It is intimated that earlier the unit was visited by Er. Sukhwant Singh, AEE on 20/06/2023 and observed that the industry has provided a batching plant for manufacturing of spun pipes and was operating without CTO/CTE of the Board.
Accordingly, the unit was issued show cause notice under the provisions of the said acts to explain its position within 15 days, the industry has failed to submit any reply. Thereafter, the industry was given personal hearing multiple times at Zonal Office level, but no one from the attended the said hearing.
Thereafter, the industry was given personal hearing before the Chief Environmental Engineer, Jalandhar on 04/09/2025, but the industry has neither attended the said hearing nor submitted any reply. Accordingly, the competent authority had issued directions u/s 33-A of the Water (Prevention & Control of Pollution) Act 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 for closure of the unit. Further, the PSPCL authorities were directed to disconnect the electric connection of the industry and Regional Office, Batala has been directed to seal the plant & machinery of the industry.
Accordingly, the PSPCL authorities have issued the TDCO no.100030228929 dated 10/10/2025 in compliance of the same. The batching plant of the idnsurty has also been sealed in the presence of representative of the unit.
Now, the industry has applied for obtaining fresh consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 through OCMMS in a totally paperless manner by uploading necessary documents as PDF under green category.
The industry has deposited Rs. 45,300/- vide UTR No. 795573087 dated 22/01/2026 & Rs. 51,200/- vide UTR No. 300004348 dated 22/01/2026 under Air Act, 1981dated 03/03/2023 as consent to operate fee under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 including Rs. 6400/- as NOC Regularization fee and Rs. 500/- as Form Downloading fee against total gross value of fixed assets worth Rs. 1,73,30,20/- as on 31/12/2025 and same are adequate upto 31/03/2027 under both Acts.
Now, the industry was visited by the Er. Maninderjit Singh Kaler, AEE on 14/01/2026 and observed as under:-
1. The industry is engaged in manufacturing of spun pipes and was not in operation during visit. However, electric connection has not yet been disconnected.
2. The industry has installed one no. batching plant for the manufacturing of spun pipes. The representative informed that they are not engaged in commercial use of RMC.
3. The industry has also provided water tanks for curing purpose of the pipes.
4. The batching is provided in the covered area. Further, the industry is using cement manually in the batching plant. The bags of cement have been stored under the covered area.
5. The industry has provided boundary wall around the premises.
6. The industry has provided brick paved movement area inside the premises, however, the area around the RMC plant is not brick paved, but the industry has provided flexible pipe with water supply for stabilization of movement area around the batching plant to avoid dust emissions. The industry has also provided a settling pit for collection of effluent generated from washing of mixtures and equipment’s. The effluent is also used for the stabilization of movement area.
7. The site of the industry falls in designated Industrial Zone i.e. Industrial Growth Centre, Pathankot. The industry has submitted allotment letter from the PSIEC vide No. PSIEC/ESTATE/1660 dated 29/05/2014 & No. PSIEC/ESTATE 2361 dated 07/09/2015.
8. The industry has installed one no. D.G. set of capacity 125 KVA, which is provided with canopy.
It is pertinent to mention here that although the industry has allotted plot by the PSIEC in year 2014, but the earlier process of the industry falls under white category with category code 4100 as per previous categorization. The industry has installed batching plant in year-2023. The industry has submitted invoice of the same. Thus the date of commissioning of the industry is Feb-2023.
The project proponent has submitted Approved Building Plan from the PSIEC.
The project falls in Green category in small scale sector, hence competency to decide the case lies with the Environmental Engineer of the Board and competency to issue directions lies with, Chief Environmental Engineer, Jalandhar with concurrence of worthy Chairperson of the Board (Agenda Note is also attached herewith).
In view of above, it is recommended as under:-
a) The consent to operate under Water (Prevention& control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be granted for six months period subject to the suitable condition that the industry shall brick paved the movement area around the batching plant.
b) Directions u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981 may be issued as under: -
1. PSPCL Authorities may be directed to restore electric connection of the unit temporarily for six months period.
2. The plant & machinery of the industry shall be de-sealed.
