Public Sand Mining Project was granted ‘Consent to Operate’ under the Water Act, 1974 & the Air Act, 1981 vide no. CTOW/Fresh/FZR/2023/24015592 and CTOA/Fresh/FZR/2023/24015053 respectively, both dated 06.11.2023, valid upto 31.03.2024 each under ‘orange category’ for operation of mining site measuring 3.29 acre (1.33 hectare) {bearing khasra nos. 30//8/2(4-0), 9(8-0), 10/2(3-14), 10/1(3-14), 13/2(4- 0), 14/1(2-0), 30//8/1/2(0-11)} in the revenue estate of Village Changali Jadid, Tehsil & District Ferozepur for mining of minor minerals (Sand) @ 29557 TPA.
Thereafter, Public Sand Mining Project auto-renewed its ‘Consent to Operate’ under the Water Act, 1974 & the Air Act, 1981 vide no. CTO/Renewal/FZR/2024/25418242 and CTO/Renewal/FZR/2024/25417890, both dated 18.04.2024, valid upto 18.04.2025 each.
Now, Public Sand Mining Project (Sand) has again applied for obtaining ‘Consent to Operate’ under the Water Act, 1974 & the Air Act, 1981 under ‘orange category’ for operation of mining site measuring 3.29 acre (1.33 hectare) {bearing khasra nos. 30//8/2 (4-0), 9(8-0), 10/2(3-14), 10/1(3-14), 13/2(4- 0), 14/1(2-0), 30//8/1/2 (0-11)} in the revenue estate of Village Changali Jadid, Tehsil & District Ferozepur for mining of minor minerals (Sand) @ 29557 TPA. The details of case are as under:
1. The project proponent has already obtained Environmental Clearance vide no. EC23B001PB189906 dated 12.09.2023 in the name of Changali Jadid Sand Mining Project, Executive Engineer/Ferozepur, Drainage-Cum-Mining & Geology Division Water Resources Department, Ferozepur, for mining of sand @ 29557 TPA in revenue area measuring 3.29 acre (1.33 hectare), bearing khasra nos. 30//8/2(4-0), 9(8-0), 10/2(3-14), 10/1(3-14), 13/2(4- 0), 14/1(2-0), 30//8/1/2(0-11), Village Changali Jadid, Tehsil & Distt. Ferozepur valid for a period of 30 years from date of issuance of EC under category-B2 with project / activity 1(a) for mining of minor minerals (Sand) on Agriculture Land as per approved mining Plan with the manual method of mining only & subsequent presentation / clarifications made by the project proponent, subject to the conditions as proposed by the SEAC & certain amendments therein & agreed by the project proponent in addition to the proposed measures.
2. The Public Sand Mining site has submitted copy of mining plan for mining site measuring 3.29 acre (1.33 hectare) in the revenue estate of Village Changali Jadid, Tehsil & District Ferozepur bearing khasra nos. 30//8/2(4-0), 9(8-0), 10/2(3-14), 10/1(3-14), 13/2(4- 0), 14/1(2-0), 30//8/1/2(0-11) for mining of minor minerals (Sand) @ 29557 TPA.
3. The Public Sand Mining site has submitted copy of approval letter for approval of mining plan of Minor Mineral of Village Mamdot Uttar, Tehsil & District Ferozepur vide no. Glg/Pb./M.P./Changali Jadid/1569 dated 29.05.2023 approved by Assistant Geologist, Mines & Geology, Water Resources Department, Punjab, Chandigarh.
4. The Public Sand Mining site has submitted project cost chart, showing total cost of the project will be 29.21 lacs. Accordingly, it has deposited consent fee of Rs. 2900/- vide UTR/Ref. No. AXSK233030030344 dated 30.10.2023 as Consent to Operate fee under the Water Act, 1974 and Rs. 2900/- vide UTR/Ref. No. AXSK233030030329 dated 30.10.2023 under Air Act, 1981 and also deposited Rs. 8700/- vide UTR No. RBISN62025122231275784 dated 22-12-2025 (Rs. 4350/- under the Water Act, 1974 and Rs. 4350/- under the Air Act, 1981), which is adequate upto 31.03.2027 under both the Acts after adjusting penalty and previous fee.
5. The Public Sand Mining site has submitted copy of revenue record, copy of latha and aks sijra for the site.
6. The Public Sand Mining site has submitted copy of site plan.
To process the application, the mining site was visited by this undersigned on 23-01-2025 and it was observed as under:
1. The site is located in the revenue estate of Village Changali Jadid, Tehsil & District Ferozepur. No mining was carried out at the site, during visit.
2. The project proponent has earmarked area of mining site with pillars around boundary of the site.
3. The project proponent has provided Weight Bridge at the entry of site.
4. The project proponent has provided movable tanker for sprinkling of water at vehicle movement area to suppress the dust emission generated during movement of vehicles.
It is pertinent to mention here that the Punjab Pollution Control Board vide order dated 193 dated 07.06.2023 has dedicated powers to decide the applications for ‘Consent to Operate’ for mining of sand and other minor mineral projects were delegated to the Environmental Engineers posted at Regional Offices of the Board upto 31.12.2023. Powers delegated to the Environmental Engineers posted at Regional Offices were further extended from time to time and now, the Punjab Pollution Control Board vide order dated 06 dated 07.01.2026, has extended Powers delegated to the Environmental Engineers posted at Regional Offices for period upto 30.06.2026.
In view of the above, it is recommended that ‘Consent to Operate’ under the Air Act, 1981 may be granted to the Public Sand Mining site for the period upto 30.06.2026 for mining of minor minerals (Sand) @ 29557 TPA over an area of 3.29 acre (1.33 hectare) in the revenue estate of Village Changali Jadid, Tehsil & District Ferozepur for operation of mining site, subject to the suitable conditions and specific as under:
1. The Consent to operate is valid for measuring of 3.29 acre (1.33 hectare) in the revenue estate of Village Changali Jadid, Tehsil & District Ferozepur bearing khasra nos. 30//8/2(4-0), 9(8-0), 10/2(3-14), 10/1(3-14), 13/2(4- 0), 14/1(2-0), 30//8/1/2(0-11) for mining of minor minerals (Sand) @ 29557 TPA.
2. The Public Mining Site shall comply with the conditions of mining plan for mining site at Village Changali Jadid, Tehsil & District Ferozepur and shall mining as per mining plan issued by Drainage-cum-mining & Geology Division, Water Resources Department, Punjab.
3. The Public Mining Site shall comply with the conditions of letter issued by State Level Environment Impact Assessment Authority Punjab, Ministry of Environment, Forest & Climate Change, Government of India, O/o Directorate of Environment & Climate Change MGSIPA Complex, Sector 26, Chandigarh-160019.
4. The Public Sand Mining shall comply with terms & conditions of approval letter for approval of mining plan of Minor Mineral of Village Changali Jadid, Tehsil & District Ferozepur vide no. Glg/Pb./M.P./Changali Jadid/1569 dated 29.05.2023 approved by Assistant Geologist, Mines & Geology, Water Resources Department, Punjab, Chandigarh.
5. The mining of minor minerals (sand) shall be carried out only upto a depth of 3 meters as proposed in the approved mining plan.
6. The Public Mining Site shall undertake plantation / afforestation work by planting the native species in the nearby area to mine lease.
7. The Public Mining Site will not discharge any air emissions during mining and transportation of minor minerals. It shall use covered vehicles for transportation of the material and shall regularly maintain the road under use.
8. The Public Mining Site will carry out regular sprinkling of water at vehicle movement area to suppress the dust emissions generated during movement of vehicles.
