It is submitted that earlier, the industry was granted fresh consents to operate under the Water Act, 1974 vide no. CTOW/Fresh/SGR/2021/15109160 dated 10/03/2021 & the Air Act, 1981 vide no. CTOA/Fresh/SGR/2021/15108662 dated 10/03/2021, both valid upto 30/09/2023 for manufacturing of Electrical Control Panels- L.T. Control Panels, P.C.C, M.C.C and APFC Panels @ 100 Number/Year by using MS Sheet @ 53.0 MT/Year, MS Channel @ 2.5 MT/Year, MS Angle @ 2.0 MT/Year, MS Pipe @ 4.0 MT/Year, Copper/Coil @ 10.0 MT/Year, Aluminum @ 20.0 MT/Year, Powder Coating Material @ 1.2 MT/Year & Other Electrical/Hardware Items (As per requirement) @ 100 Number/Year, as raw material, with certain conditions mentioned therein.
Further, the industry has obtained NOC/Consent to Establish (Expansion) vide no. CTE/Exp/SGR/2022/17302622 dated 11.01.2022 valid upto 10.01.2023 for modernization / expansion by installing phosphate process in its existing unit for manufacturing of Electrical Control Panels- L.T. Control Panels, P.C.C, M.C.C and APFC Panels @ 100 Number/Year by using MS Sheet @ 53.0 MT/Year, MS Channel @ 2.5 MT/Year, MS Angle @ 2.0 MT/Year, MS Pipe @ 4.0 MT/Year, Copper/Coil @ 10.0 MT/Year, Aluminum @ 20.0 MT/Year, Powder Coating Material @ 1.2 MT/Year & Other Electrical/Hardware Items (As per requirement) @ 100 Number/Year, Alkaline Degreaser (For Phosphating Section) @ 10 Kg/day, HCL (For Phosphating Section) @ 10 ltr/day & Zinc and Magnesium Phosphate etc. (For Phosphating Section) @ 30 kg/day, as raw material.
Thereafter, the industry has obtained renewal of Consent to Operate under the Water Act, 1974 vide no. CTO/Renewal/SGR/2024/27579272 dated 21.12.2024 valid upto 21.12.2027 and under the Air Act, 1981 vide no. CTO/Renewal/SGR/2024/27445710 dated 21.12.2024 valid upto 21.12.2027 under the auto renewal mode of the Board.
Proposal: -
Now, the industry has applied for varied Consent to Operate under the Water Act, 1974 and the Air Act, 1981 for the same production for which it has obtained NOC (Expansion) i.e. for manufacturing of Electrical Control Panels- L.T. Control Panels, P.C.C, M.C.C & APFC Panels @ 100 by using MS Sheet @ 53.0 MT/Year, MS Channel @ 2.5 MT/Year, MS Angle @ 2.0 MT/Year, MS Pipe @ 4.0 MT/Year, Copper/Coil @ 10.0 MT/Year, Aluminum @ 20.0 MT/Year, Powder Coating Material @ 1.2 MT/Year & Other Electrical/Hardware Items (As per requirement) @ 100 Number/Year, Alkaline Degreaser (For Phosphating Section) @ 10 Kg/day, HCL (For Phosphating Section) @ 10 ltr/day & Zinc and Magnesium Phosphate etc. (For Phosphating Section) @ 30 kg/day, as raw material.
Fee Details:-
The industry had already deposited consent fee amounting to Rs. 50,4000/- vide receipt No. 203526876 dated 21.12.2024 under the Water Act, 1974 & Rs. 50,4000/- vide receipt No. 766100747 dated 21.12.2024 under the Air Act, 1981, under auto renewal mode, against the fixed assets of Rs. 424.31 lacs which is adequate upto 31.03.2025.
The industry has deposited consent fee amounting to Rs. 57,600/- vide UTR no. HDFCN52025111498917074 dated 14.11.2025 under the Water Act, 1974 and Rs. 72,000/- (Rs. 57,600/- as consent fee + Rs. 14,400/- NOC regularization fee) vide UTR no. HDFCN52025111498916195 dated 14.11.2025 under the Air Act, 1981, against the total value of fixed assets amounting to Rs. 424.31 lacs, as per CA certificate dated 28.10.2025.
Hence, the aggregated fee is adequate upto 31.03.2029 under the both acts.
Effluent Details:-
The industry has proposed to consume 0.2 KLD water in its wet surface treatment process (phosphating process) from which, it will generate 0.05 KLD trade effluent, which will be lifted through M/s JBR Tech. Ltd. for further treatment in its ZLD based CETP.
Further, the industry has submitted agreement made M/s J.B.R. Technologies Limited, #2680, Jain Colony, Moti Nagar, Ludhiana for lifting of its trade effluent.
The agreement is valid for 3 years which will be auto-renewed if not cancelled by the member.
Site Plan:-
The industry has submitted approved site plan by the Er. Jasvir Singh, Competent Person approved under Punjab Factory Act.
Visit:-
To verify the facts, the industry was visited by the undersigned on 20.01.2026 and it was observed as under:
1. The industry was in operation.
2. The industry has installed 02 no. powder coating booth equipped without any APCD. The industry has installed 04 no. tanks for wet process in the existing shed. However, the industry has not installed any wet scrubber along with the Phosphating Section to control the fugitive emissions.
3. The industry has installed 01 no. DG set of capacity 20 KVA, equipped with canopy and in-adequate stack height.
4. The industry has provided a collection tank of capacity 10 KL for collection of its trade effluent, which will be further lifted through M/s JBR Tech. Ltd. However, no Electro Magnetic Flow meter has been provided at the outlet of the phosphating section.
5. The industry has provided 30 no. accommodation rooms.
6. The domestic effluent generated and is being discharged onto land for plantation without any pre-treatment facility.
From above, it is clear that the industry is not complying with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981.
Recommendations:-
In view of above, it is recommended that the applications for obtaining Consent to Operate under the Water Act, 1974 and the Air Act, 1981 may be refused and show cause notice for refusal of consent to operate applied under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution Act, 1981 may be issued with an opportunity of personal hearing, please.
