It is intimated that the project proponent has granted for consent to establish (NOC) under the Water Act 1974 & Air Act 1981 vide no. CTE/Fresh/HSP/2024/26228379 dated 07.09.2024 valid upto 06.09.2025 for the establishment of industry for manufacturing of Stearic Flakes @ 100 Metric Tonnes/Day, Crude Glycerin @ 10 Metric Tonnes/Day with condition following:
1) The industry shall not carry out any activity which is covered under first schedule of Factory Act, 1948 & activity covered under EIA notification 14.9.2006.
2) The consent to Establish/NOC is under orange category and industry shall manufacture only stearin flakes and crude glycerine and shall not carryout any distillation process.
3) The industry shall obtain consent to establish (NOC) from the Drainage Department before start of construction of the proposal.
4) The industry shall develop adequate plantation area as per Karnal Technology for utilization of treated trade effluent and domestic effluent.
5) The industry shall provide adequate APCD to contains the concentration of various pollutants, if any, to be generated from the process emission.
6) The industry shall obtain NOC from Department of Water Resource as per their notification no. 315 dated 18.9.2023 before start of the construction activity at proposed site
Now the project proponent has applied for extension of consent to establish (NOC) under the Water Act 1974 & Air Act 1981 for manufacturing of Stearic Flakes @ 100 Metric Tonnes/Day, Crude Glycerin @ 10 Metric Tonnes/Day.
The Project Proponent has submitted compliance of the earlier granted Consent to establish (NOC) Under Water Act, 1974 and Air Act, 1981, Request letter for extension. The previous application of the industry for extension in NOC was returned due to non submission of NOC by the Department of Drainage Department (close proximity to Kandi canal) and documentary proof regarding permission from Department from Water Resources/PWRDA.
The Project Proponent has deposited Rs.56400/- vide R.no. 68419863 dated 30.12.2025, which is adequate for the two years.
The industry has submitted a reply to the special conditions of the NOC granted to it, wherein it has stated that they don’t require NOC from Drainage Department in non compliance of the special condition due to the close proximity to Kandi canal. Also, the industry has stated that they are in line of obtaining NOC from PWRDA, however, has not attached any documentary proof in spite of observations raised in the previously returned application.
The site was visited by the AEE of this office on 29.01.2026 however, the site could not be traced due to non presence of any representative of the unit and in correct location shared. Thereafter, the site was again visited on 30.01.2026 & the industry has started construction process i.e. foundation of pillars is being carried out and has also provided boundary wall of the project.
From above, it is clear that the industry has failed to comply with the previous NOC conditions and has already started the construction process without obtaining NOC from the Drainage Department.
In view of the above, it is recommended that Show Cause Notice for refusal of extension in consent to establish (NOC) under the provisions of the Water Act, 1974 and Air Act, 1981 may be issued alongwith the opportunity of personal hearing.
Competency Large Orange : Chief Environmental Engineer being special condition imposed that the industry shall manufacture only stearin flakes and crude glycerine and shall not carry any distillation process.
