Sir, form the perusal of previous note, it is submitted that show cause notice for violation of the provision of the Water (Prevention & Control of Pollution) Act, 1974 was issued to the institute alongwith an opportunity to explain your position in person before the worthy Member Secretary of the Board on 08/12/2025.
The representative of the institute has attended the hearing and submitted a written reply, which was taken on record. He informed that the institute has installed a water meter on the outlet of STP on 07.11.2025 and the record of the same is being maintained on regular basis. He further informed that the institute has provided 02 acres land i.e. 01 acre for plantation including eucalyptus & other species of trees planted and 01-acre land reserve for irrigation of agriculture crops, adjoining the premises for disposal of treated waste water. During the no demand period in the fields the treated waste water is used in green area/plantation area.
After hearing the officers of the Board and representative of the institute, the Member Secretary of the Board has decided as under: -
1. The institute shall operate its STP regularly & efficiently so as to achieve the prescribed standard and also maintain the record of treated effluent on daily basis.
2. The institute shall provide adequate land for its utilization of treated effluent onto land for plantation.
3. Environmental Engineer, Regional Office, Barnala shall visit and comment upon the following:
a) To access and adjudge the adequacy of land w.r.t. discharge & utilization of treated effluent and shall send fresh recommendations accordingly.
b) Comment upon the applicability of Environmental Clearance in terms of the notification dated 14.09.2006.
4. The institute shall submit the bank guarantee amounting to Rs. 5.0 lacs within 07 days as an assurance to comply with environmental norms.
To check compliance, the institute was visited by Er. Rajesh Kumar, JEE, on 27.01.2026, and the following observations were made:
1. The educational institute was found to be in operation.
2. The institute has installed a Sewage Treatment Plant (STP) for treatment of effluent; however, the same was not in operation at the time of visit due to less effluent at inlet. Provision has been made for discharge of domestic effluent onto land for plantation/irrigation in the adjoining area measuring about 24 kanals (fresh sampling of eucalyptus tree in 16 Kanals and irrigation land of about 08 Kanals. Provision has also been made to discharge the treated effluent in the green area within the campus.
3. The institute has now installed a water meter at the outlet of the STP and is maintaining records of STP operation. As per records maintained by the project proponent (PP), the institute is discharging approximately 30 KLD of wastewater. The representative of the institute informed that the water demand is low due to the winter season. The plantation/green area available is adequate to handle the wastewater discharge of the institute.
4. As per file records of the earlier application for fresh Consent to Operate (Application No. 4430290 dated 22.08.2016), details of the built-up area were submitted and are attached herewith. It was mentioned in the said application that the institute carried out all construction activities prior to the year 2006. The institute had submitted complete year-wise details of construction activities along with built-up/covered area of each block, duly verified by an architect. As per the details submitted, the entire construction was completed before issuance of the EIA Notification. Further, the representative present during the visit informed that no new construction has been carried out within the existing premises. Hence, the provisions of the said notification are not applicable to the institute. Copies of the noting of the application (Application No. 4430290 dated 22.08.2016) and related details are attached herewith.
5. The institute has submitted a Bank Guarantee (BG) of ₹5,00,000/-, issued by PNB vide No. 344501LG000126 dated 15.01.2026, valid up to 14.01.2027.
It is also mentioned that during the visit to the institute on 06.11.2025, one treated effluent sample was collected from the outlet of the STP and sent to the Head Office laboratory for analysis. As per the analysis report received, the results are as under:
• pH: 8.6
• TSS: 22 mg/l
• TDS: 843 mg/l
• COD: 86 mg/l
• BOD: 25 mg/l
• Oil & Grease: 5 mg/l
All parameters were found to be within the standards prescribed by the Board.
From the above, it is observed that the institute is complying with the provisions of the Water (Prevention and Control of Pollution) Act, 1974, as well as the decisions taken during the personal hearing.
In view of the above, it is recommended that Consent to Operate under the Water Act, 1974 may be granted to the educational institute for running courses such as B.Tech, MCA, B.Ed, Nursing, Pharmacy, etc., up to 30.09.2029, with supersession of the auto-generated CTOs under the Water Act, 1974, subject to the suitable general and special conditions as mentioned in the previous note.
