File Note: In ref. to the report of RO, it is brought out that: # The project was given personal hearing before the Member Secretary of the Board on 02.02.2026 and during hearing it was observed as under: 1) Environmental Engineer, Regional Office, SAS Nagar shall visit the project, verify the submissions of the representative of the project proponent made during the hearing, decisions of the hearing dated 23.09.2025 and process the consent applications applied by the project proponent on merits and send the report/ recommendations immediately within 7 days. 2) Further action in the matter shall be taken after receipt of report from the Regional Office. ------------------ # The project was visited by the officer of RO to verify the compliance on 17.02.2026 and during visit it was observed as under: 1. The above site is a group housing project. 152 no. flats have been constructed in 5 towers (Category A & B). 16 no. apartments have been constructed in category C (EWS) and is being run by RWA. 2. The STP was in operation during visit, treated wastewater was being discharged onto green area and MC sewer. 3. The project proponent has provided water meter on the line of ground water abstraction and now maintain the record of the same. The project proponent has installed water meter installed at the inlet of STP and outlet of the STP. The project has maintained record of outlet. Month Borewell Inlet STP Outlet STP January 266 69 25.6 Feb (till 24.02.2026) 209.7 47.6 26 From the above record, the water consumption in the month of January & February around 22-25% waste water has been generated which is in general in the range of 70-80 %. From the record maintained during the period 01.01.2026 to 24.02.2026 the inlet volume is 116.6 KL and outlet volume is 51.6 KL. It is clear from the record maintained that either record is not being maintained properly or wastewater is being bypassed from the STP and being discharged through outlet of STP. 4. The RWA has not provided mechanical composter for the treatment of wet biodegradable solid waste. Only 2 pits have been constructed for the treatment of wet waste adjoining the sludge beds of STP. The pits do not serve the purpose of aerobic decomposition as three insufficient passages of air to the pits. Moreover, the pits constructed for the colony is inadequate considering the persons residing the colony. 5. The RWA has provided canopy and adequate stack height with two DG sets. ------------------------- # The RO has concluded that the RWA is violating the provisions of Water (Prevention & control of Pollution) Act, 1974 and Solid Waste Management Rules, 2016 and recommended that the Consent to operate under the Water (Prevention & control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be refused. -------------------- It is pertinent to highlight here that the project is found violating the provisions of the Solid Waste Management Rules, 2016, particularly with respect to on-site waste segregation, treatment, and authorized disposal mechanisms; and improper handling of solid waste under the SWM Rules, 2016 can lead to environmental degradation, including air pollution. ----------------------- In consideration of the report/ recommendations of RO; if approved, the competent authority be recommended that the applications of the project proponent/ RWA for renewal of Consents to Operate under the Water Act, 1974 & the Air Act, 1981 be refused without affording any further opportunity of personal hearing to it. ------------------------ Comp.: Worthy MS of the Board
