Discussed with yourgoodself , The report of RO was examined and It is observed that project is a large-scale red category Residential Group Hosing Colony. • Earlier, the project proponent has obtained Environment Clearance under EIA notification dated 14.09.2006 from the SEIAA vide letter no. SEIAA/1828 dated 04.02.2016 for total plot area of 6.475 acers (26203.4 sqm) and total built up area of 84874.5 sqm. Thereafter, the project proponent was granted NOC vide no. CTE/Fresh/JAL/2016/4050351 dated 19/09/2016 valid upto 18/09/2017 for Development of 401 Residential Apartment Complex in the total land area of 6.475 acres (26203.4 sqm) having built-up area 84874.5 sqm alongwith discharged of treated sewage @ 310 KLD with suitable conditions mentioned therein and extended from time to time and lastly it was valid upto 02/09/2025. • The Project Proponent was issued show cause notice for violations of provisions of Water Act, 1974 with opportunity of personal hearing before the Hon’ble Chairperson of the Board on 09.10.2025. After hearing, the Hon’ble Chairperson of the Board decided that: - 1. The project proponent shall comply in letter and spirit with all the conditions stipulated in the Environmental Clearance (EC) granted under the EIA Notification dated 14.09.2006. The PP shall also ensure that the validity of the said EC is extended from the competent authority well before its expiry and shall submit proof of the same to the Board within one month. 2. The project proponent shall ensure proper operation and maintenance of the Sewage Treatment Plant (STP) to achieve the prescribed effluent quality standards at all times, in compliance to the terms and conditions of the EC granted. In case of any deviation from the approved conditions of the EC, the project proponent shall obtain a revised Environmental Clearance from the competent authority and furnish a copy to the Board. 3. The project proponent shall apply for Consent to Operate under the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 with requisite documents and consent fee within 15 days. 4. The project proponent shall not allow any further occupancy or possession of the flats, plots, houses, shops, or any component of the project with immediate effect till compliance with the aforesaid directions is ensured and due approval is obtained from the Board. 5. Directions under Section 33-A of the Water (Prevention & Control of Pollution) Act, 1974 shall be issued to the Revenue Authorities that no fresh sale deed in respect of any plot, flat, house, shop or any other component of this project shall be registered, and suitable provision/patch be made in the Jamabandi portal to restrict such registrations, without prior approval of the Board. 6. Directions under Section 33-A of the Water (Prevention and Control of Pollution) Act, 1974 be issued to the Punjab State Power Corporation Limited (PSPCL) not to release any new electricity connection for any flat, plot, house, shop, or other component of this project with immediate effect. 7. The Jalandhar Development Authority (JDA) shall be directed not to grant or approve any further building plans pertaining to any component (plot, flat, house, or shop) of this project without the prior approval of the Board. 8. The project proponent shall submit a Bank Guarantee of ₹10,00,000 (Rupees Ten Lakh only) within 15 days as an assurance that it will apply consents under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 and operate its STP for the treatment of domestic effluent effectively to achieve the prescribed standards and the same will be utilized as per the Environmental Clearance granted to it. • Thereafter, the directions u/s 33-A of the Water Act, 1974 were issued to M/s Hamilton Land Developers, Mayfair, Jalandhar and directions were also issued to PSPCL for not to release any new electricity connection for any flat, Plot, house, shop or other component of this project with immediate effect vide letter no. 4787 dated 14.11.2025. • The directions u/s 33-A of the Water Act, 1974 were issued to M/s Hamilton Land Developers, Mayfair, Jalandhar and directions were also issued to JDA, Jalandhar for not to grant or approve any further building plans pertaining to any component (plot, flat, house, or shop) of this project without the prior approval of the Board vide letter no. 4805 dated 17.11.2025. • The directions u/s 33-A of the Water Act, 1974 were issued to M/s Hamilton Land Developers, Mayfair, Jalandhar and directions were also issued to The Sub-Registrar-Cum-Tehsildar that the revenue Authorities are directed to not register any fresh sale deed related to any plot/flat/house/shop/ any other component of this project with immediate effect and suitable provision/ patch be made in the jamabandi portal to restrict the registration of the plot, flat, house, shop or any other component of this project vide letter no. 4808 dated 17.11.2025. • The Project Proponent has submitted the Bank Guarantee of Rs. 10,00,000/- vide BG No. 35130ILG001326 which is valid upto 06.07.2026 and has submitted a letter in this office containing details regarding having not allowed any further occupancy of the flats until the due approval is obtained from the Board. The details of the apartment submitted by the Project Proponent is as under :- Total no. of flats - 323, sold out – 140, Occupied – 100, Balance Flats (Under Construction and Finishing) – 183. • Now, the project proponent has applied for Partial Consent to Operate under the Water (Prevention and Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 through OCMMS of the Board with requisite documents. • The Project Proponent has deposited Rs. 84000/- Vide UTR/Receipt No. 001409724214 Dated 15.05.2024, Rs. 84000/- Vide UTR/Receipt No. 001872621129 Dated 01.02.2025, Rs. 372000/- Vide UTR/Receipt No. 196951826 Dated 17.10.2025, 168000/- Vide UTR/Receipt No. 928426897 Dated 02.12.2025 and 300000/- Vide UTR/Receipt No. 681151992 Dated 20.01.2025 under Water Act, 1974 and Rs. 666000/- Vide UTR/Receipt No. 781163443 Dated 02.12.2025 and 378000/- Vide UTR/Receipt No. 410905022 Dated 20.01.2025 under Air Act, 1981. CTO fee is valid upto 31.03.2027 under the both Acts including Penalty and Balance Fee. • The project proponent has submitted completion certificate of STP of capacity 100 KLD. • The project proponent has submitted NOC regarding disposal of sewage treated waste water into MC sewer vide Memo no. 412/SE/O&M dated 25.08.2015 from Municipal Corporation, Jalandhar. • The project site was visited by Er. Jatinder Soni, EE and Er. Rajinder Singh, AEE and it was observed as under:- 1. There are total 6 towers in the premises of this group housing project. Out of six towers, three towers have been fully constructed and about 100 families are residing in these three towers. Civil construction work of fourth tower has been completed. Civil construction work of fifth and sixth tower is undergoing during the visit. 2. The Project Proponent has provided STP of capacity 100 KLD for treatment of domestic effluent which was in operation during visit. The treated sewage samples were also collected from the final outlet of STP and sent to Board’s Lab for analysis. As per analysis report the concentration of parameters are within the limit as prescribed by the Board. The arrangement provided earlier for discharging of untreated sewage directly into sewer has been removed and no any other arrangement or illegal discharge of untreated sewage was observed during the visit. 3. The treated sewage is partially being discharged onto 1.54 acre of green area land for plantation/Green Area/Parks within the premises & remaining is being discharged into sewer. 4. The project proponent also informed that Construction of tanks at the top of tower is underway for flushing purpose. Due to low occupancy in towers, lower quantity of effluent is being generated which is used for construction purpose, onto land for plantation and remaining discharged into sewer. 5. The project proponent also informed that the number of flats in the project is proposed to be reduced, and to obtain revised EC cum NOC the Project proponent has applied through Parivesh Portal. Copy of the screenshot of Parivesh Portal is attached herewith. 6. The Project Proponent has installed two D.G sets of capacity 1500 KVA with canopy and adequate stack height. 7. The Project proponent now has provided a designated spot under the operational towers for collection and segregation of solid waste from where it is being lifted/collected by MC, Jalandhar. 8. The Solid Waste disposes through MC, Jalandhar and the Project proponent has made agreement with JIFT vide its No. JIFT/HLD/001/SEPT-15 for collection of garbage from the project site.
In view of above and based on report/recommendations of EE,RO , it is being the case of restoration of directions may if approved the Partial consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted for six months for 100 flats with suitable conditions and special conditions that: - 1. The project proponent will comply with the all the conditions of the Environmental Clearance granted from SEIAA, Punjab vide no. SEIAA/1828 dated 04.02.2016. 2. As stated in EC, the project proponent will start dual plumbing system to use treated wastewater for flushing purpose within two months. 3. The project proponent will halt construction work on the project until the revised/extended EC is obtained. 4. The project proponent shall start carrying out complete water auditing of the project on daily basis, immediately, so that the quantity of freshwater consumed and treated effluent utilised for activities like irrigation, dual plumbing, construction purpose can be assessed. 5. The project proponent will comply with the provisions of Solid Waste Management Rules, 2016. (Competency - Hon'ble Chairperson of the Board) |
