Subject: Application for obtaining fresh Consent to Establish (NOC) under the Water Act, 1974 and the Air Act, 1981 – M/s Gurvinder Singh Poultry Farm, PO Massingan, Vill Rasulpur urf Dundi Majra, Distt. Patiala.

It is submitted that the poultry farm has applied for obtaining fresh NOC from pollution angle to the Board alongwith the requisite documents under green category of capacity of chicks 12000 number.
The industry has already deposited Rs. 900/- Vide UTR. No. 925219977 dated 23.12.2025 as NOC fee against the project cost of Rs. 8 lakh. The fee deposited by the industry is adequate for one year.
The Project Proponent has submitted the land use classification issued by DTP vide letter no. 2142 dated 23.09.2025, which is attached herewith.
Tehsildar Report:-
The industry has also submitted report of Tehsildar, Dudhan Sadhan vide no. 193 dated 25.03.2025, which is attached herewith.
As per the report, the site is complying with the siting criteria as per the guidelines notified by the CPCB notification no. 6302 dated 01.08.2021.
According, the site was visited by AEE on 14.01.2025 to verify the facts at site as observed as under:
1. The site falls in the revenue estate of Vill Rasulpur urf Dundi Majra, District Patiala.
2. The industry has constructed one no. shed.
3. The industry has proposed to construct septic tank for the treatment of domestic effluent generated from its premises and the treated domestic effluent will be utilized onto land for plantation.
4. No trade effluent will be generated.
As per DTP report, SDM report and visit of undersigned the is complying with sitting CPCB guidelines no. 6302 dated 01.08.2021.
Keeping above in view, it is recommended that consent to establish (NOC) from pollution angle may be granted to the project proponent under green category for one year with usual conditions as per policy of the Board and special conditions that:
1. The industry shall apply for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 before commissioning of its unit.
2. The industry shall not generate or discharge any kind of trade effluent and only domestic effluent generated shall be discharged onto land for plantation/irrigation/green area, after treatment through septic tank.
3. The industry shall obtain necessary clearance for abstraction of ground water from Punjab Water Regulation and Development Authority (PWRDA), if the industry installs submersible pump/tubewell for abstraction of ground water.
4. The industry shall not install any source of air pollution (boiler/furnace) and shall not consume any fuel for burning purpose without the prior written permission of the Board.
5. The industry shall submit building plan approved by competent authority under Director of Factories, Punjab.
6. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
7. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
8. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
9. The NOC is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
10. The industry shall obtain building plans approved from Director of Factories or any competent authority approved from Director of Factories.
11. The industry shall take appropriate environmental measures in compliance to the guidelines issued by the CPCB for poultry farms.
12. The industry shall ensure that there is no public nuisance polluted in the area due to activities within its premises.
13. The industry shall find out the possibility for incineration of dead birds in the incinerator installed by common bio medical waste treatment facility operator at Ludhiana namely M/s Medicare Enviro Management Pvt. Ltd., Ludhiana or shall take other measures.
14. The industry shall develop adequate plantation area to use whole of its wastewater to be generated from the premises.
15. The applicant shall be liable to abide by the provisions of Master Plan and shall also be follow the provisions of section 79 along with the other provisions of PRTPD Act, 1995, in case the site falls in non-conforming land use zone after the notification of Master Plan and no claim shall be demanded by the applicant from the department.
