It is submitted that show cause notice before refusal of 'Consent to Establish' (NOC) under the provisions of Water Act, 1974 and Air Act, 1981 was issued to the industry alongwith an opportunity of personal hearing before the Senior Environmental Engineer (B) of the Board on 05.01.2026.
During the personal hearing, the Project Proponent (PP) submitted a reply (copy enclosed), the gist of which is as under:
1. Tehsildar report of 15 Pucca house in 100-meter report we hereby obtained the same report from concerned tehsildar and annexed to this reply.
2. We have deposited Rs. 10,800/- as NOC fee.
3. We have proposed 3 Thrashers (for Shredding) attached with one APCD dust collector using bag filter of 36 bags and 1 dryer, 1 hammer mill and 2 pallet mills attached with two APCDs (dust collector Bag Filter having 52 Bags).
4. We have provided dimensional diagram of the same.
5. In dryer we will use bio-mass pallets as fuel @50 Kg/hr.
Subsequently, proceedings of the personal hearing were issued and the following decisions were taken by the Senior Environmental Engineer (B):
1. The reply submitted by the project proponent be forwarded to Regional Office, Sri Muktsar Sahib, immediately.
2. The Environmental Engineer, Regional Office, Sri Muktsar Sahib shall examine the reply and shall submit the report with conclusive recommendations, within 02 days.
3. The application of the project proponent shall be decided after receipt of report from Regional Office, Sri Muktsar Sahib. Submitted for confirmation of the decisions of the proceedings of hearing dated 05.01.2026, please.
Point-wise examination report of the reply is as under:
1. The Tehsildar report submitted by the PP is found to be satisfactory.
2. The PP has deposited Rs. 10,800/- vide online receipt no. 28511884 dated 06.01.2026 as NOC fee.
3. The PP has proposed 3 Thrashers (for shredding) attached with one APCD having bag filter of 36 bags, and 1 dryer, 1 hammer mill, and 2 pellet mills attached with two APCDs having bag filters of 52 bags each. The proposal regarding APCDs appears principally adequate.
4. The PP has submitted the drawing of the APCDs.
In view of the above examination, it is observed that the Project Proponent has satisfactorily complied with the observations raised in the show cause notice and the decisions taken during the personal hearing held on 05.01.2026. The Tehsildar report regarding the absence of 15 pucca houses within 100 meters is found satisfactory, the requisite NOC fee has been deposited, and the proposed Air Pollution Control Devices (APCDs) appear principally adequate.
Accordingly, the application of the Project Proponent for grant of Consent to Establish (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be considered for approval.
