Earlier the consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 were granted to the subject cited stone crusher for the production of Washed Crushed Bajri @ 4000 CFT/day, Washed Sand @ 1400 CFT/day, Rori @ 2000 CFT/day & Gole Bajri @ 600 CFT/day by using River Bed Material @ 8000 CFT/Day vide online reference no. CTO/Renewal/PKT/2024/26942816 & CTO/Renewal/PKT/ 2024/26942804 dated 23/09/2024, which are valid upto 23/09/2029 respectively.
Thereafter, the stone crusher was visited by the officers of the Board on 30/12/2025 and was found non-complying with the provisions of the said acts and with the code of practice prescribed by the Board for the stone crusher.
Accordingly, show cause notice for revocation of the consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 was issued to industry along with opportunity of personal hearing on 06/01/2026, wherein it was decided as under:-
1. The consent to operate granted under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 to the stone Crusher shall be revoked/cancelled.
2. The stone crusher shall operate the unit after complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, code of practices & Environmental guidelines issued by PPCB/CPCB for such type of units.
Accordingly, the CTOs granted under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 has been revoked vide this office letter no. 112 dated 12/01/2026.
Now, the industry has applied for obtaining fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through OCMMS mode under orange category.
The industry has already deposited Rs. 18,000/- vide UTR No. 244277608 dated 23/09/2024 & Rs. 18,000/- vide UTR No. 418406431 dated 23/09/2024 & now deposited Rs. 11,200/- vide UTR No. 624236605 dated 26/02/2026 & Rs. 15,300/- vide UTR No. 686136730 dated 26/02/2026 as consent to operate fee under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 including Rs. 500/- as Form Downloading fee against total gross value of fixed assets worth Rs. 90,23,654/- as on 31/01/2026 and same are adequate upto 30/09/2030 under both Acts.
The industry was visited by Er. Maninderjit Singh Kaler, AEE on 27/02/2026 and it was observed that:-
1. The stone crusher was not in operation during visit.
2. The stone crusher has now covered the dust emitting points like Jaws/rotopactor.
3. The stone crusher has now provided chutes to the end of the conveyor belts. The conveyers are also covered to control dust emissions.
4. The stone crusher has now provided water sprinklers at the boundary of the industry.
5. The stone crusher has stabilized the approach road with river bed material within the premises and on the ramp.
6. The process regarding installation of wind breaking wall is under process.
7. The stone crusher has provided setting tanks and entire effluent is being recirculated in the process.
It is further intimated that the stone crusher has provided a letter issued by Executive Engineer Cum District Mining Officer, Pathankot vide his office letter no. 100-101 dated 03/02/2026 as per which the stone crusher was allotted to stock 66667 CFT of raw material under “Jis da Khet Usdi Rait Policy”. (Agenda Note is also attached herewith).
In view of above, it is recommended that consent to operate under Water (Prevention& control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30/09/2026 with suitable along with special conditions :-
1. The stone crusher shall comply with the orders of NGT in O.A. No 57/2020 or any relevant orders of Competent Authority in related matter.
2. The stone crusher shall maintain the plantation cover around the periphery so as to comply with the code of practice.
3. The stone crusher shall comply with the new Environmental Guidelines issued by the CPCB as well as code of practice framed for the stone crushing unit.
4. The stone crusher shall comply with the conditions mentioned in letter issued by Executive Engineer Cum District Mining Officer, Pathankot vide his office letter no. 100-101 dated 03/02/2026.
