File Note: • The case has been examined in light of the show cause notice issued and reply of the industry…………..... • The PP has submitted that they will install STP of capacity 15 KLD, however quantity of wastewater remain 13.65 KLD. They will use 6.4 KLD treated water for flushing by providing dual plumbing and remaining 7.25 KLD shall be utilized for plantation / green area to be provided in the project. Further, the plan showing wastewater conveying line from outlet of STP to toilet & green area with blue colour conveying line and green area has been closed herewith for reference. RO has reported that arrangement made by the PP for waste water treatment seems to be adequate and has recommended for grant of NOC…………… • The project proponent has applied for Consent to Establish (CTE)/NOC for setting up a commercial colony named Rampura Commercial Complex over an area of 4.45 acres at Rampura Phul, District Bathinda, comprising 99 shops……………. • The PP has submitted copy of the approved layout plan by Senior Town Planner, Bathinda vide no. CTP(LG)-2025/1798 dt. 14.07.2025…………….. • The PP has submitted grant of CLU and to Approve the Layout plan of our Commercial Colony "Rampura Commercial Complex" in Rampura Phul, Tehsil: Rampura Phul, District Bathinda from ADC UD vide letter no. 337 dt. 25.08.2025……… • The project cost is Rs. 696.7 lakhs and the applicable NOC fee of Rs. 18,000/- (Orange Category) has been deposited, which is adequate for one year………….. • As per the approved layout plan, the total salable area is 7575.03 sqm. Considering FAR of 2.1, the total built-up area works out to 15,907.56 sqm, which is below 1,50,000 sqm; hence, the project does not attract the provisions of the EIA Notification 2006…………….. • The PP has proposed to discharge only 7.25 KLD of treated effluent onto land for plantation, to handle that much amount of effluent plantation along the road side/ boundary is sufficient, as such no specific area is required to earmarked for such a small quantity of effluent………….. • As per RO report, the waste water generation of 13.65 KLD in the application form, which is in consonance with the water balance submitted in the feasibility report. But the PP mentioned mode of disposal for reuse @ 6 KLD and effluent for plantation @ 7.25 KLD in the waste water disposal column, which may be due to typing error and same may be considered as 6.4 KLD for reuse and 7.25 KLD for plantation/road washing as already mentioned in the feasibility report……………. • RO has reported that the site inspection conducted on 03.02.2026 confirmed that the land has been secured with boundary wall and the location is suitable, with no air-polluting industry within 100 meters and no MAH unit within 250 meters……….. • As per RO reported, the proposal is adequate under the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981………… • RO has recommended that consent to establish/NOC for the commercial colony be granted for a period of one year with suitable conditions. In view of the above facts and report of RO, it is recommended that consent to establish (NOC) under the Water Act, 1974 and Air Act, 1981 may be granted to the PP for one year for development commercial colony in an area of 4.45 acres comprising 99 shops for discharge of domestic effluent @ 13.65 KLD (6.4 KLD treated water for flushing by providing dual plumbing and remaining 7.25 KLD shall be utilized for plantation / green area), subject to the suitable conditions alongwith special conditions that:- 1. The consent to establish (NOC) is being granted for the development of commercial colony in an area of 4.45 acres comprising 99 shops and in case any of the documents submitted by the project proponent are found forged/incorrect, the consent to establish granted to the project would be deemed to have been cancelled and the Board would not be responsible for the cost incurred by the project proponent in the matter…………….. 2. The project proponent shall not use fresh water for green belt or plantation within the project premises and shall make adequate arrangements for reuse of treated effluent through dual plumbing for flushing and irrigation of green areas within the premises………….. 3. The project proponent shall establish only single-story commercial shops and will utilize 6.4 KLD treated water for flushing by providing dual plumbing and remaining 7.25 KLD shall be utilized for plantation / green area.………….. 4. The project proponent will install the STP of adequate capacity as proposed, simultaneously with the commissioning of the project………. 5. The project proponent shall not abstract or utilize groundwater for any purpose without obtaining prior permission/NOC from the Central Ground Water Authority (CGWA), Punjab Water Regulation Authority or any other competent authority, as applicable from time to time. 6. The project proponent shall install and commission the Sewage Treatment Plant (STP) of adequate capacity as proposed prior to occupation/commissioning of the colony or any part thereof and shall ensure its proper operation at all times. 7. The project proponent shall ensure that the total built-up area (FAR basis) of the project remains below the threshold prescribed under the EIA Notification dated 14.09.2006. In case the total built-up area exceeds 1,50,000 sq. m. or the built-up area of any individual plot exceeds 20,000 sq. m., prior Environmental Clearance shall be obtained before undertaking further construction activities. 8. The project proponent shall obtain Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 from the Punjab Pollution Control Board prior to occupation or operation of the colony or any part thereof. 9. The project proponent shall provide necessary monitoring arrangements including online monitoring systems, wherever applicable as per directions/guidelines issued by CPCB/PPCB from time to time, for monitoring the performance of the Sewage Treatment Plant and compliance of discharge standards. 10. The project proponent will ensure that the municipal solid waste generated from its colony is handled in an environmentally sound manner and the Bio degradable solid waste shall be managed through in-house treatment, in compliance to the Solid Waste Management Rules, 2016 and also comply with the applicable provisions for bulk waste generators under the Solid Waste Management Rules, 2026 which will come into force w.e.f. 01.04.2026……... 11. The project proponent shall also develop the vermi-composting/composting to manage the biodegradable solid waste and shall not throw, burn or bury any solid wastes in open, outside premises or in drain / water bodies………. 12. The project proponent shall undertake Corporate Environmental Responsibility (CER) activities including awareness programmes for environmental protection and promotion of environmentally sustainable practices. 13. The project proponent shall ensure strict prohibition on use of single-use plastic and thermocol disposable items such as water bottles, pouches, cups, plates, forks, spoons, straws and decorative materials made of plastic, thermocol or any other non-biodegradable material within the project premises. 14. This Consent to Establish is issued from the pollution control angle only. The project proponent shall obtain all other statutory clearances and permissions from the concerned departments, as required under applicable laws. Competency : SEE
