It is submitted that the industry is a small scale Orange category unit and was granted 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH2/2023/23782393 dated 29/12/2023 valid upto 30/09/2028 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH2/2023/23782423 dated 29/12/2023 valid upto 30/09/2028 This consent is valid for manufacturing of Hand Tools @ 04 Metric Tonnes/Day Forging of Auto Parts @ 08 Metric Tonnes/Day.
Thereafter, the industry was visited by the officer of this office on 25/03/2025 and it was observed that the industry has installed 06 forging hammers in which furnace oil is being used is fuel and are provided with adequate stack height. The industry has provided 02 hammers with electrically operated billet heaters. The industry has installed 03 shot blasting machines, which are provided with inbuilt bag house each as APCD and stacks of inadequate height. The industry has installed 01 DG set of capacities 380 KVA. There is no generation of trade effluent and is discharging only domestic effluent into M.C. sewer. The industry is disposing off hazardous waste of category 33.2 (contaminated cloths etc) in Municipal Solid Waste. Housekeeping in the entire units was very bad.
It is pertinent to mention here that the industry has merged its another unit of small scale red category under the name & style of M/s Ess Ess Forging, GT Road, Ludhiana. Now, both units have common entrance and exit with common electric connection.
Accordingly, the industry was given personal hearing given before the SEE, Zonal Office-I, Ludhiana on 08.05.2025 and during hearing it was decided that:-
1. Consent to operate granted under the Air (Prevention & Control of Pollution) Act, 1981 be revoked.
2. The industry shall apply for Consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 for installation of electrically operated billet heaters, within 15 days.
3. The industry shall provide stacks of adequate height with shot blasting machines, within 15 days.
4. The industry shall improve the overall housekeeping in the premises.
5. The industry shall apply for authorization under the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016, within 15 days.
6. Environmental Engineer, Regional Office-2, Ludhiana shall visit the industry to verify the submissions made by the industry and process consent/ authorization applications on merits.
Now, it has applied for fresh 'consent to operate' under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 along-with requisite documents through OCMMS for manufacturing of product FORGING OF AUTO PARTS @ 10 TPD & FORGING OF HAND TOOLS @ 2 TPD. The industry has deposited Rs. 54000/- vide UTR No. 112528986 dated 30.09.2023 & Rs. 30500/- vide e-R no. 520997801 dated 12/07/2025 (Rs. 21600/- water, Rs. 8400/- as NOC regularization fee & Rs. 500/- form fee) under Water Act, 1974 & Rs. 21600/- vide e-R no. 42232131 dated 12/07/2025 & Rs. 54000/- vide UTR No. 141940113 dated 30.09.2023 (air)consent fee against the un-depreciated fixed assets of Rs. 485.35 Lacs as on 14/06/2025, which is adequate upto 30/09/2030 as per Board's Office Order dated 29/10/2018 after deducting NOC regularization fee.
Accordingly, the industry was visited by the officer of this office on 15.01.2026. During the visit, it was observed as under:
1. The industry was in operation during visit.
2. It is engaged in manufacturing of Forging of Auto Parts, Forging Of Hand Tools by using Bar Steel as raw material.
3. The manufacturing process is as Raw material Shearing of Round Bar Heating forging Trimming Heat Treatment (if necessary) Grinding Shot blast Final inspection Packing Dispatch.
4. There is no generation of trade effluent and entire cooling water is re-circulated and only domestic effluent is discharged into sewer.
5. The industry has installed 17 No. Lathe machines, 3 no. Hydraulic machines, 1 no. Normalizing machine & 15 No. Power Presses of various capacities.
6. The industry has installed 06 forging hammers out of which 4 No. electric forging hammers and 2 Hammers are Gas fired with adequate stack height.
7. The industry has installed 03 shot blasting machines, which are provided with inbuilt bag house each as APCD and stacks of adequate height.
8. The industry has installed 01 DG set of capacities 380 KVA with canopy and adequate stack height.
9. The industry has submitted approved building plan for Director of Factory, Punjab.
10. The site of the industry falls in Industrial Area-C, Ludhiana.
11. During the visit category waste of 33.2 was not found. No 5.1 category used oil stored because the D.G set has not yet been serviced. The industry has been advised to store 5.1 category waste in dedicated hazardous waste storage room.
12. The industry has applied for the authorization under Hazardous Waste Rules, 2016 vide application no. 30967145 for category 5.1 only, which is under process.
In the subject cited case, the industry has mentioned ground water extraction @ 1.6 KLD. Considering 25 working days per month, ground water extraction will be 40 KL/month, which is less than 300 KL/month.
It is further submitted that the industry has another sister concern unit namely M/s Ess Ess Forgings (R17LDH25430268) at G.T. Road, Behind Raja Vanaspati, Jugiana, Ludhiana which was reported (on visit date 25.03.2025) to be operational within the same premises vide report dated 26.03.2025 in e-note no. 28289298 which has now been closed and now only M/s Happy Machine Tools operate within the premises. It is further submitted that the industry has another unit in the same name of M/s Ess Ess Forgings (R16LDH24130189) at Industrial Area-C , Near Basant cinema,P.O. Jugiana , Ludhiana so the industry could not produce dissolution deed of M/s Ess Ess Forgings and could not surrender the GST number of the firm as it is common with unit which is operational at Industrial Area-C , Near Basant cinema,P.O. Jugiana , Ludhiana.
The industry is complying with the hearing decisions held before the SEE, Zonal Office-I, Ludhiana on 08.05.2025.
In view of the above, it is recommended that consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.09.2030 to the industry, please.
