File Note: In this regard, it is submitted that the subject cited has proposed to establish a small scale category red unit and has applied for obtaining Consent to Establish / NOC under the provisions of the under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for Washing or Dyeing of Fabrics Cloth/Pc/Polyester/Knitted Fabric etc. @ 10.4 TPD along with discharge of trade effluent @ 449 KLD & domestic effluent @ 01 KLD into conveyance system of CETP 50 MLD along with operation of one boiler of capacity 06 TPH with multi cyclone separator followed by wet scrubber as APCD. Earlier, the industry had applied for obtaining Consent to Establish / NOC under the provisions of the under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 in the name and style of M/ Aarti Scientific Dyers, which was refused by the Board on 20.12.2022 solely on the ground that the CETP shares were required to be dematerialised mentioning the comments reproduced below:- “The matter was considered by the Competent Authority and it is directed to submit share allotment certificate duly signed by the Chairman, Directors and Company Secretary of CETP 50 MLD ’’. Accordingly, the unit started the process for dematerialization of 450 shares purchased from Sh. Manoj Makkar and Sh. Ashok Makkar. However, the dematerialization of the shares took a long time. Eventually, these shares were dematerialized in two phases i.e. on 09.05.2024 & 28.01.2025 in the name of Mr. Pankaj Jindal. Thereafter, successful dematerialization of shares in the name of Mr. Pankaj Jindal, the industry has submitted new application for obtaining Consent to Establish / NOC under the provisions of the under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 in the name and style of M/s Aakash Dyeing and Finishing House, but the same application was returned with the observation per the last hearing given to the SPV on 06.05.2025 by the Competent Authority of the Board, it has been decided that no new NOC or NOC for expansion or varied consent to operate for increase in the discharge of trade effluent shall be granted to the member units connected with the CETP Meanwhile, the industry has file an Appeal before the Appellate Authority Constituted under Section 28 of the Water (Prevention & Control of Pollution) Act, 1974 read with Section 25/26 of the Water Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. The appeal was heard on 15.12.2025 and wherein it was decided as under:- Accordingly, the project proponent has submitted fresh application for obtaining Consent to Establish / NOC under the provisions of the under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 in the name and style of M/s Aakash Dyeing and Finishing House for Washing or Dyeing of Fabrics Cloth/Pc/Polyester/Knitted Fabric etc. @ 10.4 TPD along with discharge of trade effluent @ 449 KLD & domestic effluent @ 01 KLD into conveyance system of CETP 50 MLD along with operation of one boiler of capacity 06 TPH with multi cyclone separator followed by wet scrubber as APCD. The industry has submitted copy of letter issued vide no. 641/ATP-B/D dated 27.01.2026 by Municipal Corporation Ludhiana for land measuring 2740 Sq.Yards as per which site falls in the industrial Zone of approved Master Plan of Ludhiana. The industry has submitted feasibility report of the Boiler of capacity 06 TPH steam generation capacity and Thermopack of capacity 1500 U or 150000 Kcal/hr. The industry has proposed to use rice husk/wood /argo waste as fuel in both. Further, the industry has proposed to install individual multi cyclone separator followed by the Common wet scrubber to be installed as APCD along with the new boiler of capacity 06 TPH and Thermopack of 1500U or 150000Kcl/hr. The industry has also proposed to install 02 DG sets of capacity 125 and 500 KVA equipped with canopy and adequate stack height. The industry has deposited Rs. 14900/- vide online receipt no. 814803116 dated 09.04.2025 which is adequate for One year. The industry was visited by the Er. Simarpreet Singh, AEE on 27/01/2026 and contacted Sh. Pankaj Jindal, Proprietor at site. During visit, it was observed as under: 1. The site of the industry is located in the Mahavir Jain colony, Tajpur Road, Opp central Jail, Ludhiana. 2. The industry has proposed to install 10 soft flow machines of capacities (2 x 600 Kg, 2 x 450 Kg, 03 x 300 Kg, 02x 150 Kg & 01x 100 Kg) having total 23 chambers/mouths in its premises. As per GNE calculation, total effluent generation from the industry would be maximum to the tune of 460 KLD. 3. The industry has submitted DEMAT certificate of 450 shares to discharge 450 KLD effluent into the conveyance system of CETP 50 MLD, Tajpur Road, Ludhiana. The industry has also proposed to provide the flow meter at its final outlet leading to CETP and is connected to SCADA system. 4. The industry has proposed to provide flow meters at both the borewells provided for ground water extraction. 5. The industry has started the process of installation of the boiler of capacity @ 6.0 TPH based on ricehusk/wood/agro waste. The industry has also proposed to install Thermopac of capacity 1500U or 150000Kcal/hr but has not started installation of the same. 6. The industry has proposed to install individual multi cyclone separator followed by the Common wet scrubber to be installed as APCD along with the new boiler of capacity 06 TPH and Thermopack of 1500U or 150000Kcl/hr. 7. The industry has proposed to install 02 DG sets of capacity 125 and 500 KVA equipped with canopy and adequate stack height. From the above-mentioned facts and decision given by the Appellate Authority and the land classification submitted by industry the site is suitable for establishment of dyeing unit. In view of above, it is recommended that Consent to Establish / NOC for expansion under the Water (Prevention & Control of Pollution) Act 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry for installation of new boiler of capacity 06 TPH using agro based fuel / pet coke as fuel with multi cyclone separator followed by wet scrubber as APCD with replacement of old boiler of capacity 04 TPH.
