Previous consent was granted for discharge of trade effluent @ 720 KLD into the conveyance line of the CETP. Now applied for consent for discharge of @790 KLD………………………….
As per DEMAT certificate, the industry has shares for discharge of wastewater @ 1579 KLD in the CETP……………
The industry has installed a new machine of 600 KG capacity with 4 chambers without permission of the Board…………………………..
As per GNE calculations, the wastewater discharge at the installed machinery is 810 KLD……………………..
Unit has installed excess machinery contributing to discharge of 90 KLD of wastewater compared with previous consent…………………
As per decision taken by the Board on 06.05.2025, the unit cannot carryout expansion beyond the discharge for which previous consent was granted……………….
In a separate application of the industry for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 it has been recommended to refuse the consent to operate due to above said reasons and to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 to seal the excess machinery installed by the unit contributing to excess discharge of 90 KLD into the CETP of 50 MLD treatment capacity………
The application is under consideration of the Competent Authority of the Board…………………
The industry was also afforded an opportunity of personal hearing before CEE(L) on 10.11.2025 u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 in which it was decided as under:-
1. The industry shall take following measures, within 15 days and to ensure that there is no black smoke from its stack:
a. The industry shall upgrade the treatment system and operate its APCD regularly and efficiently so as to achieve the prescribed standards as mandated by the MoEF & CC, Govt. of India vide notification dated 16.05.2023.
b. The industry shall provide energy meter with the APCD and maintain record of the same.
c. The industry shall provide mechanized feeding of fuel is carried out in all time to come.
d. The industry shall ensure that only authorized fuel is utilized in the boiler furnace. The industry shall make all the efforts to avoid wetting of fuel including proper storage/covers while storing in its premises.
e. The industry shall provide CCTV, facing towards camera towards chimney, fuel feeding points and fuel storage area with back up of at least 30 days. The CCTV camera shall be monitored regularly by the owner/responsible person of the industry through online mechanism.
f. The industry shall make a comprehensive proposal for fly ash utilization in scientific manner and shall explore the possibilities for its reuse by the brick kilns owners, road filling by NHAI / PWD/other departments, cement industry and other establishments and submit the same to the Board, within one month.
g. The industry shall maintain daily record of fly ash disposal and submit the same in the Regional Office by every 5th of the month……………………………………..
2. The industry shall, within 07 days, submit revised bank guarantee of Rs. 1 lakh as an assurance to comply with the above decisions…………………………….
3. The industry shall, within 07 days, deposit the Environmental Compensation of Rs. 50,000/-with the Regional Office-3, Ludhiana as per decision of the personal hearing afforded to the industry u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 on 29.03.2023………………………….
4. The industry shall apply for obtaining consent of the Board under the Air (Prevention & Control of Pollution) Act, 1981, immediately…………………………………
5. It was made clear to the industry, in case, the industry is again found emitting black smoke. strict action including closure shall be initiated against the industry u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981………………………………..
6. Environmental Engineer, Regional Office-3, Ludhiana shall visit the industry to verify the contentions of the industry and process the consent application on merit.
The industry has not submitted Environmental Compensation of Rs.50,000/- as well as the revised bank guarantee of Rs.1 lakh as per the decision of the personal hearing dated 10.11.2025 as afforded to the industry…………………….
Recommended to issue notice for refusal of consent with an opportunity of personal hearing to show case within 07 days in writing…………………………………….
