Sub :- Proceeding of the personal hearing given before the Chief Environmental Engineer, Ludhiana on 19.01.2026 w.r.t show cause notice for refusal of consent to operate under the Air Act, 1981 - M/s Kitty Industries (P) Ltd, Hadbast No. 218, Village- Panglia, P.O Heeran, Chandigarh Road, Ludhiana.

The Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry was earlier granted consent to operate under Water Act, 1974 and Air Act, 1981 vide no. CTOW/Varied/LDH1/2023/22873099 dated 07.08.2023 valid up to 31.03.2026 and CTOA/Varied/LDH1/2023/21651042 dated 17.07.2023 valid up to 31.03.2025. The Industry generates 200 KLD of waste water which consists of 125 KL of domestic wastewater whereas 75 KL is process generated. This 200 KL of treated wastewater is disposed on to land for plantation after treatment in STP. As per granted consent, Industry had installed 15 no. HSD fired ovens, 4 no. HSD fired friers, 2 no. HSD baby boilers of 0.6 TPH and 0.4 TPH Capacity.
Now, the industry has applied for varied Consent to Operate under Air Act, 1981 for same product. There is no change in the product details however there has been changes in fuel and machinery.
The industry was visited by officers of the Board on 29.08.2025 with regard to its earlier application. However, the application was returned by the Competent Authority on the ground of wrong category and change of fuel. Now, the industry has re-applied under new Orange category code (4.1 Bakery, confectionery, sweets with production capacity ≥ 1 TPD). Based on the visit & documents, it is observed as under:
1. The industry was in operation during visit & engaged in manufacturing breads & bakery products.
2. The industry has installed 2 PNG fired baby boiler of capacity 0.6 TPH capacity & 1 no. PNG fired baby boiler of capacity 0.3 TPH. The three boilers have stacks of height 7 meters. As per general emission standards, a minimum stack of 11 meters is suggested for Boilers up to 2 TPH capacities.
3. The industry has installed 23 PNG fired ovens/friers with adequate stack.
4. The industry has installed 02 DG sets of capacity 500 KVA each & One of 750 KVA with canopy but inadequate stack height.
5. The Industry has submitted emission sampling report carried out in July, 2025 of all 23 emission source points at ovens/friers and its 3 Baby Boilers. As per reports, submitted by ITLCH Labs Private Limited, Maximum particulate matter concentration observed in 23 oven/friers is 26 mg/m3 and in Boilers it is 48 mg/m3
6. Overall, The Industry has converted to PNG as fuel in all its oven/friers and its three boilers whereas DG sets are HSD fired.
7. There are two ongoing proceedings against the industry vide e-noting no. 27226436 and 24406329 for violations of the provisions of the Water Act, 1974 and non-renewal of Authorization under HWM Rules 2016. The updated report w.r.t proceedings for violations of the provisions of the Water Act, 1974 has been sent through e-noting no. 27226436 whereas industry has applied for renewal of Authorization under HWM Rules 2016. The application is currently under process.
In view of above, show cause notice for refusal of consent to operate under the Air Act, 1981 has been issued to industry with hearing before the CEE, Ludhiana on 19.01.2026.
Sh. Ashok Rana, Asst. Manager of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that the stack height of the Boiler as well as D.G set are being increased as per prescribed standards of the Board and will be completed within 07 days.
After hearing, the industry officer of the Board and considering background of the case and material facts on the record, the Chief Environmental Engineer of the Board decided that :-
1. The industry shall provide stacks of adequate height with boilers and D.G. sets as per norms prescribed by the Board, within 07 days.
2. The Environmental Engineer, Regional Office-1 Ludhiana shall visit the industry after one week to verify the contentions made by the industry during hearing and submit report alongwith recommendations in the matter so as to decide the consent application.
