File Note: • It is submitted that the industry is a large-scale red category (R-17) sugar mill. It was earlier granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/FZL/2025/28398577 dated 22.04.2025 with validity up to 30.09.2025 and the under the Air Act, 1981 vide no. CTOA/Renewal/FZL/2025/28398615 dated 22.04.2025 with validity upto 30.09.2025 for production of White commercial sugar @ 125 TPD as main product and Bagasse @ 280 TPD, Molasses @ 50 TPD & press mud @ 36 TPD as byproducts using sugarcane @ 1250 TPD as raw material, subject to the certain conditions mentioned therein …………………… • Now, the industry has applied for varied consent to operate under the Water Act, 1974 and the Air Act, 1981 for the production of White commercial sugar @ 125 TPD as main product and Bagasse @ 280 TPD, Molasses @ 50 TPD and Press Mud @ 36 TPD as by products using sugarcane @ 1250 TPD as raw material, alongwith discharge of treated trade effluent @ 300 KLD onto land for plantation.......... • The industry has applied for varied consent to operate under the Water Act, 1974 and Air Act, 1981 due to increase in value of plant and machinery (mainly due to repair). However, there is no change in production capacity as well as pollution load of the industry......... • The industry has deposited Rs. 42,000/- vide UTR / Ref. No.UTIBN62025111146489937 dated 11.11.2025 and Rs. 42000/- vide UTR / Ref. No. UTIBN62025111146490817 dated 11.11.2025 as consent to operate fee under the Water Act, 1974 and Air Act, 1981, respectively against the certificate of CA dated 08.10.2025 showing the value of fixed assets of Rs. 1819.28 lakhs as on 31.03.2025. The consent fee deposited by the industry is adequate up to 30.09.2026 under both Acts (by adjusting the NOC regularization fee for increase in gross fixed assets approx. 87.76 lacs).......... ……. • The industry has submitted a certificate from MC Fazilka vide no. 2042 dated 29.10.2025 which specifies that the industry lies outside the MC limits.......... • The industry has submitted compliance report of previous consent conditions in annotated form......... ……….. • The industry has attached analysis report of previous water sampling carried out by the Board on 02.01.2025 and as per Board’s Water lab analysis report, the concentration of all parameters (pH, TSS, COD, BOD, MLSS and MLVSS was 8.2, 50 mg/l, 106 mg/l, 18 mg/l, 3290 mg/l and 2470 mg/l, respectively) was within permissible limits………………. • The industry was visited by Er. Ravinder Bhatti, SEE, Er Ravipal, EE, Er Harblister Singh, AEE and Sh. Gurpyar Singh, SA on 17.12.2025 and it was observed as under: (i) The industry was found to be in operation at the time of visit.......... (ii) ETP installed by the industry was operational. The ETP comprises an Collection tank , Oil and Grease trap, Equalization tank, Primary Clarifier, Aeration tanks, Secondary Clarifier tank, Outlet Chamber and Sludge Drying beds........ (iii) During visit, ETP was in operation and treated effluent was being discharged onto land for plantation. The industry has developed plantation over an area of approximately 04 acres for disposal of treated trade effluent .......... (iv) During visit, treated effluent sample collected from outlet of ETP as well as aeration tank. As per analysis report, the concentration of all parameters (pH 6.7, TSS: 54 mg/l, COD: 75 mg/l, BOD: 16 mg/l & oil and grease: 6.5 mg/l ) was within permissible limits. However, the value of MLSS: 490 mg/l & MLVSS: 380 mg/l is on lower side……. (v) A flow meter has been installed at the outlet of the ETP which indicated a totalized flow of 4362.53 m³ and flow reading of 10.059 m³/hour, during the time of visit……. (vi) A separate energy meter has also been provided for the ETP. The industry is maintaining record of treated effluent generated from the ETP….. (vii) The industry has also installed CCTV cameras at the ETP which were in proper working condition......... (viii) The industry has installed two boilers, each of 20 TPH capacity, using bagasse as fuel. Both boilers were found operational and equipped with wet scrubbers as APCD, along with common stack of adequate height and proper sampling arrangements……. (ix) During visit, air emission sample was collected from porthole of the stack of wet scrubber. As per analysis report, the conc. of particulate matter is reported as 493 mg/Nm3 against the permissible limit of 150 mg/Nm3 for the sugar industry…….. (x) Water recirculation pump of wet scrubber was not in operation. However, the representative made it operational during the visit ……… (xi) It is pertinent to mention here that the industry was earlier granted consent to operate under Air Act, 1981 with special condition that the industry will ensure to replace the existing wet scrubbers (APCDs) with the new ones. However, the industry has not yet replaced the existing wet scrubbers. Hence, not complying with the earlier consent conditions. (xii) The industry has installed a DG set of 166 kVA capacity, provided with canopy and adequate stack height.......... • RO has reported that the industry may be granted consent to operate for Water Act, 1974 and show cause notice may be issued for refusal of consent to operate under the Air Act, 1981. • It is further added that the industry has provided OCEMS for ETP which is connected with the server of the Board. The OCEMS was checked on 23.12.2026 and showing off line from 20.12.2025. Keeping in view of the above and recommendations of RO, if approved, the industry may be granted consents to operate under the Water Act, 1974 upto 30.09.2026 (adequacy of consent fee) with following special conditions : 1. The industry will ensure continuous operation of ETP even during the non-crushing season for the adequate maintenance of required biomass in compliance to the directions of the Central Pollution Control Board (CPCB) and shall operate the ETP efficiently to achieve the prescribed standards at all times........ 2. The industry shall develop adequate land area under plantation with proper distribution system before the operation of next crushing season 2026-27, so as to utilize its entire treated trade/domestic effluent and shall further ensure no stagnation / indiscriminate disposal of its effluent....... 3. The industry shall maintain good house-keeping in and around the ETP….. 4. The industry shall ensure regular operation/calibration of OCEMS installed at the outlet of the ETP........... 5. The industry shall get itself registered and establish connectivity of OCEMS with Online Data Acquisition and Monitoring System (ODAMS) portal of CPCB (https://cems.cpcb.gov.in) within 15 days, in order to ensure the compliance of the directions issued by CPCB u/s 18 (1) (b) of the Water Act, 1974 and Air Act, 1981 at and thereafter submit compliance to the Board, immediately. 6. The industry shall maintain the record of ETP operation w.r.t. water meter, energy meter readings on daily basis…… 7. The industry shall ensure that there is no nuisance / pollution in the vicinity with operation of the unit. 8. The consent to operate is being granted by the Board from pollution angle only. The industry is bound to obtain other statutory clearances from other departments, as required…… 9. The industry shall not increase the production and land area without obtaining prior permission from the Board…… 10. The project proponent shall devise the ways & means to minimize the generation of all kind of wastes through REDUCE, REUSE and RECYCLE activities. The generated waste, if any, shall be properly handled and managed as per the provisions of the Municipal Solid Waste Rules 2016 in an environmentally sound manner.......... 11. The Project proponent (PP) may also develop the vermicomposting/composting to manage the biodegradable solid waste. PP shall not throw, burn or bury any solid wastes in open, outside premises or in drain / water bodies........ 12. The Project proponent shall ensure that there are no usages of plastic carry bags and single use plastic / thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises........... 13. The Project proponent shall perform / promote its Corporate Environment Responsibility (CER) activities as well as use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic ............ 14. PP shall carry out awareness and activities for the themes / action points identified under Mission LiFE (Lifestyle for the Environment) by Ministry of Environment, Forests and Climate Change given at the website (http://missionlife-moefcc.nic.in)........
