It is submitted that the industry is a medium-scale orange category unit. Earlier the industry was granted 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 for production of Edible Crude Oil @ 15 TPD & de-oiled cake @ 80 TPD and for disposal of 20 KLD of effluent in 1 acre and for operation of Boiler @ 5 TPH vide dated 05.02.2021 valid up to 30.09.2021 with suitable conditions.
The industry had earlier applied for obtaining Consent to Establish along with requisite documents. In persuasion of the application, industry was visited by officer on 11.02.2022 and it was observed as under: -
1. The industry was in operation during visit and engaged in the production of Edible Crude Oil & De-oiled cake by using Rice Bran.
2. The industry has already installed one Boiler of capacity 5 TPH (as per consents) and thermopack with multi cyclone as APCD. However, the air emission sampling was not done due to non-availability of Lab staff.
3. The industry has already installed a Boiler of 12 TPH with multi cyclone as APCD for Refinery plant.
4. The machinery of Refinery plant was under installation during visit and is almost complete.
5. The industry has just started the installation of ETP at site and the same is not in commensuration with the rest of project.
Accordingly, application of the industry was refused. The industry was again visited by officer on 01.09.2022 and it was observed as under:-
1. The industry was in operation during visit and engaged in the production of Edible Crude oil. The refinery plant was in operation but the solvent plant was not in operation.
2. The waste effluent from the refinery plant was being discharged onto land without any treatment.
3. The industry has not installed any ETP for treatment of effluent generated from the refinery process. The ETP was under installation during visit and only civil work was completed.
4. The stagnation was observed in the open area and it appears that the untreated effluent is discharged from few months.
5. The effluent samples were collected from the outlet of the industry and it failed to meet prescribed standards.
Thereafter the industry has been issued directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 were issued vide Zonal Office-1, Ludhiana letter no. 4721-22 dated 19.10.2022 and orders to disconnect the electric supply of the industry were issued to PSCPSL vide Board's letter no. 4717-18 dated 19.10.2022. The above proceedings are covered vide e-noting no. 19843081.
In compliance to the direction issued by the Board for disconnection of electricity, the PSPCL authorities disconnected the supply w.e.f. 10.11.2022 vide letter dated 10.11.2022.
Thereafter, industry applied for 'Consent to Operate' was granted under Water (Prevention & Control of Pollution) Act, 1974 Air (Prevention & Control of Pollution) Act, 1981 on 07.11.2022 (as per requested of industry, the application was returned) and on 18.11.2022. The industry had been visited on 11.11.2022 and it was observed as under:
1. The industry was not in operation during visit and electric connection was found disconnected.
2. The industry presently proposed to operate only its spent recovery unit and has made it in operational condition. The refinery unit is yet not made in operational condition. Hence, the industry will manufacture only edible crude oil from the rice brain & presently further refining of edible crude oil will not done at this location.
3. The industry has already installed ETP for treatment of effluent generated from its existing unit of solvent extraction plant. The treated effluent will be disposed off onto land for plantation & has adequate area for it's disposal. The component of ETP is Graded Screen-Oil and grease separator- Raw Waste water collection-cum-reaction tank-Primary Clarifier- Up-flow anaerobic bio-filter-Aeration tank (MBBR)- Secondary clarifier-Filter feed sump- Multi-grade pressure depth filter- primary/secondary sludge handling.
4. The industry has installed a rice husk fired FBC boiler of capacity 5 TPH with trima cyclone as APCD and adequate stack height.
5. The industry has also installed one thermopac along-with multi-cyclone as APCD.
6. Domestic effluent @ 2 KLD will be discharged onto land for plantation after septic tank.
7. The industry has one D.G. set of capacity 320 KVA with canopy and adequate stack height.
In pursuance of the application, The Industry was granted Consent to operate under Water Act, 1974 vide no. CTOW/Fresh/LDH1/2022/20435818 and Air Act, 1981 vide no. CTOA/Fresh/LDH1/2022/20435811 dated 30.11.2022 valid up to 29.05.2023. Directions were issued temporary restoration of electric connection up to 29.05.2023 vide letter no. 5301-02 dated 30.11.2022 with special condition that the industry shall not operate its machinery which has been installed without obtaining SAC. Apart from that, due to violations found during visit on 11.02.2022 and compliance noted on 11.11.2022, Environmental Compensation of Rs. 5 lacs was imposed on the industry by the Competent Authority vide zonal office letter no. 5305 dated 30.11.2022.
Thereafter the industry filed an appeal (Appeal No.26/SLO/AA/2022) DATED 30.12.2022 before the Appellate Authority of the Board against the orders issued regarding imposition of EC amounting Rs. 5 lacs.
On dated 31.05.2023 the case was listed and the Appellate Authority has disposed off the appeal with directions to the Board to reconsider the case and pass fresh orders in the matter within one month.
The worthy SSTE (Appellate authority) has passed the orders which are reproduced as under:
In view of the specific statement of the representative of the appellant that there are two different plants in the same premises - solvent extraction plant and refinery unit and both the units have different operational ETP systems, I deem it appropriate to remand the case back to the Board with a direction to the Chairman to reconsider the case and pass a fresh order within one month from the date of receipt of this order, after considering all the aspects. The orders were endorsed to worthy Chairperson vide letter no. No.26/SLO/AA/2022/185-87 dated 15.06.2023. The same are attached in e-noting no. 20859699. One Parallel e-noting 20859766 was also started for compliance of special condition that the industry will not operate the additional machinery installed i.e. other than for which it has obtained SAC clearance. The same was closed after compliance.
Thereafter, industry applied for 'Consent to Operate' was granted under Water (Prevention & Control of Pollution) Act, 1974 Air (Prevention & Control of Pollution) Act, 1981 on 01.07.2023 & was granted 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 CTOW/Renewal/LDH1/2023/22648025 dated 11.08.2023 valid up to 10.02.2024 & Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH1/2023/22648004 dated 11.08.2023 valid up to 10.02.2024 with suitable terms and conditions and temporary restoration of electric connection up to 10.02.2024 with special condition that the industry shall not operate its machinery which was installed without obtaining SAC.
Thereafter the industry was again granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and same was granted vide no. CTOW/Renewal/LDH1/2024/25018022 Date of issue: 01/04/2024 Date of expiry: 30/09/2024 and CTOA/Renewal/LDH1/2024/25018018 Date of issue: 01/04/2024 Date of expiry: 30/09/2024 with temporary restoration of electric connection.
Thereafter Industry was again granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH1/2024/27287815 Date of issue: 28/11/2024 Date of expiry: 27/05/2025 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH1/2024/27287810 Date of issue: 28/11/2024 Date of expiry: 27/05/2025 with temporary restoration of electric connection for six month (i.e. up to 27/05/2025 vide letter no. 6727 dated 28.11.2024) for production of Edible oil @ 300 TPD and Edible crude oil @ 15 TPD using RICE FLOUR @ 100 MTD, RICE BRAN CRUDE OIL @ 300 TPD & Hexane @ 200 LPD. The Industry was last visited by regional office on 12.11.2024 and it was observed as under:
1. The industry was not in operation during visit due to insufficient raw material.
2. The industry has 1 no. refinery unit and 1 solvent plant in its premises.
3. The industry has provided separate ETP along with its solvent plant which was not in operation. The components of ETP are as follows: Collection tank-Clarifier-cum-tube settler- Pre-filtration followed by carbon-cum-sand filter- onto land for plantation.
4. The industry has provided separate ETP with refinery unit which was also not in operation. The components of ETP is as follows: Graded Screen-Oil and grease separator- Raw Waste water collection-cum-reaction tank-Primary Clarifier- Up-flow anaerobic bio-filter-Aeration tank (MBBR)- Secondary clarifier-Filter feed sump- Multi-grade pressure depth filter- primary/secondary sludge handling. Aeration was in operation during visit.
5. The industry has provided approx. 3 acre of land for plantation area for disposal off treated waste water generated from the ETP. Now the industry has developed the plantation area and clears all the wild grass and provided proper furrows
6. The industry has installed a rice husk fired FBC boiler of capacity 5 TPH with multi-cyclone as APCD and adequate stack height.
7. The industry has also installed one thermopac of 15 lakh Kcal capacity along-with multi-cyclone as Common APCD and common stack height with above mentioned 5 TPH boiler.
8. The industry has provided 1 boiler of 12 TPH capacity equipped with multi-cyclone and water scrubber as APCD with adequate stack height.
9. Domestic effluent @ 2 KLD will be discharged onto land for plantation after septic tank.
10. The industry has one D.G. set of capacity 320 KVA with canopy and adequate stack height.
Now the industry has applied for renewal Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 along with requisite documents for production of Edible Crude Oil @ 15 TPD, Edible Oil @ 300 TPD & by-product de-oiled cake @ 80 TPD with permanent restoration of electric connection.
The industry has already deposited Rs. 338400/- vide UTR. no. HDFCR52022110357576083 dated 03.11.2022 under Water Act, 1974. Rs. 338400/- vide no. HDFCR52022110357565178 dated 03.11.2022 under Air Act, 1981.Rs. 8400/- vide no. 500992080 dated 28.09.2024 as NOC regularization fee and has now deposited Rs. 28200/- vide UTR. no. 243725840 dated 30.12.2025 under Water Act, 1974. Rs. 33800/- vide UTR. no. 958426265 dated 31.12.2025 under Air Act, 1981 including Rs. 5600/- as NOC regularization fee. Adequate up to 30.09.2027. The Current CA certificate has gross assets of 4915.48 lacs with P&M as 3593.45 (3511.76), Land & Building as 1135.64 lacs and gross assets as 186.39 lacs. The small increase in P&M consists of loose MS Sheet, MS Channel, Machinery parts, S S Vessels.
To verify the facts the industry was visited by AEE (Lovinder Singh Mann) along with JSO Baldeep Singh and Field assistant on 16.01.2025 & observed that:-
1. The industry was in operation during visit.
2. The industry has 1 no. refinery unit and 1 solvent plant in its premises. The refinery unit was operational during the visit. Two Separate ETPs have been provided for each unit.
3. The industry ETP with refinery unit which was in operation. The components of ETP is as follows: Graded Screen-Oil and grease separator- Raw Waste water collection-cum-reaction tank-Primary Clarifier- Up-flow anaerobic bio-filter-Aeration tank (MBBR)- Secondary clarifier-Filter feed sump- Multi-grade pressure filter. Aeration was in operation during visit. The effluent samples from the outlet of ETP have been submitted for analysis in the Zonal Lab, Ludhiana. The Industry has also submitted effluent sample reports of SIMA labs, New Delhi dated 23.11.2025. The results are with in prescribed limits.
4. The industry has provided approx. 3 acre of land for plantation area for disposal off treated waste water generated from the ETP.
5. The industry has installed a rice husk fired FBC boiler of capacity 5 TPH with multi-cyclone as APCD and adequate stack height.
6. The industry has also installed one thermopac of 15 lakh Kcal capacity along-with multi-cyclone as Common APCD and common stack height with above mentioned 5 TPH boiler. The emission samples have been taken for analysis and results are pending.
7. The industry has provided 1 boiler of 12 TPH capacity equipped with multi-cyclone as APCD with adequate stack height.
8. Domestic effluent @ 2 KLD will be discharged onto land for plantation after septic tank.
9. The industry has one D.G. set of capacity 1000, 600 AND 380 KVA with canopy and adequate stack height.
In view it is recommended that Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 be granted to the unit for six months along with temporary restoration of power, please.
