It is submitted that, the industry was a small scale orange category unit and was granted 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH2/2023/24230890 dated 30.12.2023 and no. CTOA/Renewal/LDH2/ 2023/24230888 dated 30.12.2023, which has been expired on 13.01.2024 for manufacturing of Non Alloy Steel Round/Alloy Steel Round @ 80 T/day using Non Alloy Steel Ingots/Alloy Steel Ingots/Billets @ 80 T/day as raw material.. Further, it has obtained auto renewal of 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTO/Renewal/LDH2/2024/24746363 dated 2024-06-29 expired on 2025-06-29 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTO/Renewal/LDH2/2024/26062882 dated 2024-06-29 expired on 2025-06-29.
Thereafter, the site of the industry was visited by the officers of this office on 06.02.2025 to collect stack sample and during visit it was observed the industry has installed 1 no. coal fired reverbratory Furnace followed by Rolling mill. The industry has installed cyclone followed by wet scrubber as APCD, however cyclone was not working properly. The Stack emission sample was collected by this office during visit and SPM is reported as 298 mg/Nm3 against the prescribed standards of 150 mg/Nm3, which is beyond the prescribed limit.
Thereafter, the industry was visited by officer of the Board on 24.05.2024 and found non complying during the visit. Accordingly, the industry was issued notice u/s 31-A of the Air Act, 1981 alongwith show cause notice for violations of provisions under the Water Act, 1974 with an opportunity of personal hearing before the Chief Environmental Engineer on 18.07.2024, wherein it was decided as under:
1. The Environmental Engineer, Regional Office shall visit the industry immediately and submit flash report in the matter.
2. It is made clear that in case the industry was again found violating the provisions of pollution control laws, directions for closure of unit may be issued without giving any opportunity of show cause / hearing.
Thereafter, the industry was again visited by officer of the Board on 24.06.2025 and it was observed as under:-
1. The industry was operational and engaged in making MS Round from ingots.
2. A wet scrubber is provided as APCD; however, the chimney stack was damaged and inadequately maintained, with parts reported to have collapsed. Around 16 bags of APCD dust were stored in a designated room.
3. Poor housekeeping was noted at the premises.
4. The air emission samples of reheating furnace were collected during visit and as per analysis results concentration of SPM is 167 mg/Nm³, which is beyond the prescribed limit of 150 mg/Nm³.
Accordingly, the industry was issued notice to issue directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 alongwith show cause notice for cancellation of consent to operate granted under the Air (Prevention & Control of Pollution) Act, 1981 with hearing before the Chief Environmental Engineer of the Board on 24.07.2025 and after hearing it was decided as under :-
1. The industry shall complete the installation and commissioning of the new chimney alongwith sampling infrastructure with reheating furnace, within15 days.
2. The industry shall operate its APCD, regularly and efficiently so as to achieve the standards prescribed for such units.
3. The industry shall provide separate energy meter with APCD and maintain record of energy consumption for operation of APCD on daily basis.
4. The industry shall submit a Bank Guarantee amounting to Rs. 1.0 Lakh with a validity of atleast 02 years as an assurance to operate the APCD regularly and achieve the prescribed standards, within 15 days.
5. The industry shall not use furnace oil as fuel and shall only use those fuels which are permitted under the Fuel policy notified vide no. 10/64/2020-STE4/469 dated 04.10.2023.
6. The industry shall store, handle and dispose hazardous waste in an environmentally sound manner and to ensure handling, labeling, and storage of APCD dust in accordance with the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 and maintain records properly.
7. The Environmental Engineer, Regional Office-2, Ludhiana shall visit the industry to check the compliance of above decisions and environmental compliances. He shall also collect stack emission sample of reheating furnace and submit the report alongwith recommendation in the matter.
Now, the industry has applied for varied consent to operate under Water Act, 1974 & Air Act, 1981 alongwith requisite documents as the industry has changed its name from M/s Shri Trivani Puri Steel to M/s Shri Trivani Puri Alloys and also change in its ownership. The industry had deposited Rs. 22100/- vide e-R No. 586594826 dated 07.10.2025 (Rs. 10800/- water & Rs. 10800/- as NOC regularization fee), Rs. 10800/- vide UTR No. 604446885 dated 23.12.2025 & Rs. 10800/- vide e-R No. 209956301 dated 07.10.2025 & Rs. 10800/- vide UTR No. 548212128 dated 23.12.2025 under Air Act, 1981 against the un-depreciated fixed assets of Rs. 361.13 Lacs as on 26.08.2025, which is adequate upto 31/03/2027 under Water Act, 1974 & Air Act, 1981, as per Board's Office Order dated 29/10/2018 after deducting 25% penalty fee. The industry has also submitted the bank guarantee of Rs. 1.0 Lacs.
Accordingly, the industry was visited by the AEE of this office on 07.01.2026 During the visit, it was observed as under:-
1. The industry was not in operation during the visit due to breakdown in its furnace.
2. The industry has installed one no. reheating furnace (coal fired) with cyclone separator followed by wet scrubber, same was not in operation, so air emission sampling could not be carried out. However, the industry has deposited Rs. 13824/- as sample testing fee in advance to collect the sample.
3. The industry has installed one coal pulveriser with cyclone separator and bag filter as APCD to control emissions.
4. There is no source of trade effluent & domestic effluent is discharged onto land for plantation after septic tank. Cooling water is being re-circulated.
5. There is no D.G. set installed by the industry.
6. The industry has submit a Bank Guarantee amounting to Rs. 1.0 Lakh bearing no. 03090ILG000825 dated 21.11.2025 as an assurance to operate the APCD regularly and achieve the prescribed standards.
7. The industry has already submitted approved building plan from the approved person by Directors of Factories, Punjab.
8. The industry has already submitted the letter issued by DTP, Ludhiana vide no. 2139 dated 23.06.2009 stating that the site of the industry falls in Medium and Heavy Industrial Zone as per approved Master Plan, Ludhiana (2007-21).
It is therefore recommended that varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.03.2027 with suitable conditions and special condition that the industry will submit air emission sample report from the Board within this period as per policy of the Board.
