Subject: Application for obtaining Consent to Establish"(NOC) for Expansion of an existing industrial unit u/s 25 of Water (Prevention & Control of Pollution) Act, 1974 and u/s 21 of Air (Prevention & Control of Pollution) Act, 1981 – M/s Arvin Rice Mills (Earlier known as K.K. Industries), Channa Mehon Road, Devigarh, Tehsil and Distt. Patiala.

It is submitted that the industry was granted consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 vide no. CTOW/Renewal/PTA/2022/18302766 dated 30/03/2022 and under the Air (Prevention and Control of Pollution) Act, 1981 vide no. CTOA/Renewal/PTA/2022/18302754 dated 30/03/2022, both are valid upto 30/09/2030 for manufacturing of Rice @ 2.0 T/Hour by processing of Paddy @ 3.0 T/Hour (without drier) and discharge of domestic effluent @ 0.5 KLD onto land for Plantation after treated in septic tank under orange category subject to conditions mentioned therein.
Now, the industry has applied for obtaining 'consent to establish' (NOC) from pollution angle, for expansion within its existing unit for manufacturing of Rice @ 2.0 T/Hour to 3 T/hour by using Paddy @ 3.0 T/Hour to 4.5 T/hour (with drier of capacity 24 T/batch) as raw material and discharge of domestic effluent @ 1.6 KLD onto land for plantation after passing through septic tank under green category along with requisite documents.
The industry has deposited Rs. 1400/- vide R. No. 414112528 dated 15.01.2026 on account of NOC expansion fee against the proposed project cost of Rs. 15 lakh as per the project report, which is adequate for one year.
The details regarding distances of various siting parameters w.r.t the proposed site where rice sheller is to be established is given by the Tehsildar Patiala (copy attached).
The industry has now proposed to install mechanical dryer provided with cyclone separator as APCD along with its rice shelling unit to be installed with individual cyclone separator as APCD with both and with separate adequate stack height. It has been come into the notice of this office that all the rice sheller units in Punjab have been granted NOC/ consent to operate with cyclone as APCD. There is no Circular/ Notification issued by the Board regarding revised standards/ up-gradation/ modification of the old APCD.
The industry has submitted compliance report of consent conditions earlier granted to it under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981
Accordingly, the industry was visited by the undersigned on 29.01.2026 and observed as under: -
1. The industry was in operation. The industry has not started any construction of drier installation.
2. The industry has already installed submersible pump as source of fresh water supply.
3. The industry has provided septic tank for the treatment of domestic effluent generated from its premises.
4. All the dust emitting points were found connected with the I.D. fan of the APCD.
5. The industry has provided cyclone separator as APCD with the shelling section with adequate stack height.
6. The industry has provided paved / brick roads inside their premises for movement of vehicles, so as to prevent the generation of dust.
7. The industry has proposed expansion within existing unit and there is no increase land area. The industry is complying with the conditions new code of practice notified by Govt. Notification no. 10/48/2004-STE (4) /932 dated. 15/10/2013 and conditions of consents granted to it under said acts. It is pertinent to mention here that as per Govt. of Punjab, D.S.T.E 10/48/2004-STE (4) /932 dated. 15/10/2013.
As the industry submitted certificate from Tehsildar Patiala dated 09.12.2025 in which it is mentioned that the unit falls outside the M.C. limits of Patiala. Therefore, the site is suitable for expansion/modernization as per the policy of the Board.
Keeping above in view, it is recommended that Consent to Establish"(NOC) for Expansion of an existing industrial unit u/s 25 of Water (Prevention & Control of Pollution) Act, 1974 and u/s 21 of Air (Prevention & Control of Pollution) Act, 1981 granted for one year for manufacturing of Rice @ 3.0 T/Hour by processing of Paddy @ 4.5 T/Hour (With Drier 24 MT) under green category subject to certain condition and following additional conditions that:
i) The industry shall comply with the code of practice notified by Govt. Notification no. 10/48/2004-STE (4) /932 dated 15/10/2013 in true letter and spirit.
ii) The industry shall obtain varied consent to operate under the provisions of Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 before installing paddy drier.
iii) The industry shall install APCD as proposed in the feasibility report submitted by the industry along with the application.
iv) The industry will submit revised building plan prepared and duly authenticated by the Director of Factories/ Chartered Architect/ Chartered Engineer under the provisions of section 3-A of Punjab Factory Rules, 1952.
v) The industry shall put in place all the hoods, ducting's & enclosures and other components of the APCD well before commissioning of the unit for next paddy shelling season and report the compliance in the regard to the Board.
vi) The industry is advised to obtain necessary clearance for abstraction of ground water from Punjab Water Regulation and Development Authority (PWRDA).
vii) The industry shall comply with the stack emissions standards as laid down by the Board and as amended from time to time by the Board/MoEF.
viii) The industry shall upgrade/ replace its APCD as per policy of the Board at any stage.
ix) The industry shall give area earmarked for disposal of ash generated from the boiler at the time of varied consent to operate for expansion/ modernization.
x) The industry will shift to designated zone within the stipulated time or any amendment in the timeline as per the policy of the Govt.
xi) The industry shall inform the Board in writing as and when any change is occurred in the Partnership Deed / Proprietorship / Memorandum of Article of Association, especially with regard to the name and address of the Partner / Proprietor / Director / Subscriber etc, and in any case the industry fails to do so and later on it comes to the notice of the Board that there is any change in Partnership Deed / Proprietorship / Memorandum of Article of Association, action as deem fit under the provision of said Act shall be taken. |
