The industry was given a personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 21.08.2025 w.r.t. show cause notice for violation of the provisions under Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 - M/s Platewell Industries, E-100, phase 4 Focal Point, Ludhiana. The Following were present: On behalf of Punjab Pollution Control Board Er. Sukhwant Singh, Environmental Engineer, Zonal Office-1, Ludhiana. On behalf of the industry Sh. Piyush Dogra, Proprietor The Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a small scale red category unit engaged in electroplating. The industry is operating its unit without obtaining consent to operate of the Board. The industry was visited by team of officers of the Board alongwith Municipal Corporation, Ludhiana on 19.04.2025 and during visit, it was observed as under:- 1. The industry was in operation. 2. The industry has made agreement with M/s JBR Technologies Pvt. Ltd., Ludhiana @ 6,000 Ltr. 3. The industry could not produce record regarding bill of purchase of acid for electroplating process. 4. During the visit both the storage tanks were completely full. 5. It is apprehended that the industry might be disposing of its untreated effluent through unauthorized manners in odd hours. 6. The house keeping was very poor. 7. The industry was operational without obtaining consent from the department. 8. The industry could not produce any proof regarding date of commissioning of the unit. In view of the above, the industry was issued show cause notice for violation of the provisions under Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of personal hearing before the Senior Environmental Engineer of the Board on 21.08.2025. Sh. Piyush Dogra, Proprietor attended the hearing and submitted the written reply which was taken on the record. He submitted that the industry is in operation since Sept 2020, engaged in electroplating process and has made agreement with M/s JBR Technologies Pvt. Ltd., Ludhiana for lifting of its trade effluent. They are maintaining proper record of fresh water consumed and trade effluent lifted by JBR and has submitted copy of record. They have submitted bills of purchase of acid for electroplating process from Jan 2025. He further submitted that they have applied for consent to operate under the Water Act, 1974 and the application for consent to operate under the Air Act, 1981 is not submitted due to some technical error, which is being taken up with the Regional Office-1, Ludhiana and same will be applied as early as possible. After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:- 1. The industry shall regularly lift its trade effluent to the CETP operator in accordance with the agreement and ensure that no trade effluent is discharged into sewer or through any unauthorized means under any circumstances. 2. The industry shall maintain proper daily record of fresh water consumption and effluent lifted to the CETP and shall keep it available at site always. 3. The industry shall maintain adequate effluent storage capacity at all times to avoid any overflow or bypass. 4. The industry shall improve overall housekeeping, particularly ensuring no acid spillage and maintaining clean process areas. 5. The industry shall apply for consent to operate under the Air (Prevention & Control of Pollution) Act, 1981, within 07 days.
Now the industry has applied for obtaining Consent to operate under Water Act, 1974. The industry has filled online application form, submitted latest CA certificate, manufacturing process, Rent deed as proof of commissioning, approved building plan, site plan. The industry has deposited Rs. 33000/- vide no. 400140814 dated 23.04.2025 under Water Act, 1974, Rs. 2200/- vide no. 400140814 dated 23.04.2025 under NOC regularization fee. After deducting the penalty fee 500 % i.e. Rs.11000/- and previous fee i.e. Rs. 11000/-. Adequate upto 22.01.2031.
The industry was visited by the undersigned on 16.01.2026 and observations are as follows:
1. 1) The industry was in operation during visit & is engaged in the Electroplating of Auto/Tractor Parts (Job Basis).
2. The industry has made an agreement @ 6000L/month with CETP operator for lifting of its effluent.
3. The industry has provided water meter at the source of supply and the reading noted during visit was 20.8KL.
4. The industry has provided a storage tank for collection of the effluent, of capacity @ 8000 Litres. During the visit approximately 4100 litres water was found stored in the tank.
5. The industry is maintaining the record of fresh water consumption viz-a-viz trade effluent lifted by CETP operator.
6. As per record furnished, opening balance= 2286 litres, Total water consumption in months of July2025 = 5287 Litres (6000litres lifted) , August = 5222 litres (4700 litres lifted), September = 3220 litres (2200 litres lifted), October = 6129 litres (5400litres lifted) , November = 4638 litres (6600 litres lifted), December = 5679 Litres (6000 litres lifted). After considering total evaporation losses @ 10%, record pertaining to fresh water consumption and trade effluent lifted are in consonance.
7. The industry has installed CCTV facing towards the process area and was guided to install CCTV facing the source of water supply and storage tanks from where the trade effluent is lifted and the housekeeping was good.
8. The industry has already submitted approved building plan and rent deed as Date of commissioning proof.
9. The industry is complying with the directions of the personal hearing and also the provisions of the Water Act, 1974.
10. The competency to decide the case lies with the Senior Environmental Engineer of the Board(Red Small)
11. The industry falls under designated Industrial i.e. Focal Point, Ludhiana. Therefore, there is no requirement of Site Clearance u/s 41 (A) of the Factories Act, 1948.
In view of the above, it is recommended that Consent to Operate may be granted to the industry under Water Act, 1974 upto 30.06.2030 with suitable terms and conditions as per the policy of the Board.
