• It is submitted the project proponent was earlier granted consent to establish under the Water Act, 1974 and Air Act, 1981 on 16.05.2025 valid up to 15.05.2026 for manufacturing of Non-Torrefied Biomass Pallets @32 Metric Tonnes/Day by using Paddy Straw @32Metric Tonnes/Day and Saw Dust / any other agriculture waste @8Metric Tonnes/Day…………
• After that the industry was granted consent to establish (NOC) for expansion vide no. CTE/Exp/MKS/2025/29101858 on 30.07.2025 valid up to 29.07.2026 for manufacturing of Non-Torrefied Biomass Pallets @ 3.0 TPH by using Paddy Straw @3 TPH and Saw Dust any other agriculture waste @0.80 TPH with change in the plant & machinery along with suitable conditions mentioned therein……………
• Now, the industry has applied for consent to establish under the Water Act, 1974 and Air Act, 1981 for manufacturing of Non-Torrefied Biomass Pallets @ 3.0 TPH by using Paddy Straw @ 3.3 TPH with only change in the raw material through OCMMS on 18.11.2025……….
• The application of project proponent has been examined and it was observed as under:-
1) As per policy of the Board, the industry is allowed to set up at a distance of 100m outside the Municipal Council limits/ phirni of village/ designated residential area /residential area comprising of 15 pucca houses by the Competent Authority of the State. However, the revenue certificate dated 16.01.2025 submitted by the industry is not in order as per policy of the Board. The revenue authority has not mentioned the distance of MC limit, phirni of village, designated residential area and residential area comprising of 15 pucca houses. Moreover, Naib Tehsildar, Lambi has signed the report after one year from receipt of report from concerned Patwari.
2) The project proponent has not deposited any NOC fee alongwith application form.
3) The industry has not mentioned the detail of machinery to which common APCD has been proposed.
4) The industry has not given detail regarding capacity / specifications / dimensional drawing of APCD.
• Accordingly, show cause notice before refusal of 'Consent to Establish' (NOC) under the provisions of Water Act, 1974 and Air Act, 1981 was issued to the industry alongwith an opportunity of personal hearing before the Senior Environmental Engineer (B) of the Board on 05.01.2026, wherein it was decided as under:
1) The reply submitted by the project proponent be forwarded to Regional Office, Sri Muktsar Sahib, immediately.
2) The Environmental Engineer, Regional Office, Sri Muktsar Sahib shall examine the reply and shall submit the report with conclusive recommendations, within 02 days.
3) The application of the project proponent shall be decided after receipt of report from Regional Office, Sri Muktsar Sahib.
• The reply submitted by the industry has been examined by RO and reported as under:-
1. The industry has now submitted amended revenue report dated 24.12.2025, according to which, the site is suitable for establishment of such unit.
2. The PP has deposited Rs. 10,800/- vide online receipt no. 28511884 dated 06.01.2026 as NOC fee.
3. The PP has proposed 3 Thrashers (for shredding) attached with one bag filter house of 36 bags as APCD. The PP has also proposed to install 1 dryer, 1 hammer mill, and 2 pellet mills attached with two APCDs having bag filters of 52 bags each. The proposal regarding APCDs appears principally adequate.
4. The PP has submitted the drawing of the APCDs.
• RO has reported that as per revenue report, site is suitable and the pollution control measure proposed by the industry are principally adequate. RO has recommended for grant of NOC…..
• It is further submitted that the project proponent has already submitted letter bearing no. 114 dated 18.02.2025 of DTP Sri Muktsar Sahib, wherein, it has been mentioned that the site falls under the notified LPA (Local Planning Authority) area, the Master Plan for which is yet to be prepared. While preparing the Master Plan, considering the trends of the surrounding area, there is a possibility that the area under your site will be kept in the Agricultural Zone, in which establishing the said industry is permissible. However, if after the notification of the Master Plan, the said site falls in a Non-conforming Zone, "The applicant shall be liable to abide by the provisions of the Master Plan & shall also be bound to follow the provisions of section 79 along with other provisions of the PRTPD Act, 1955. In case the site falls in a Non-conforming Land use Zone after the notification of the Master Plan, no claim shall be demanded by the applicant from the Department.……….
keeping in view of above and recommendation of RO, if approved, the industry may be granted consent to establish ( NOC) with following special conditions:-
1. The project proponent shall establish the unit in 18 Kanals 04 marla in only those khasra numbers mentioned by DTP, Sri Muktsar Sahib vide letter no. 114 dated 18.02.2025……….
2. The project proponent is bound to comply with all the terms & conditions imposed by DTP, Sri Muktsar Sahib vide letter no. 114 dated 18.02.2025……….
3. The project proponent is bound to comply with the zoning regulations of Master Plan as and when notified……………..
4. PPCB shall not be liable for any loss incurred in case site of the industry falls under non-conforming zone as per notified Master Plan, please………….
5. In case, any of the document submitted by the project proponent found forged or incorrect, the Consent to Establish shall be deemed cancelled and the Board shall not be responsible for any cost incurred by the project proponent in this regard...........
6. The project proponent shall obtain permission from Punjab Water Regulation and Development Authority (PWRDA) for abstraction of ground water and shall comply with the guidelines prescribed by it …………….
7. The project proponent shall install all the pollution control devices proposed at the time of NOC.………….
8. The project proponent shall obtain necessary statutory permission from the other concerned department, as applicable……………
9. The project proponent shall not operate the unit without obtaining consents to operate under the Water Act,1974 and Air Act,1981………..
