The unit is small scale orange category unit and engaged in sale, service and washing of Four- wheeler vehicles. A telephonic complaint was received in the Regional Office against the agency regarding washing of vehicles at outside of the workshop.
To verify the facts of the complaint the agency was visited by the officer of the Regional Office on 30.10.2025 after approval of the Competent Authority and it was observed as under:
1. The service station was in operation during the visit and engaged in sale and service/washing of four-wheeler vehicle. However, the washing section was not in operation as per its requirements.
2. The representative informed that earlier the agency was only engaged in sale of vehicles and commissioned the servicing /washing section in Septmeber2025.
3. The service station has not provided E T P for treatment of trade effluent generating from washing section. The agency has made provisions to collect the effluent in underground collection tank and same was being disposed of into sewer with temporary motor arrangements. The representative has not shown any permission from the MC, Barnala regarding it.
4. Domestic waste water generated from the washrooms is being directly discharged into public sewer without any treatment.
5. The service station has not made any hazardous waste storage room for storage of hazardous waste of category 5.1 and 5.2. The hazardous waste of category 5.1 was stored in underground tank and 5.2 was stored in open drums in the service area.
6. The representative has failed to show any agreement and record for li5ing of Hazardous Waste to an authorized recycler/facility.
7. The service station has installed 1 no. DG set of capacity 30 KVA with canopy but without adequate stack height.
8. The service station has neither obtained Consent to Establish for establishment and Consent to Operate under Water Act, 1974 & Air Act, 1981 for its operation.
9. The project proponent has not obtained Authorization under Hazardous Waste Management Rules, 2016 of the Board.
The service station is operating its unit without obtaining consents to operate of the Board under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 as well as authorization under the Hazardous & Other Wastes (Management & Transboundary Movement) Rules, 2016.
Accordingly, show cause notice for violations of the provisions of the Water Act, 1974 and the Air Act, 1981 as well as under Hazardous & Other Wastes (Management & Transboundary Movement) Rules, 2016 issued alongwith an opportunity of personal hearing before the Senior Environmental Engineer, Zonal Office-II, Patiala of the Board in his office at Vatavaran Bhawan, Nabha Road, Patiala on 13/11/2025 at 11.00 AM. The representative of the service station attended the hearing and submitted a written reply which was taken on record. He informed that the service station is under construction and not yet operational.
After hearing the officer of the Board and representative of the service station, Senior Environmental Engineer, Zonal Office-II, Patiala decided as under:
1. The service station shall install appropriate E T P of adequate capacity to treat the wastewater generated from the washing of vehicles and also develop adequate planation area for the disposal of treated wastewater onto land for plantation.
2. T h e service station shall obtain permission from the MC, Barnala for the sewer connectivity if unit wants to discharge its treated wastewater into sewer.
3. T h e service station shall execute an agreement with the authorized recyclers/re-processor for lifting of hazardous waste categories generated within the premises.
4. The service station shall provide the water meter on the tubewell, E T P outlet and maintain the record of fresh water consumption and treated wastewater on daily basis.
5. T h e service station shall provide dedicated storage room for storage of hazardous waste categories.
6. T h e service station shall provide the Environmental Data Board near the main gate.
7. The service station shall apply for obtaining consents to operate of the Board under the provisions of the Water Act, 1974 & the Air Act, 1981 as well as authorization under the HoWM Rules, 2016.
8. Environmental Engineer, Regional Office, Barnala shall visit the industry after 20 days, verify the contentions made by the service station during hearing and send the report/ recommendations, accordingly.
9. It was made clear to the project proponent that if any violation under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 shall be observed by the visiting officer in future, action as deemed fit under the provisions of said Acts shall be taken without any further opportunity/ notice.
Now, the project proponent has applied for obtaining CTOs under the Water Act, 1974 and the Air Act, 1981 for operation of an Sale, Servicing and washing of Light Motor Vehicles @ 10 numbers/day vehicles (Mahindra 04 Vehicles). The details of the case are as under:-
The industry has submitted CA certificate showing the value of gross fixed assets of Rs. 103.89 Lakhs as on 19.12.2025. The project proponent has deposited fee of Rs. 50400/- vide UTR No. 821243499 dated 08.01.2026, under Water Act, 1974 and Rs. 42000/- vide UTR No. 562835754 dated 08.01.2026, under Air Act, 1981. which is adequate for a period upto 30.06.2029 under both the Acts after adjusting the NOC regularization fee and penalties under both acts.
The project proponent has submitted rent agreement made on 02.04.2025 which has been made for a period upto 28.02.2040.
The project proponent has submitted approved layout plan signed by Municipal Authorities, Barnala vide dated 04.11.2025
To verify the facts, the site of the project proponent has been visited by the undersigned on 21.01.2026 and it was observed as under:-
1. The unit was in operation. However, the washing section was not in operation during visit…………………………….
2. The industry has installed an ETP treatment of effluent generated from washing section and provision has been to treated effluent is partially reused for washing purpose and partially discharged into MC sewer………….
3. The service station has not submitted permission from the MC, Barnala for the sewer connectivity.
4. The industry has not maintained any record of operation of ETP.
5. The industry is generating hazardous waste of category 35.3- Chemical Sludge from ETP, 35.4- Oil & grease skimmed, 5.1- Used Oil & 5.2- Waste Containing Oil ……………..The industry has not submitted copy of agreement with authorized recycler regarding disposal of hazardous waste of category 5.1 i.e. waste/used Oil………………………..The industry has not submitted copy of agreement for lifting of hazardous waste of category 35.3- Chemical Sludge from ETP & 5.2- Waste Containing Oil & 35.4- Oil & grease skimmed ……………………………………..
6. The industry has not provided hazardous waste storage room for storage of the hazardous waste in the premises. ……………………………….
7. The industry has not maintained record regarding generation/storage/disposal of Hazardous waste hazardous waste of category 35.3- Chemical Sludge from ETP, 35.4- Oil & grease skimmed, 5.1- Used Oil & 5.2- Waste Containing Oil …………………………
8. The industry not is complying with the decisions of personal hearing dated 13.11.2025 as well as with the provisions of the Water Act, 1974, Air Act, 1981 & HOWM Rules, 2016…….
Keeping in view of above, it is recommended that consents to operate applied under the Water Act, 1974 and Air Act, 1981 may be refused pls and action under the provisions of Water Act, 1974, Air Act, 1981 & HOWM Rules, 2016 may be initiated against the industry pls.
