promoter shall provide a buffer zone of green belt (dense populated trees with pleasant fragrance) around the sewage treatment plant, so as to reduce the effect of odour problem in its vicinity.
20. The promoter company shall explore the possibility of using treated domestic effluent for useful purpose such as construction work, sprinkling on dusty patches/roads, use in nearby construction activities etc.
21. The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted.
22. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter of adequate capacity to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.
23. The project proponent shall obtain permission from GMADA/ MC regarding disposal of the inert solid waste onto any authorized or upcoming dumping/ SLF site of GMADA/ MC. In case, the permission for the same is denied or not allowed by the GMADA/ MC at any stage; then this ‘Consent to Establish’ (NOC) from pollution angle shall be deemed cancelled and the Board shall not be responsible for any financial liability arising due to cancellation of this CTE (NOC). In such case, the project proponent shall apply for fresh ‘Consent to Establish’ (NOC) from pollution angle alongwith concrete proof for alternate modes of disposal of the inert solid waste. The project proponent will develop the project on its own risk & cost in regard to disposal arrangement of the solid wastes.
24. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.
25. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016.
26. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disperse in the air in any form.
27. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form.
28. The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project.
29. The project proponent shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material.
30. The project proponent shall provide mask to every worker working on the construction site and involved in loading/ unloading and carrying of construction material and construction debris.
31. The project proponent shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions.
32. The project proponent shall install mechanical composter for the treatment of solid waste being a bulk waste generator.
33. The project proponent shall make use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021.
34. The Punjab Pollution Control Board shall have the liberty to revoke this consent & take penal action against the industry/project proponent and its responsible/ concerned person(s), in case any information/document provided by the industry/ project proponent is found to be incorrect/false/misleading at any point of time.
35. The Punjab Pollution Control Board shall not be responsible for any financial liability and/ or any other liability of the project proponent, due to grant of this Consent to Establish.
