The report/ recommendations of RO in the matter has been examined and it was noted as under:

# Earlier the project proponent was granted consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2020/13804579 dated 27.10.2020 which was valid upto 26.10.2021 for development of Residential project flats @ 492 nos. and shops @17 nos. and subsequently extended upto 26/10/2025, subject to certain conditions as mentioned therein.

# Thereafter, the project proponent was granted Consent to Operate (CTO) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 dated 20/01/2025 both were valid upto 30/06/2025, for development of Flats @ 367 and Shops 17 with disposal arrangement that domestic effluent 200.0 KLD - After treatment in STP of Capacity 400 KLD, treated domestic wastewater @ 83 KLD will be used for flushing, 26 KLD will be discharged onto land for plantation/ green area and remaining 91 KLD will be discharged into sewer subject to certain terms and conditions as mentioned therein.

#The project proponent has earlier obtained Environmental Clearance from State Level Environment Impact Assessment Authority vide no. DECC/SEIAA/2020/3380 dated 05.11.2020 for establishment of the Group Housing Project namely “Nirwana Heights” at Village Khanpur, Kharar, District SAS Nagar (Punjab) by M/s East Avenue Infracon (P) Ltd. As per Environmental Clearance granted by Competent Authority, the total land area measuring 27016 sqm having built up area 59379 sqm and the project consists of 492 flats and 17 shops.

# Now, the project proponent has applied for varied Consent to Operate (CTO) under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for development of Residential project flats @492 nos. and shops @17 nos., with requisite documents.
------------
#The RO has calculated that the consent fee deposited by the project proponent is adequate upto 31.07.2028, under both the Acts after adjusting the late and penalty fees.

# A clarification was raised on the application of the project proponent. The project proponent has submitted the reply of the same which is as under:
Clarification: The six-monthly compliance report of EC submitted by the PP, there was additional condition at no.3 that “Chute system, separate wet & dry bins at ground for common areas for facilitating segregation of waste, collection centre and mechanical composter (with minimum capacity of 0.3kg/tenement/day) shall be provided for proper collection, handling, storage, segregation, treatment and disposal of solid waste.” However, in the compliancereport, the PP has just mentioned that no chute system will be provided and only mechanical composter will be provided. This needs to be clarified as the application was previously also refused with the observation that compliance to EC additional conditions needs to be assured.
Reply: Sir, Chute system is not feasible because when the bags throw in chute after segregation then bags are ripped off and waste not reaching at the bin as segregation. For biodegradable waste we have provided mechanical composter and non- biodegradable waste will be sold to approved vendors.

# The project proponent has submitted permission granted by Municipal Council Kharar vide no. 521 and 522 dated 12.03.2020 for the discharge/disposal of treated sewage and solid waste, respectively by the firm. The project proponent has submitted approved site plan by Competent Authority.

# At the time of NOC, the project proponent had submitted the CLU of Competent Authority – Regional Deputy Director Cum Competent Authority, Urban Local Bodies Patiala vide no. CLU/DDLG/PTL/2019/3326 dated 24.02.2020 under the name and style of M/s East Avenue Infracon P. Ltd for the development of group housing project namely Nirwana Heights.

# The industry has submitted analysis report of the effluent samples got analyzed by M/s Eko Pro Engineers Pvt. Ltd. on 13.06.2025, which is not NABL approved laboratory. The conc. of the parameters was found within the permissible limits of the Board as under:
pH – 7.26 (Prescribed Limit as per CPCB guidelines – 5.5-9.0)
TDS mg/l – 1185 (Prescribed Limit as per CPCB guidelines – not specified) TSS mg/l – 46.0 (Prescribed Limit as per CPCB guidelines – 100)
COD mg/l – 82.5 (Prescribed Limit as per CPCB guidelines – 250) BOD mg/l – 20 (Prescribed Limit as per CPCB guidelines – 30)
O&G mg/l – BLQ (LOQ-4.0) (Prescribed Limit as per CPCB guidelines – 10)

# The project proponent has submitted compliance report of the previous granted Consent to Operate (CTO) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 as well as Environmental Clearance granted by the Competent Authority.
------------
# The site of the project proponent was visited by the officer of RO on 09.02.2026 and observed as under:The project proponent has developed housing project (high rise) consisting of 492 flats and 17 shops.
1. There are total 16 no. of towers (Block A-7, Block B -3, Block C – 5, Block D – 1).
2. Presently, approx. 200 flats and 5 shops have been occupied.
3. There is a club house within the project and a provisions for access to its other project namely Nature Huts-3 has been provided from this project. A boundary wall has been constructed between the project. However, a gate has been provided with lock and key facility for any emergency purpose.
4. The project proponent has installed STP of capacity 400 KLD based on SBR technology. It has provided flow meter at outlet of STP and the reading of the same was noted as 5191 m3 and the record is being maintained.
5. It is pertinent to mention here that the samples from the STP outlet were collected on the previous visit dated 20.11.2025 and the results of the same as below:
pH – 7.6, TSS mg/l – 48, COD mg/l – 139, BOD mg/l – 33, O&G mg/l – BDL
In view of the above, the samples were within the prescribed limit. (Copy of the sample results enclosed)
6. The project proponent has provided dual plumbing pipeline for reuse of treated waste water and also the treated waste water from STP is being utilized in green area.
7. The project proponent has provided 01 no. borewell and provided water meter on it. Reading of water meter was 7210 m3. The project proponent is maintaining record of the abstraction of waste water.
8. The project proponent has provided mechanical composter of capacity 250 kg for the treatment of bio-degradable solid waste.
9. The project proponent has installed 01 no. of DG set of 380 KVA with proper canopy and stack height and 200 KVA will be installed soon as per the project proponent.
10. The project proponent has planted few palm trees within the premises and also planted plumeria tree along the boundary of the premises.
11. The project proponent was found complying with the additional conditions mentioned in the Environmental Clearance granted to the project proponent.

# The RO has concluded that the project proponent is complying with the conditions of the earlier granted CTO of the Board under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 as well as Environmental Clearance granted to it; and recommended that varied Consents to Operate (CTO) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.07.2028.

In consideration of the report/ recommendations of RO; if approved, the varied Consents to Operate (CTO) under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for operation & occupancy in Residential flats @492 nos. and shops @17 nos. in the project may be granted upto 30.09.2027, subject to suitable general and the following additional conditions that:
1. This Consent is valid only for occupancy & operation in 492 Residential flats and 17 no. booths/ shops in the project.
2. The promoter company shall comply with conditions mentioned in the Environmental Clearance granted to it by the SEIAA vide no. DECC/SEIAA/2020/3380 dated 05.11.2020.
3. The project proponent shall ensure operation of the arrangements provided for usage of the treated effluent after STP @ 110 KLD for flushing purpose and shall utilize the treated effluent after STP @ 26 KLD for irrigation of green/ plantation area within premises and only the remaining treated effluent shall be allowed for discharge into Sewer, in accordance with the NOC from the competent authority regarding sewerage connection.
4. The project proponent shall be bound to provide additional mechanical composter of adequate capacity as the occupancy in the project increases.
6. The project proponent will obtain necessary permission from PWRDA for abstraction of ground water, if applicable.
7. The project proponent shall start carrying out complete water auditing of the project on daily basis, immediately, so that the quantity of freshwater consumed and treated effluent utilised for activities like irrigation, dual plumbing, construction purpose can be assessed.
8. The project proponent shall ensure regular operation of the STP installed within its premises and ensure that the effluent treated shall achieve the prescribed standards at all times.
9. The project proponent shall ensure operation of the arrangements provided for usage of the treated effluent after STP for flushing purpose and shall utilize the treated effluent after STP for development of adequate green/ plantation area within premises and only the remaining treated effluent shall be allowed for discharge into Sewer, in accordance with the NOC from the competent authority regarding sewerage connection.
10. The project proponent shall provide separate flow meters after STP on channels/ pipelines carrying treated effluent for reuse in dual plumbing, discharge onto green area and disposal into MC sewer, if not already provided and maintain record regarding the same.
11. The project proponent shall make use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021.
12. The project proponent will ensure time bound compliance of the CER activities mentioned in the conditions of the Environment Clearance granted under the provisions of the EIA notification, 14/09/2006.
13. The project proponent will comply with the provisions of MSW Rules, 2016.
14. The project proponent shall ensure at source segregation of the solid waste to be generated from its premises, at all times.
15. The project proponent shall get the non-biodegradable solid waste disposed of at authorised site only, after obtaining permission from the Competent Authority and shall maintain proper record of disposal of the same, at all times.
16. The project proponent shall place adequate no. of storage bins in its premises, from where the municipal solid waste shall be got lifted and transported by the operator of the integrated MSW management facility as and when the facility is established and made operational.
17. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016.
18. The project proponent will comply with the provisions of E-waste Management Rules, 2016.
19. The project proponent shall ensure that its activities does not create any nuisance in the surrounding areas and no public complaints are received.
20. The Consent is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
21. In case the institute fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
