Sub:- Application for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981- M/s Kuber polymers (Earlier Pal Plastic Industries), Village Bijalpur, Patiala Road, Tehsil Samana, Distt. Patiala.
Ref:- Online application Id 30378214 (Water) and 30378176 (Air).
It is intimated that the industry was granted to 'consent to operate' under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/PTA/2016/4644877 dated 09/11/2016 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/PTA/2016/4641753 dated 09/11/2016 both valid upto 30/09/2021 with the suitable conditions for manufacturing of PVC pipes @ 3000 kgs/day.
Earlier the industry was applied for varied consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of PVC pipes @ 6000 kgs/day. While the scrutinized application it was observed that the industry has carried out expansion without obtaining CTE of the Board. 2. There is an increase of Rs. 40 lacs in value of plant and machinery, but the industry has not given the details thereof. 3. The industry has not justified whether site is ok for expansion carried out by it as it has only attached Outside MC certificate, which is not adequate as the certificate from Revenue Authority is required regarding distance of the site of the industry from M.C. Limits, residential area comprising of 15 puca houses and village phirni. The application was returned to the industry earlier with above observations. However, the industry has refused to attach abovesaid documents as sought in previous returned application. The matter was considered by Competent Authority of the Board and it was decided that the application be returned at this stage and the industry will apply again with complete documents.
The industry has also submitted reply regarding the above clarifications as under:-
1. The detail of machinery purchased is attached herewith.
2. We have not made any changes in our building due to said expansion. Therefore, building
plan is not required at this Stage.
3. We are operating our unit at the site since long. Further, the Master Plan of Samana is yet
to be notified. Please find attached herewith certificate from MC, Samana indicating the site of the industry is outside MC limits.
4. We have not purchased any additional land. As such, no suitability certificate is required
from revenue authority.
The industry has submitted a Revenue report from Tehsildar, Samana dated 04/07/2025 copy attached.
Now the industry has applied for varied consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of PVC pipes @ 6000 kgs/day with requisite documents through OCMMS.
The industry has deposited consent fee Rs. 67200/- vide online R. no. 653623741b dated. 11.03.2023 & Rs. 67200/- vide online R. no. 913528463 dated. 11.03.2023 as water and Air consent fee against the fixed assets of Rs. 182.92 Lacs as on 31/03/2025 as per C.A. certificate dated 17/12/2025, which is adequate upto 30/06/2031.The industry has also deposited NOC regularization fee Rs. 3600/- vide online R. No. 653623741 dated. 11.03.2023 due to increase in Plant & machinery.
Accordingly, the industry was visited by undersigned along-with JEE of this office on 08/01/2026 & it was observed as under:-
1. The industry was in operation.
2. The industry was engaged in process of manufacturing of PVC Pipes using PVC resin & fillers as raw materials.
3. There is no source of trade effluent and the industry is discharging its domestic effluent onto land for plantation along the boundary wall after passing through septic tank.
4. The cooling water is being re-circulated through cooling tower installed by the industry.
5. There is one no. DG set of 180 KVA capacity which is provided with canopy and stack of adequate height.
The industry is complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
In view of the above, it is recommended that the varied consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & under Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of PVC Pipe @ 6000 KG/day may be granted i.e. upto 31.12.2030 with the suitable conditions and special condition the industry shall submit land of classification certificate from Distt Town Planner, Patiala within one month.
