File Note: From the perusal of pervious note, show cause notice for refusal of consent to operate granted under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 issued to the industry alongwith an opportunity of personal hearing before the Senior Environmental Engineer, Zonal Office-ll, Patiala of the Board in his office at Vatavaran Bhawan, Nabha Road, Patiala on 12/01/2026. However, the industry has failed to attend the personal hearing on the said date. The matter has been considered by the Competent Authority and it has been decided to give another opportunity of hearing before the Senior Environmental Engineer, Zonal Office-ll, Patiala on 22.01.2026. The representative of the industry failed to attend the hearing. However, a written reply to the show cause notice issued to the industry was submitted at the Regional Office, Barnala, on 20.01.2026, which was taken on record. In the written reply, it was mentioned that the industry has removed all the discrepancies earlier observed by the visiting officer. He further stated that water sprinklers have been provided to suppress dust emissions generated from the vehicle movement area and that plantation has been carried out along the boundary wall for discharge of the treated effluent. After hearing the officer of the Board and considering material facts on record, Senior Environmental Engineer, Zonal Office-Il, Patiala decided as under: - 1. Environmental Engineer, Regional Office, Barnala shall visit the industry, verify the contentions made by the industry in the written reply and send the report/ recommendations immediately. 2. Further action shall be taken to decide the consent application after the receipt of report from the Regional Office. To verify the compliance, the industry was visited by Er. Manmohit Kumar, AEE on 29.01.2026 and it was observed as under:- 1. The Hot Mix Plant was not in operation during the visit as per its requirements. 2. The project proponent has stored raw material in the premises and the representative informed that due to non-allotment of work, the HMP is not being operated in the past days. 3. The Hot Mix Plant has installed dust collector followed by wet scrubber with water re-circulation system as APCD to contain the process emission. 4. The Hot Mix Plant has now made arrangement by providing flexible pipe for sprinkling of water to suppress the dust emissions generated during vehicular movement. The representative informed that they are now regularly sprinkling water 2 times a day. 5. The Hot Mix Plant has constructed septic tank for treatment of its domestic effluent but has now made any provision to discharge the treated effluent onto land for plantation. 6. The hot mix plant has developed fresh sampling of tree along the boundary, which is adequate. From the above, the industry now complying with the provisions of Water Act, 1974 & Air Act, 1981 as well as decisions of personal hearing. Keeping in the view of above, it is recommended that consent to operate under the provisions of Water Act, 1974 & Air Act, 1981 may be granted to industry for operation of hot mix plant to manufacture Hot Mix @ 170 TPH for a period upto 30.09.2026 (upto the validity of consent fee), subject to suitable conditions and specific conditions as under:- 1. The Hot Mix Plant will submit its operational schedule to the regional office of the Board, within a period of one month, so as to carry out its air emission sampling. 2. The Hot Mix Plant will comply with all its code of practice every time. 3. The Hot Mix Plant is bound to submit extended lease deed of land area of the plant 01 month before expiry of the same in the Board. 4. The Hot Mix Plant shall ensure that no air pollution problem /public nuisance odour problem is created in the area due to the discharge of emission from hot mix plant. 5. The adequacy and efficacy of the Air Pollution Control Devices will be the entire responsibility of the industry. 6. The Hot Mix Plant will not emit black smoke under any circumstance. 7. The Hot Mix Plant shall ensure that the concentration of the suspended particulate matter in the emissions does not exceed limits prescribed by the Board for such type of industries. 8. The Hot Mix Plant shall use only HSD for burning purpose in the bitumen heaters and the DG set and shall not use any other fuel for burning purposed without the prior written permission of the Board.
