Kindly peruse the note of AEE date 23.01.2026…………
• It is submitted that the project proponent has applied for Consent to Establish (NOC) for establishment of Residential colony namely M/s Sitara Signature Green over an area of 11.64 acres, bearing Khasra Nos. 827/3, 830, 831, 832, 833, 834, 835, 836, 840, 841, 842 situated at Ganganagar road, Area Village Alamgarh, Tehsil Abohar, Distt. Fazilka, comprising 257 plots (231 residential plots, 23 EWS plots and 03 commercial plots) ...............
• The project proponent has submitted a copy of the Letter of Intent (LOI) bearing Memo No. 13/BB dated 07.07.2025 issued by the Competent Authority i.e. Commissioner, Municipal Corporation, Abohar, granting a license for setting up the colony “Sitara Signature Green” bearing Khasra Nos. 827/3, 830, 831, 832, 833, 834, 835, 836, 840, 841, 842 situated at Ganganagar road, Area Village Alamgarh, Tehsil Abohar, Distt. Fazilka. The proposal is as per the layout plan approved by the Competent Authority vide Application No. PB/LOUT/FKA/ABOHA/1044 dated 19.05.2025.....................
• The project proponent has submitted a copy of the layout plan approved by the Competent Authority i.e. Commissioner, Municipal Corporation, Abohar vide No PB/LOUT/FKA/ABOHA/1044 dated 19.05.2025…….
• As per approved layout, total area of 47120.77 sq. m is covered by 257 plots (231 residential plots, 23 EWS plots and 03 commercial plots). Total saleable area (Residential + Commercial + EWS) is 30275.20 sq.m and total non-saleable area is 16785.55 sqm. Hence, considering the max FAR of 2.1, the total built-up area of the project is 63577.92 sq m. which is less than 1,50,000 sq. m, hence it is not covered under provisions of the EIA Notification dated 14.09.2006..............
• It is added that SEIAA Punjab vide letter no 205 dated 15.04.2019 has clarified that the projects with land area less than 50 ha but built-up area more than 20,000 Sqm may be appraised as per provisions of Schedule 8(a) of the EIA Notification2006 as amended from time to time. In this regard, the Board vide letter no. 10949 dated 09.05.2023 has sought a clarification from the Joint Director MoEF&CC, Chandigarh and reply of clarification is awaited…………
• It is further added that total land area of project is less than 50 ha and built-up area is less than 1,50,000 sq.m. Hence, as per MOEF&CC notification dated 29.01.2025, the project is not covered under the ambit of EIA notification 2006 & its subsequent amendments……..
• As per feasibility report submitted by the project proponent, total waste water generation will be 400 KLD. The PP has proposed to install sewage treatment plant (STP) of capacity 500 KLD, which seems adequate…………
• As per proposal of the project proponent, 100 KLD treated effluent will be used in flushing through dual plumbing, 30 KLD will be disposed in plantation/green area (0.587 acres) and remaining 270 KLD treated effluent will be discharged into MC sewer………
• The PP has submitted NOC issued by Municipal Corporation, Abohar vide no. 3794 dated 06.10.2025 for discharge of treated domestic effluent into the MC sewer.......
• The estimated total Solid Waste Generation from the Project will be 2230 kg/day which will be segregated at the source as bio-degradable and non-bio-biodegradable waste as per the SWM rules. The PP has also proposed in-situ remediation of the bio-degradable waste generated from the colony and the non-biodegradable will be handed over to MC Authorities.
• The proposed site of the project was visited by the AEE Harblisterjeet Singh on 19.01.2026 and the following observations were made: -
1. The project site is located near Ganganagar road, Area Village Alamgarh, Tehsil Abohar, Distt. Fazilka falling within the jurisdiction of Municipal Corporation, Abohar. ....................
2. There is no MAH unit within 250 meters of the project boundary. Additionally, no air-polluting industry exists within a 100-meter radius of the site. Similarly, there are no rice shellers or stone crushers within 500 meters and no cement plants, hot mix plants, or brick kilns fall within 300 meters of the project area................
• RO has reported that the project proponent has proposed adequate facilities for the treatment and disposal of domestic effluent and solid waste generated. RO has further reported that the site is suitable for establishment of the residential colony and has recommended for grant of Consent to Establish (NOC)……………………
Keeping in view of above & recommendations of RO, if approved, Consent to Establish (NOC) may be granted to the project proponent from pollution angle for a period of one year for development of Residential colony, subject to suitable conditions and following special conditions that: -
1. The project proponent shall ensure that the total built-up area of the project remains below 1,50,000 sq. m. In case the built-up area exceeds 1,50,000 sq. m or the built-up area of any individual plot exceeds 20,000 sq. m, the project proponent is bound to obtain Environmental Clearance as per the provisions of the EIA Notification dated 14.09.2006…….
2. The project proponent is bound to comply with the decisions of MOEF&CC w.r.t. clarification raised by the Board vide letter no. 10949 dated 09.05.2023………………
3. The Punjab Pollution Control Board is not responsible for any lose if the project covered under the ambient of EIA notification, 2006…………………………
4. Consent to Establish (NOC) is being granted for the development of the residential colony in an area of 11.64 acres in only those khasra numbers for which it has obtained permission from the concerned authority……………………….
5. The project proponent is bound to comply with the zoning regulations of Master Plan as and when notified……………...
6. In case, any of the document submitted by the project proponent found forged or incorrect, the Consent to Establish shall be deemed cancelled and the Board shall not be responsible for any cost incurred by the project proponent in this regard...........
7. The PP will develop the project as area development project and in no case the PP will develop the project as Building construction project by making construction on the individual plots without prior permission from the Board………...
8. The project proponent shall install the STP of adequate capacity as proposed, simultaneously with the commissioning of the project………….
9. The project proponent shall develop adequate plantation within the project premises for the disposal and utilization of treated wastewater, as proposed, before the commissioning of the project………….
10. The project proponent shall utilize maximum treated effluent inside the premises for flushing through double plumbing, construction work, roadside sprinkling etc, and only surplus treated effluent will be discharged into MC sewer leading to terminal STP after getting assessed spare capacity of STP from MC Abohar / PWSSB and after obtaining permission from the concerned authorities……………..
11. It is made clear to the project proponent that in case the STP provided by Municipal Council, Abohar do not have adequate treatment capacity, then the project proponent will make its own arrangement to utilize entire treated wastewater…………………
12. The project proponent shall not use fresh water in the green area/ plantation area and will make adequate arrangements to reuse the treated effluent for watering of green areas in the project premises……………
13. The project proponent shall obtain permission from the Punjab Water Regulation and Development Authority (PWRDA) for abstraction of ground water and shall comply with the guidelines prescribed by it……….
14. It will be sole responsibility of the Project Promoter to provide adequate treatment and disposal of effluent at any stage………..
15. The project proponent will ensure that the municipal solid waste generated from its colony is handled in an environmentally sound manner and the Bio degradable solid waste shall be managed through in-house treatment, in compliance to the Solid Waste Management Rules, 2016…….
16. The project proponent shall also develop the vermi-composting/composting to manage the biodegradable solid waste and shall not throw, burn or bury any solid wastes in open, outside premises or in drain / water bodies…….
17. The project proponent shall perform / promote its Corporate Environment Responsibility (CER) activities as well as use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic……….
18. The project proponent shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises……….
19. This consent to establish is issued from pollution angle and the project proponent shall obtain the statutory clearances / permissions from the other concerned departments, as required…………….
